RE: Conditional Use Application for Ticket Sales Facility - Aspen
Skiing Corporation
DATE: April 17, 1980
This is a public hearing to consider an application for conditional use
submitted by the Aspen Skiing Corporation for the construction of a
ticket sales facility at the base of Little Nell. The applicant proposes
to build an approximately 10' x 22' structure on a parcel of property
zone C - Conservation and owned by the Aspen Skiing Corporation. Ski
lifts and associated ski facilities are conditional uses within the
Conservation zone.
The Engineering Department has reviewed the Ski Corp's application and
recommends approval subject to the following conditions:
1. The ticket saIes facility should be constructed in such a man-
ner as to be readily moveable in order to permit access to a
City water line located beneath the proposed structure.
2. That the only utility connections permitted be an easily dis-
connected electrical hook -up.
3. That the Department be allowed to review the construction plans
and the electrical disconnect prior to the issuance of a
building permit for the sales facility.
The Planning Office has also reviewed the application and has determined
the following:
1. The proposed use complies with all the requirements imposed by
the Zoning Code.
2. The proposed use is consistent with the objectives and purposes
of the Zoning Code and the Conservation zone district.
3. The proposed use is designed to be compatible with the surrounding
land uses and uses in the area.
The Planning Office therefore recommends approval subject to the conditions
outlined in the Engineering Department's attached memorandum. The City
Attorney concurs with the Planning Office recommendation.

Having reviewed the survey plat for the above conditional use application
and having made a site inspection, the Engineering Department recommends
approval for the above conditional use application with the only restric-
tion being placed on the type of construction used for the ticket sales
facility. The structure should be constructed so as to be readily move-
able in order to gain access to the buried waterline for the purpose of
maintenance.. We would also require that the only utility connection be
an easily disconnected electrical hook -up, giving the structure a readily
moveable status.
Also, the Engineering Department would like to review the construction plans
and the electrical disconnect prior to the issuance of a building permit.

The Aspen Ski Corp. has patiently worked with the staff of the
City Engineer's office and myself to prepare this application for
conditional use approval.
First, the property is properly zoned.
Second, now that the City Council has granted a lease to the Ski
Corp. for a portion of vacated South Hunter Street, the applicant
has the necessary front and side yard setbacks.
Third, although construction is planned such that the structure
will be placed on top of a vital water easement, the applicant has
agreed to construct the structure on studs and to meet all other
requirements imposed by Engineering necessary to make the
structure readily moveable. Therefore, I recommend unconditional
approval.

NOTICE IS HEREBY GIVEN that there will be a public hearing before the
Aspen Planning and Zoning Commission on Tuesday, April 22, 1980, at a meeting
to begin at 5:00 P.M. in City Council Chambers, 2nd Floor, City Hall, 130
South Galena, Aspen, to consider an application for conditional use submitted
by the Aspen Skiing Corporation for the construction of a ticket sales facility
at the base of Little Nell. Further information may be obtained at the Planning

Dear Karen:
Application is herewith made under the provisions of Section
24 -3.3 of the Municipal Code of the City of Aspen, Colorado,
utilizing the procedures as required in Section 2 -22 of that Code.
The approval sought is for a ticket sales and administration facility
to be situated in the proposed building to be constructed by the
applicant, The Aspen Skiing Corporation, on certain property owned
by it, zoned conservation (C) and, as shown on the enclosed map,
five (5) copies of which are enclosed herewith. The building has
been scaled at 10 feet by 22 feet and will be one story. Final
building plans have not been proposed. The application for conditional
use approval is submitted after conference between the applicant,
city attorney and city engineer as to the compliance of the proposed
location of the structure with the setback provisions of the
conversation (C) zone.
Additionally, I am enclosing the requisite mailing list of all
property owners within 300 feet of the property in question which
includes the listing of the number of units in each condominium
project which requires notice through the Condominium Association
pursuant to the Code and a legal description of the applicant's
property. Please advise me as to the preparation of the necessary
sign for posting. I am unaware as to whether this is the responsibility
of the applicant or whether it will be prepared by the city.
The final item of enclosure is our check in the amount of
$20.00 which is submitted pursuant to Section 2- 22(4). My inter-
pretation of the application is that it is a use request, thereby
necessitating this fee.

In making the application, the applicant believes the
proposed use other than requiring a conditional use permit complies
with all requirements imposed by the Code in terms of location of
the property and in terms of being an accessory use permitted in
the conversation (C) zone, that the proposed use is consistent with
the objectives and purposes of the city's zoning code and applicable
zoning district, and that the proposed use is designed to be, will
in fact be, compatible with surrounding land uses and uses in the
area.
I would appreciate commencement of the processing of this
application. If we may be of any assistance in analyzing the
application, both myself, Chuck Maddalone, Aspen Mountain Manager,
and Jerry Blann, General Manager for The Aspen Skiing Corporation
are available. I would ask that I be advised well in advance of
any hearing dates established.
