processed as a Special Review in accordance with Common Development Review Procedure set
forth in Chapter 26.304. The Special Review shall be considered at a public hearing for which
notice has been published, posted and mailed, pursuant to Section 26.304.060(E)(3)(a, b, and c).
Review is by the Planning and Zoning Commission.
A Special Review from the Stream Margin Review Determination may be approved, approved
with conditions, or denied based on conformance with the following review criteria:
1. An authorized survey from a Colorado Professionally Licensed Surveyor shows a
different determination in regards to the top of slope and 100-year flood plain than the
Stream Margin Map located in the Community Development Department and filed in the
City Engineering Department; and
2. The proposed development meets the Stream Margin Review Standard(s) upon which the
Community Development Director had based the finding of denial.
F. Building Permit Submittal Requirements. Prior to receiving a building permit for a
property within the stream margin review area, the following must be submitted:
The applicant shall record a site improvement plat with topography prepared by a
Colorado licensed, professional surveyor showing the building envelope determined by
the Community Development Director based on the Stream Margin Review Map located
in the Community Development Department.
Site sections drawn by a registered architect, landscape architect, or engineer shall be
submitted showing all existing and proposed site elements, the top of slope, and pertinent
elevations above sea level.
3. The building envelope shall be barricaded prior to issuance of any demolition, excavation
or building permits. The barricades shall remain in place until the issuance of Certificates
of Occupancy. (Ord. No. 45-2001, § 3)
Editor's note--Ord. No. 45-200], § 2, repealed former § 26.435.040, pertaining to Stream Margin
Review and Ord. No. 45-2001, § 3, enacted a new § 26.435.040 as herein setout. Former §
26.435.040 was derived from Ord. No. 47-1999 § 3; Ord. No. 52-2003, §13
26.435.050 Mountain view plane review.
A. Applicability. The provisions of mountain view plane review shall apply to all
development located within the following established mountain view planes, unless exempted
pursuant to Section 26.435.050(B).
1. Glory Hole Park View Plane. There is hereby established a view plane originating from
Glory Hole Park above which plane no land use or building shall project. The reference
point bears N. 19° 06' 00" W. a distance of 919.85 feet from Corner 1 of the Aspen
City of Aspen Land Use Code. June, 2005.

Townsite, a 1954 BLM brass cap; the reference base line bears N. 55° 04' OS" E. a
distance of 73.00 feet from the reference point. Elevation is 7,947.5 *1 feet above sea
level. The view plane consists of two (2) spatial components more pa cularly described
as follows:
a. All that space which is within the projection of a sector of 9° 54' 00" described by
two (2) radial lines which bears S. 44° 49' S5" E. and S. 34° 55' S5" E. respectively
from the reference point, and which is also above the view plane which passes
through the reference base line at the inclination of 3° 30' above horizontal.
b. All that area within the projection of the following described perimeter and which is
also above the view plane which passes through the reference base line at an
inclination of 3° 30' above horizontal. The perimeter is more fully described as
follows: Beginning at the reference point, thence N. 55° 04' OS" E. a distance of 73.00
feet along the reference base line; thence S. 34° 55' S5" E. a distance of 418.27 feet to
a point on the northerly radial line of the view sector; thence N. 44° 49' S5" W. along
said radial line a distance of 424.59 feet to the reference point.
2. Wagner Park View Plane. There is hereby established a view plane originating in the
north central part of Wagner Park above which plane no land use or building shall
project. The reference point bears N. 58° 03' 11" E. 198.65 feet from the northwesterly
corner of Block 83, Original Aspen Townsite; elevation of the reference point is 7,919.73
feet above mean sea level. The view plane consists of a sector component more
particularly described as follows: All that space which is within the projection of a sector
of 9° 46' 18" described by two (2) radial lines which bear S. 36° OS' 49" E. and S. 45° 52'
07" E. respectively from the reference point and above a plane which passes through the
reference point at an inclination of 3° 39' 10" above the horizontal.
3. Cooper Avenue View Plane. There is hereby established a view plane originating on the
northerly side of Cooper Avenue easterly of Galena Street above which plane no land use
or building shall project. The reference point bears N. 75° 41' S2" E. 147.78 feet from the
northwesterly property corner of Block 96, Original Aspen Townsite, an aluminum cap
located in the sidewalk. Elevation of the reference point is 7,926.75 feet above mean sea
level. The view plane consists of spatial components more particularly described as
follows: All that space which is within the projection of a sector of 48° 00' 00" described
by two (2) radial lines which bear S. 11° 41' 08" E. and S. 36° 18' S2" W. respectively
from the reference point, and above a plane which passes through the reference point at
an inclination of 6° 20' OS" above the horizontal.
4. Court House View Plane. There are hereby established two (2) view planes originating
from the sidewalk on the northerly side of Main Street easterly of Galena Street above
which planes no land use or building shall project.
a. View Plane Number One. The reference point bears S. 79° 43' 29" E. 69.00 feet from
the southwesterly property comer of Block 92, Original Aspen Townsite; a plastic
survey Cap. Elevation of the reference point is 7,912.32 feet above mean sea level.
The view plane consists of spatial components more particularly described as follows:

Scott Nystrom, James Breasted,, Ramona Markalunas, and City Attorney Sandra
Stoller.
Councilman ~?ystrom moved to approve the minutes of April 23, 1973 as prepare:
and mailed by the City Clerk. Seconded by Councilman Breasted, All in favor,
motion carried.
Councilman Nystrom moved to approve the accounts payable as submitted,
Seconded by Councilman Breasted, Roll call vote - Councilmen [Jystrom aye;
Breasted aye; Markaluraas aye; Mayor Homeyer aye. Motion carried,
Aest Side Mr, Robert Marsh was present (letter of requests
Improvement previously'submitted to Council) to review with the
Association Council the Association's requests - i,e, density,
violations of occupancy, etc, See letter on file. Mr,
Marsh stated the letter has been answered by the City
Manager, Further request to go on record the West Side
Improvement Association agrees with straight across the
board of down zoning, not. just certain areas of the
comm~m ity, The group is represented by 120 family
memberships and extends from the north side of Main
Street from Hallam to the river,

View Control Mayor Homeyer opened the public hearing, resolution of
the Planning and ?,oning Commission recommending approval
was submitted, Mr, Bartel, City/County Planner stated
this proposal is being made in two parts: (1) general
provision to be made a part of Chapter 24 allowing view
plains or view corridors to be established; (2) specific
view plain from Glory Hole Park of Independence Pass.
Mr. Bartel reviewed with Council maps and slides of the
view plain from Glory Hole Park. Further explained each
view corridnr or plain will have its own criteria depend-
ing on the circumstances involved, Ordinance does limit
view corridors or plains from .public places only.
There being no further comments, Mayor Homeyer closed the
public hearing.
Trails Plan Mayor Homeyer opened the public hearing, resolution of the
Planning and Zoning Commission was submitted recommending
approval. Mr, Bartel explained this would be an amend-
meat to the 1966 General Plan to include the trails plan
(map submitted), Mr, Bartel further explained the plan
is not specific as to a description, this is left flexible
as development occurs. This amendment is proposed as an
addition to the required 47, 3edication as the basis for
the 47, is for park areas, schools etc. in developments in
the outlying areas, Trail specifications will be as
established by the forest service.
There being no further comments, Mayor Homeyer closed the
public hearing,
Opp Space Mayor Homeyer opened the public hearing, Building
ReQuiremenC, Inspector Clayton Meyring reviewed with the Council the
C]:arification proposed ordinance. Ordinance is merely to clarify the
existing requirement.
Council questioned the requirement of living plants etc.

Meeting was called to order by Chairman James Adams at 5:05 p.m.
with Charles Collins, Victor Goodhard, Bruce Gillis, Barbara Lewis
and Charles Vidal. dlso ;resent City/County Planner Herb Bartel
and Building Inspector Clayton Meyring.
Gillis moved to approve the minutes of April 3, 1973, seconded by
Lewis. All in favor, motion carried.
iew Control - Chairman Adams opened the public hearing. Planner
Bartel outlined the amendment as (1) a general amendment to the
zoning code to allow for the establishing of view corridors and
(2) specific corridor from Glory Hole Park of Independence Pass.
Charles Vidal excused himself from the table due to conflict of
interest, also Barbara Lewis.
Planner Bartel utilized slides and map to outline the view corridor
or plain from Glory Hole Park. Emphasized the line shown on the
slide is the bottom of the plain. No building would be allowed in
the corridor to exceed in height above the base of the plain line.
Corridor is approximately 70' wide within the park and expands as
you progress towards Independence Pass.
Discussed view corridor vs a view plain. Mr. Gaudino stated he
felt a corridor would be from ground level up., N.r. Bartel further
explained the engineers call it a view corridor. The line shown
on the slide and as defined in the ordinance is the bottom of the
view corridor. It would be impossible to maintain a corridor from
the total park or area.
Janet Landry also stated she felt the corridor should extend to the
ground . . r ,
Mr. Bartel further explained the strongest point for view control
is to protect views from public places.
Discussed a corridor through the DRC and Shareholders properties
going from ground level.
Chairman Adams closed the public hearing.
Goodhard moved to aiaend the supplementary regulations to provide for
maintaining of mountain views. Seconded by Gillis. All in favor,
motion carried.
Gillis moved to recommend to the City Council adoption of the
specific view corridor as recommended for Glory Hole Park of
Independence Pass. Seconded by Goodhard. All in favor, except for
Collins who voted nay. Motion carried.
Destination Resort Corporation - Final Outline Development Plan.
Mr. "Skip" Behrhorst reviewed with the Commission the plan, Mr.
Bartel stated the plan is in full compliance and this matter before
the Commission is a matter of review to see that all requirements
of the preliminary outline development plan have been met.
Mr. Behrhorst stated thbre were three items which the City Council
request be made a part of'the plan: (1) create adequate right of
way through West End Street, triangle that will be dedicated to the
City; (2) committment to the shuttle bus service - wording on the

Doug Fogarty and I checked the lowest vertical
angle represented on Sheet VI of Destination
Resort - Aspen Ltd.'s presentation to the
Aspen City P&Z and the Aspen City Council.
This angle is 3°30'00" above horizontal. This
figure has now been noted on Sheet VI.
Please advise if I can be of further assistance.

Commission agreed they did not like the containers and Mr.
Goodhard informed the Commission. 50 gallon size is nct

Reported and request comments from the Commission as relate:
to areas where controls could be designated as relates to
the view of Aspen Mountain and Independence Pass, i, e.
Garmisch Street and all streets leading to the mountain
would relate to the view of Aspen Mountain. Vidal question-
ed the changes that might eccer when the transportation
study is completed.
