MINUTES OF JUNE 30.2010
Terry Butler called the meeting to order at 8:30 a.m. Commissioners in
attendance were: Bill Dinsmoor, Fred Ayarza, Andrew Kole, Don Sheeley,
Mark Zitelli and John Starr. Mark Goodman was excused.

Ed said the focus is to maintain adequate fire access on the two malls in case
of an emergencies. Emergency vehicles means fire trucks, ambulance and
police vehicles. Using the fire lane at the Red Onion restaurant would
compromise life safety on the Cooper Ave. mall.
Andrew said the Hyman mall is problematic because of the statue. On
Cooper Ave. why can't 12 tables for the Red Onion be used for three or four
months.
Ed said we need access and we don't have it on the north side. You are
sitting having dinner and why did you sit us here in a fire lane. With the
trees in the middle we can do aerial service. We will not park a truck in
front of a building that is burning.
Don said he would prefer not to have anything in the mall. Don also inquired
about Mustang restaurant.
Ed said we have been working with mustang. We can fight fire from the
corner two adjacent buildings because they are completely sprinkled.
Don suggested CCLC take a ride in a fire truck down the mall.
Andrew asked what area can't be reached on the mall. I don't see where 12
tables can't be evacuated.
Ed said the third floor of Red Onion isn't sprinkled.
Ed asked CCLC if they are willing to take the liability?
Bill said CCLC has the task of overseeing alfresco dining. This has come up
a number of years as restaurant come and go. There is nothing specific. We

are never sure where alfresco dining can occur. Business people do not
understand. We need the confusion organized.
Steve Barwick said every physical space is different and you can't codify
everything. When is too much alfresco dining too much. It is the totality
that people are concerned about. It will never be perfect.
Bill said we need clarity for our businesses that come to us. We need
guidelines.
Steve said he would draw some absolutes.
Daryl said the requirements are driven by national law. We need to be there
within seven minutes. This includes water supplies etc. Some buildings are
fully fire protected.
John Stan asked if the fire department has a building by building plan? If
they do can we build it into a plan. If we have that then we know the rules.
Daryl said they are working toward a system with a map that shows where
the water etc. is located in each building.
Andrew said it seems arbitrary to people on Cooper that the only lane is the
one that is littered with signs. If there was a fire it would be harder to clear.
Why wouldn't you be vigilant on Cooper? There should be some middle
ground.
Trish Aragon, Engineering Dept. said we need fire access and pedestrian
access on each mall.
Ed said we work with everyone. If we have to set up an aerial operation it
has to be in the center of the mall. We need dedicated fire lanes. Crested
Butte and Telluride have dedicated fire lanes in their malls. When that
discussion occurred about the Red Onion it wasn't about tables it was about
fire access. I talked to Texas and they have issues with fire fighting and life
safety and retrofitting the downtown core with fire sprinklers. All the cities
are supplying the water and the building owners are responsible to set up the
fire instillation (sprinkler systems). Putting tables in the mall is not an
option.

Fred said we are asking for clarity and we don't want to put people out there
that have a disadvantage. We need to know where we are going. In this day
in age people are struggling.
Ed said it seems capricious because we are doing it case by case. On three
story buildings we need to be in the middle of the mall. We can't put the
truck in front of a burning building.
Fred said we are talking about the vitality of the mall.
Ed said where do I draw the line of life safety v.s. commercialism.
Andrew said it seems that there should be some middle ground. Could they
have six tables?
Bill asked if Mustang and the Red Onion could have a fire drill that is
amenable for the fire department. Ed said no.
Ed said the police cars come in from the Bentley Restaurant side.
Steve said Ed has made his mind up. Long term sprinkling is a good idea.
Ed said if that occurs then we would need smaller trucks etc.
Terry said she wished her building was fully sprinkled.
Signage:
Steve Barwick pointed out that all the businesses have taken advantage of
signs and merchandising etc. Staff met last week and there is a vending
agreement in place with the city manager. There will be three different
ranges of fees. We will do a diagram and take a photo of the merchandise
that is on display for our records.
Steve said what works at Boogies doesn't work in the mall. Other places are
different.
Fred mentioned the graffiti on the newspaper boxes. Staff said the only way
newspaper boxes can be moved is with life safety issues.

Don asked what is going on with the Power Plant Road. Steve said they are
experimenting with a no left turn.
Trish said the clearance for pedestrians is six feet on the sidewalks and the
malls. When they put the heaters out then creep occurs. Trish said we are
trying to get everything organized for the 4`h of July. There is a two foot
area that is needed for the door of a car. There is also a 7 foot clearance for
umbrellas. On planters 27 inch height including planter is needed.
Terry recused herself.
Bill said he has a concern with Louis Swiss selling sandwiches. It competes
with Little Annie's.
MOTION: John made the motion to now allow Louis Swiss to sell
sandwiches; second by bill. Motion failed 4-2.
