SUMMARY: On behalf of the North of Nell, Randy Wedum of Wedum and Associates PC has applied for an Insubstantial Amendment to the approved North of Nell Subdivision and Planned Unit Development (Ordinance No. 36, Series of 2007) to approve a Master Sign Plan (the • "plan"). REVIEW PROCEDURE: The Community Development Department may approve, approve with conditions, or deny an insubstantial amendment to an approved PUD pursuant to Land Use Code Section 26.445.100, Planned Unit Development (PUD). STAFF EVALUATION: The North of Nell (the "property") is a large mixed -use building just outside of Aspen's Commercial Core (CC) zone district. The property, approximately 275 feet in length, runs the distance of the block which is bounded by South Galena Street and Gondola Plaza. The main level of the property includes several retail and restaurant establishments. Given the sheer size of the building, there is a difficulty meeting the City's Sign Code, specifically the system for signage allotment. Under a strict application, each facade of the property would only receive 20 square feet of signage to be shared amongst all tenants with store frontage on that facade. This is not such an issue for the east and west facades of the property, but becomes a significant hardship on the north and south (the longer) facades where the majority of storefronts exist. This Applicant's proposed master sign plan (the "plan") intends to alleviate this hardship • and grant each tenant an equal and fair amount of signage. Additionally, this sign plan Page 1 of 5 • mimics the existing conditions on the property itself. The plan accomplishes the following major items: • Grants two (2) square feet of window signage per tenant. The location of this signage will not be predetermined by the plan, and the window cut-out letter signs shall be considered wall signs and their aggregate area shall be credited toward allowable sign area at one-half the measured area. • Allows a variance the tenant identification signs that hang from the property's overhang. The lowest point of these signs will be at seven (7) feet six (6) inches, instead of the required eight (8) feet. • Allows twenty (20) tenant identification signs at six (6) square feet a piece. These hanging or projecting signs will be placed around the perimeter of the building in front of the applicable business. • Allows four (4) building entry signs of 5.93 square feet a piece at the buildings four primary entrances. • Allows for four (4) logo signs of 2.9 square feet each on the two ends (east and west) of the building. • • If tenant spaces are combined or divided and a sign is needed in a new location, the Master Sign Plan shall be amended accordingly. (*Note: All other approvals of this plan are included in the approved document. The lighting standards of Section 26.510 of the City of Aspen Land Use Code shall apply to this property) Staff supports the proposed PUD amendment to the North of Nell. This signage master plan represents a reasonable approach for signage, given a property that simply does not fit the mold of the City's Sign Code. The proposal does not request any type of signage that is obtrusive, over -sized, or unreasonable in contrast to those regulations in the Sign Code and the surrounding neighborhood. Staff has reviewed the proposed amendment and finds that request meets the criteria for an insubstantial amendment pursuant to Section 26.445.100, Amendment of a PUD Development Order and Section 26.510, Signs of the City of Aspen Land Use Code. Staff recommends approval of the proposed Master Sign Plan. DECISION: The Community Development Director finds the Insubstantial PUD Amendment for the North of Nell to be consistent with the review criteria (Exhibit B) and thereby, APPROVES the amendment as specified below. • The approved Insubstantial PUD Amendment for the North of Nell allows for the creation of a Master Sign Plan. The following shall not be considered an insubstantial amendment: 1. A change in the use or character of the development. Staff finding: This Master Sign Plan will not constitute a change in character for the North of Nell building. The plan creates a uniformed system of signage allotment for a property that is clearly too large to reasonably meet the standards of the City's Sign Code. The plan will alleviate enforcement hardships and avoid the scenario of inadequate signage for some tenants. Staff finds this criterion met. 2. An increase by greater than three (3) percent in the overall coverage of structures on the land Staff finding: • Not applicable. 3. Any amendment that substantially increases trip generation rates of the proposed development, or the demand for public facilities. Staff finding: Not applicable. 4. A reduction by greater than three (3) percent of the approved open space. Staff finding: Not applicable. 5. A reduction by greater than one (1) percent of the off-street parking and loading space. I This application is for a universal signage for the entire building. There are existing tenant signs on the north, west and east ends of the building, and do to the remodel, there will be tenant signs on the south. These are all projection signs hanging under the overhang of the building except one hanging from a beam. The building would like to make a universal sign frame and mounting system for the majority of the tenant signs as ' projection signs hanging from the building overhang. The frame and support will be provided by the building and the tenants will provide their own signs to fit inside. 11 There will be two existing signs to remain and one sign that will have to be long and short and mounted directly to the covered walkway ceiling, this frame and mounting is also provided by building and sign by tenant. The universal sign frame is mounted to comply with the 4' off the building wall, but due to the shortness of the overhang of the building, would not comply with the 8' to the bottom of the sign requirement. It would however be at T-6" and is the reason for the PUD amendment. The two existing signs would comply with some minor modifications. All of the existing tenant signs would be removed, most of which do not meet the 8' requirement, and 10 replaced with the new sign. The building entry signs to the mall are on four sides of the building and comply with all requirements. There were two before and now they will be all new and old entrances. There will be Logo signage of the Letters of the building on the ends of the building up high, as were similar signage on the building previously. The building has enough signage area for all signs and has enough on each elevation for the amount used. The only item that needs consideration is the height to the underside of the sign from the City of Aspen sign code. Provided are a set of drawings containing the sign area calculations, sign fronts, elevations and plans with sign types noted and a sign detail sheet of other views and construction.
