FIRST AMENDMENT TO THE PUD AGREEMENT FOR THE MAROLT RANCH AFFORDABLE HOUSING PROJECT This Amendment to the Agreement is made this 8th day of May, 1997, between ASPEN/PITKIN COUNTY HOUSING AUTHORITY ("Lessee") and the CITY OF ASPEN, a municipal corporation (the "City"). WHEREAS, the Lessee has experienced problems with the parking of unauthorized vehicles at the Marolt Ranch Affordable Housing Project (the "Project") during the Winter months; and WHEREAS, the Lessee needs to control unauthorized parking at the Project both for the safety and the convenience o f residents authorized to park at the Project; and WHEREAS, the PUD Agreement does not permit the physical control of parking because of a shared use provision of the Agreement with respect to users of the Marolt Open Space; and WHEREAS, there is minimal use of parking by Open Space users during the Winter months and any parking needs can be provided at other parking locations; and WHEREAS, an Amendment may be entered into between the Lessee and the City to modify the provision with respect to parking. NOW, THEREFORE, in consideration of the mutual covenants contained herein and he approval, execution, and acceptance of the Amendment for recordation by the City, it is agreed as to amend Paragraph 6. Parking of the Agreement to read as follows: 6. Parking. There shall be one fifty-space parking lot provided on the Marolt Park sit for joint use with open space users from May 15 through September 15 of each year. Lessee may restrict access by use of a gate or similar device during the Winter months. The applicant is proposing two gates, one electric and one fixed, and an adjustable lighting fixture to be used on the existing poles. The above mentioned problems were brought to the attention of City Council. The Council directed the Housing Authority to address the problems with a gate and additional downcast lighting. In reference to lighting, the original PUD agreement states outdoor lighting shall be downcast fixtures. The applicant is proposing to replace the existing downcast fixtures with adjustable (tilting) fixtures to address the inadequate light in the parking lot. Staff believes this is not consistent with the original PUD agreement and is not appropriate for authorization by the Director, The applicant is encouraged, however, to address the lack of lighting with either brighter bulbs in the existing fixtures or with additional downcast fixtures. In reference to parking, section 6 of the PUD agreement states there shall be one fifty-space parking lot provided on Marolt Park site forjoint use with open space users, This implies the parking lot shall be open to the general public at all times. The Housing Authority has proposed two gates that would restrict entry to the parking lot from September 15 through May 15 of each year, but would remain open during the Summer months. In light of Council's directive, Staff feels the proposed gate would be consistent with the original PUD agreement and is an insubstantial amendment appropriate for authorization by the City Manager. An amendment to the plat is not necessary. Section 16 the PUD agreement between the Aspen/Pitkin County Housing Authority and the City of Aspen states "this Agreement may be altered or amended only by a written instrument executed by both parties." The City Manager has the authority to act on behalf of the City. The Executive Director ofthe Housing Authority may act on behalf of the APCHA. Staff recommends section 6 of the PUD agreement be amended in the following way: .. 6. Parking. Due to the restrictions imposed by this designation, enforcement of illegally parked cars is constant. The major problem encountered by management in this area is that of procuring a tow truck on a timely basis, particularly on snowfall days. Another problem being addressed by this application is that of inadequate lighting in the parking lot caused by the use of downward casting lights only being allowed at the project. Auto vandalism and a general feeling of insecurity by tenants has been a result ofthis problem and has been noted by the police department officers on several occasions. In a recent meeting by the city council, the housing department was directed to address these two problems by the installation of an electric access gate and additional downcast lighting in the parking lot. The following is a general summary of the proposed solutions for submission to the planning department: GATE INSTALLATION The unique design of the Marolt parking lot requires that in fact, two gates will be necessary for adequate control of vehicles. One gate will be non-electric and will be installed merely to deny access for that entrance. The other gate proposed will be operated by electric remote controls which will be provided for tenants wishing to purchase a permit for use of this amenity. The introduction of these gates should reduce the amount of enforcement required in the regulation of the auto disincentive concept. LIGHTING To avoid unnecessary cost and unsightliness, management proposes that rather than add additional lights, current light fixtures be changed to a more adjustable downcast head piece (fig. ).
