RECORD OF PROCEEDINGS 100 Leaves RESOLUTION) N0. -' ~.~- (Series of 1984) A RESOLUTION OF THE ASPEN CITY COUNCIL DECLARING ITS OPPOSITION TO THE STORAGE AND TRANSPORTATION OF RADIO-ACTIVE SUBSTANCES AND OTHER HAZARDOUS MATERIALS IN THE CITY OF ASPEN AND ALONG INTER- STATE HIGHWAY I-70 WHEREAS, the City of Aspen, Colorado, is a home rule munici- pality existing under and by virtue of the Constitution and laws of the State of Colorado with all of the powers conferred thereby; and WHEREAS, the City Council has received an application from the Commonsense Coalition, including Tom Henton, Maxwell Aley and Paul M. Crawford, to enact legislation declaring the City of Aspen as a "Nuclear-Free Zone"; and WHEREAS, the City Council finds that contamination by radio- active and other hazardous substances, by accident or intent, pre- sumptively interferes with the tourist and residential character of the City of Aspen and would have an adverse effect on the residents, visitors, businesses and wildlife in the Aspen area; and WHEREAS, because Interstate Highway I-70 is the main ground route for visitors and inhabitants traveling to and from Aspen, the City Council also opposes the transportation of radio-active and other hazardous substances along Interstate Highway I-70; and WHEREAS, the City Council is aware that certain court deci- sions have limited the ability of local governments to ban or regulate the transportation and storage of radio-active and other hazardous materials on state and federal highways; and WHEREAS, the City Council desires to declare its opposition to the storage and transportation of radio-active and other haz- ardous materials in the City of Aspen and along Interstate Highway I-70, and therefore desires that the City Manager and City Attor- RECORD OF PROCEEDINGS 100 Leaves FOPM ~p OECKEL 9. B. 9 ney recommend a program for prohibiting or regulating the storage and transportation of radio-active and other hazardous materials in the City consistent with the City's legal authority in such matters. NOW, ^1HEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ASPEN, COLORADO: Section 1 The City Council of the City of Aspen, Colorado, hereby declares its general opposition to the storage and transportation of radio-active substances and other hazardous materials in the City of Aspen and along Interstate Highway I-70. Section 2 The City t,~anager and City Attorney are hereby directed to develop a work program for making recommendations to determine what positive steps the City Council can take to prohibit or regu- late the storage and transportation of radio-active and other hazardous substances in the City of Aspen. Section 3 The City Clerk shall certify a copy of this resolution to the Governor of the State of Colorado, and such other local, state and federal officials, as the City Manager may deem appropriate.
