RE: A-1 T.V., INC. - Conditional Use
NOTICE IS HEREBY GIVEN that a public hearing will be
held before the Aspen Planning and Zoning Commission on Tuesday,
January 3, 1984, at a meeting beginning at 5:00 P.M., in the
City Council Chambers of City Hall, 130 S. Galena, Aspen, Colorado,
to consider the application of A-1 T.V., Inc. to occupy the space
at the Truman Center which was formerly occupied by Michael Scott,
directly next door to Clark's Market, 300 Puppy Smith Road, Aspen,
Colorado.

Having reviewed the above application, the Engineering
Department has the following comment:
The applicant already has space in the Truman Center.
The Engineering Department has no record of a special review
for the applicant's use of its current space. Since
the space relocation does not involve a change in space
size, it is not anticipated that the relocation would
impact engineering concerns except perhaps as regards to
the electric paver requirements to be supplied to the space.

Re: Application for Conditional Use Approval A-1 TV Inc.
Dear Collette:
This firm represents A-1 TV Inc. A-1 has been presented
with an opportunity to lease and occupy a portion of the premises
formerly occupied as an interior design shop by Michael Scott in
the Truman Center at 300 Puppy Smith Road in Aspen. A-1
currently occupies basement space lying below Clark's Market in
the same complex. Our client feels that relocation to the first
floor level will greatly enhance its retail exposure and requests
by this letter conditional use approval to move its operation to
the new premises. The exact premises proposed to be occupied by
A-1 is the easterly portion consisting of roughly one-half of the
premises formerly occupied by Michael Scott. Those premises
consist of 1,000 square feet more or less. A-1 currently
occupies, in its present location, 1,000 square feet more or
less, of space. The proposed operation by A-1 in its proposed
location would be the sales and servicing of television, stereos
and other audio and video equipment; and accessories thereto,
together with the sales of tapes, records and video tapes. It is
contemplated that the rental of video tapes may also be a part of
the operation in its new location.
It is our understanding that both space currently occupied
by A-1 and the new proposed location are designated as
Neighborhood Commercial (NC) and that television and stereo
stores are conditional uses in the Neighborhood Commercial
district. We request that you place this matter before the
Planning and Zoning Commission for its earliest possible consid-
eration in early January of 1984. Enclosed you will find A-1's
check in the amount of $465.00 as the fee for the filing and
processing of this matter.

the basement space presently occupied to the vacant
upstairs space between Clark's Market and Pyramid Travel)

REFERRAL COMMENTS:
The City Attorney's Office had no comment.
The City Engineering Department comments that the applicant already
has space in the Trueman Center. Also, since the space relocation
does not involve a change in space size, it is not anticipated that
the relocation would impact engineering concerns.
PLANNING OFFICE REVIEW:
A TV sales and service shop is a conditional use in the neighborhood
commercial zone. This shop presently occupies approximately 1000
square feet in the lower level of the Trueman Center. The proposed
relocation is to an upstairs space between Clark's Market and Pyramid
Travel which will also be approximately 1000 square feet. Since the
change of location is within the same building, utilizing the same
services and parking, it seems reasonable that this move will have few
additional impacts or requirements. Initial conditional use approval
was given to A-1 TV at the October 23, 1979 Planning and Zoning
Commission meeting.
No structural enlargement is proposed, or expansion of square footage.
The modifications are rather insubstantial in that the business may
include rental of video tapes and sales of tapes and records.
This change of location will have no impact on pedestrian and vehicular
traffic circulation, parking or noise; there is no affect on the
tourist or local orientation (except that it will be more easily
accessible); and the neighborhood character will not be affected. This
use has been found to be compatible with surrounding land uses in the
past and this remains unchanged in our opinion. The retail square
footage and employee base remain unchanged and no external modifications
are proposed to the building or site.
Recently, the Emporium Fabric Shop completed conditional use review
for this same space. They ultimately decided not to make the move from
their present location. As part of that review, Pyramid Travel
requested and was granted approval to expand into approximately 400
square feet of the space.

Pyramid is now proposing to split the area with A-1 TV such that
Pyramid increases by 708 square feet. Pyramid received a conditional
use permit last year. The approval to expand the travel agency which
was granted in September of this year was for 400 square feet. It was
found that this increment of increase would not alter Pyramid's
compliance with the conditional use criteria. It is our opinion that
this is the case with 700 square feet also.
PLANNING OFFICE RECOMMENDATION:
The Planning Office recommends granting an expansion of the
conditional use permit for Pyramid Travel to occupy an additional
708 square feet. We further recommend approval for A-1 TV to move
from their basement space to Space 205 of the Trueman Center,
occupying approximately 1000 square feet of that space and expanding
into sales of records and tapes and rental of video supplies.
