There is a second element of this application which requests approval for a variance from the Board of Adjustment for the expansion of the ticket booth in the same building. That variance request is not within the jurisdication of this Commission. This application was referred to the City Engineering Department as well as to the City Attorney. The City Engineering Department has commented that there do not seem to be any engineering concerns associated with the application. Ron Stock has recommended denial of the conditional use request. "Section 24 -3.3 of the Code requires that no conditional use may be modified or structurally enlarged unless such modification or enlargement receives the prior approval of the Aspen Planning and Zoning Commission. In considering the request for conditional use the Commission is required to determine 'whether the proposed use otherwise complies with all requirements imposed by the zoning code'. The minimum side yard of the Conservation zone is 30 feet. According to the applicant's survey, his construction will be 22 -23 feet from the east property line. As such this proposed use does not comply with the setback requirements of the zone." (Ron also plans to appear before the Board of Adjustment to recommend denial of the variance as he does not feel that the variance is essential to the enjoyment of a substantial property right of the applicant.) Based on the recommendation of the City Attorney, the Planning Office recommends denial of the conditional use request. Galena Aspen, Colorado 81611 RE: Proposed Additions to Aspen Ski School Building at Base of Little Nell Dear Richard: You will please find enclosed herewith an original letter also addressed to you and the Planning and Zoning Commission relating to the portion of the proposed addition to the Aspen Ski School Building at the base of Little Nell, which is situate within the C (Conservation) Zone, together with an Application for Variance for the portion of the subject property situate within the SPA Zone classification. This letter is intended to serve as an application pursuant to X24 -3.3 of the Official Code of the City of Aspen to the Planning and Zoning Commission, and processed pursuant to the procedures of 52 -22 of the Municipal Code of the City of Aspen. I have enclosed herewith a list of the adjacent ownerships within 300 feet of the subject property for purposes of notices given and, additionally, a check in the amount of $40, $20 for each of the Variance Application and the Conditional Use Application. That the proposed use otherwise complies with all of the requirements imposed by the Zoning Code; 2. That the proposed use is consistent with the objectives and purposes of the Zoning Code and the applicable C (Conservation) Zone; and, 3. The proposed use is designed to be compatible with the surrounding land uses and uses in the area. The final item of enclosure is a site plan and plans and specifica- tions for the proposed improvement, showing both that sought to be approved by virtue of the Variance Application and that sought to be approved by virtue of the Conditional Use Application. Hopefully, this plat and plans and specifications can be used for both applica- tions. Please feel free to contact me with any additional information or submission materials which you feel are necessary to process this application.
