NOTICE IS HEREBY GIVEN that a public hearing will be held before
the Aspen Planning and Zoning Commission on Tuesday, May 17, 1983 at a
meeting to begin at 5:00 p.m. in the City Council Chambers of City Hall,
130 S. Galena Street, Aspen to consider a conditional use application for
a frozen yogurt shop to be located at 308 S. Hunter Street (the Centennial
Building),in the C -1 zone district,on the 2nd level. for further informa-

Applicant's
Request: The applicant is requesting conditional use approval
to locate a frozen yogurt shop in the Centennial
Building.
Referral
Comments: The Engineering Department has no areas of concern.
The Environmental Health Department anticipates no
adverse impacts in the areas of noise or drainage.
The shop will be on the City of Aspen public water
system and Aspen Metro Sanitation sewer system which
are in conformance with policies of this department.
As the proposal is presented, there will be no need
to install a ventilation system at this time. The
conditional use will be required to comply with all
applicable state food service rules and regulations
and all local building code requirements. This
must be accomplished prior to issuance of a Colorado
Food Service License.
Planning Office
Review: The C -1 zone lists as a conditional use a "coffee
shop or food service intended as a non - tourist
oriented sit -down facility with a limited fare of
specialty items, to be served as accompaniments to
such activities as reading, playing chess, or other
passive activity, and provided that the operation:
1. Has no kitchen;
2. Has no food preparation other than
warming on premises;
3. Has no liquor service on the premises."
The operation proposed by Valerie Britt in her
letter of application will have a counter with bar
stools and 3 or 4 small tables. There will be no
major kitchen facilities but there will be a microwave
or steamer, some crock pots and a coffee machine.
The items to be offered include frozen yogurt and
assorted toppings. Juices and non - alcoholic drinks
including yogurt drinks, will be served. The main
emphasis will be on yogurt with a limited fare of
other food items such as soups and sandwiches. The
shop will be open year round and is intended to
serve the local residents as well as tourists. The
patrons are expected to be pedestrian and no parking
is required. The arrangement proposed closely
resembles that of Fry by Night Donuts, which received
earlier conditional use approval to locate in this
building.

Recommendation:
The Planning Office feels that the proposed yogurt
business fits the description of an acceptable food
service operation in the C -1 zone and recommends
conditional use approval and the granting of a
conditional use permit for the frozen yogurt shop
to locate in the Centennial Building at 308 South
Hunter, with the following condition:
1. Compliance with all applicable state food
service rules and regulations and all
local building code requirements prior
to the issuance of a Colorado Food Service
License.

The above - mentioned project has been reviewed by this office
for the following concerns:
1. Air Pollution
Based on the proposed menu verbally presented to this
office by the applicant there will be no need to install a
ventilation system in this business. If, in the future, a
charbroiler or similar type of cooking device is installed
compliance with the City of Aspen Restaurant Grill Ordinance
will be required.
2. Drinking Water
Service of this project by the City of Aspen public water
system is in conformance with policies of this department.
3. Sewage Disposal
Service of this project by the Aspen Metro Sanitation District
is in conformance with policies of this department.
4. Noise Abatement
No adverse impacts are anticipated from approval of this
project.
5. Site Drainage
No adverse impacts are anticipated from approval of this
project.
In conclusion, this conditional use will be required to comply
with all applicable State food service rules and regulations and
all local building code requirements. This must be accomplished
prior to issuance of a Colorado Food Service License.

To Whom It May Concern:
It is my intention to open a frozen yogurt shop in Aspen. I am applying
under Section 24 -3.3 of the Land Use Code, which is entitled Grant of
Conditional Use. This complies with the requirements of the zoning code,
and is consistant with the objectives of this code.
It is my intention to generate most of my business from the neighborhood
offices and shops. My emphasis on pedestrian traffic will therefore
preclude any additional parking facilities.
A description of my operation is as follows: I will serve four or five
flavors of yogurt daily as well as an assortment
of fresh fruit toppings, and other healthy toppings such as carob chips,
trailmix, nuts, etc. I will also serve various juices and other non+ -i
alcoholic drinks including yogurt drinks. It is also my intention to serve
a limited fare of food items such as soups, chili, and possibly sandwiches.
However, these will all be secondary to the main emphasis of yogurt.
I am of the opinion that local residents of Aspen will frequent this shop,
as frozen yogurt offers a healthy alternative for the light lunch, or light
dessert that people so desire in this "fitness" oriented community. It
is my intention to offer people a quiet and clean place to enjoy a delicious
substitute for ice cream desserts all year long as this is not a seasonal
endeavor.
It is my desire to attract the tourist trade but I feel that the local
residents of Aspen will find my shop a welcome addition to the food - service
businesses in town. Your expeditious attention and consideration in this
matter is greatly appreciated.
