Re: Detailed description of the proposed antique shop
for Lots K & L, Block 18, City and Townsite of Aspen
Dear Mr. Grice, Ms. Smith and Members of
the Planning & Zoning Commission:
The following letter is intended to be a detailed descrip-
tion of the proposed operation of an antique shop presently
under consideration as a conditional use on the above - described
property. The proposed shop is to be exclusively an antique
shop dealing in high quality Scandinavian antiques occassionaly
supplemented with geniune authenticated antique articles from
other areas. All of the antiques will be of high quality in
the form of large and small furniture and small antique articles
such as candle holders, mugs, glass pieces and similar items.
Lis G. Sorensen will be a co- owner. She is a Danish citizen
residing in the United States, and both she and Mary Webster,
the other co- owner, will travel to the Scandinavian countries
every year to locate, buy and import antiques, whereby replenish-
ing the stock of the shop whenever necessary from available
sources. Both of the applicants will actively be involved in
the operation of the facility. The shop will offer no nonantiques,
gifty type items, junk (junque) or other types of items some-
times offered along with genuine antiques in quasi- antique shops.
Simulated or artificial antique items will not be available at
the shop. The applicants wish to inform the Planning & Zoning
Commission that a shipment of Scandinavian antiques has arrived
in Texas belonging to them and will be freighted to Aspen
shortly for removal later this month (September). The shop
will be open seasonally, and may be closed during some off -
seasons allowing the owners needed time to travel abroad in search
of stock. It is proposed the entire main the building will

NOTICE IS HEREBY GIVEN that the Public Hearing scheduled for October
3, 1978, before the City Planning and Zoning Commission to consider a
request for conditional use of Mr. Temple Allen's Victorian building located
on the corner of Seventh and Main Street as an Antique Shop has been post-
poned until October 10, 1978. The meeting will be held in City Council
Chambers, Aspen City Hall beginning at 5:00 p.m. For further information
contact the Planning Office, 3rd floor of the Aspen City Hall or call
925 -2020 ext. 223.

be used as the antique shop. The first floor area is 1,250
square feet in size. The upstairs of the building will be
utilized as a three or four bedroom two bath apartment, use
permitted as matter of right in the O (office) zone. The base-
ment of the structure will be utilized for storage in conjunction
with the antique shop proposed to be operated within the build-
ing. On site parking is provided to the premises with ten (10)
legal parking spaces available and in place. Additional parking
is available along Main Street in the block between 7th and 8th
Street which provides for unrestricted parking under the Municipal
Code.
With respect to improvements proposed to the buildings,
the applicants advise that they may desire to have the building's
exterior painted, but because of its historic designation that
any such painting would be done only after approval of color
schemes and design by the Historic Designation Committee of the
City of Aspen. No other exterior changes are proposed. Any sign
which is utilized in conjunction with the antique shop will be
tastefully done subject to the applicable provisions of the sign
code of the City of Aspen.
The applicants will be in attendance at the consideration
of this matter and will be willing to further elaborate on their
plans and answer questions of the Planning Office Staff and
Planning & Zoning Commission.

Dear Members of the Planning & Zoning Commission and Mr. Grice:
This letter is written by the fee simple owner (and
contract seller) and contract purchasers of the above described
property, who have entered into a purchase and sale contract
wherein Mary M. Webster and Lis G. Sorensen (the contract pur-
chasers) have agreed to purchase the above described property
from Temple W. Allen (the fee simple owner and contract seller)
conditioned upon the issuance of a conditional use approval for
the subject property to operate and maintain an antique store
therein. The applicants propose to operate a high - quality
antique store, offering for sale imported antiques. The contract
purchasers will be available at the hearing set on this matter to
describe in detail their proposed operation. Reference is made
to Section 24 -3.2 of the official Code of the City of Aspen,
which specifically includes within the O- Office district, the
district within which the subject property is situate, antique
stores as a conditional use.
We would appreciate this matter being placed on the
agenda of the Planning & Zoning Commission for consideration at
the earliest possible date in September, inasmuch as a closing
of October 1, 1978, is contemplated. Please confirm the date
of the consideration to us.

in addition to the rental price adopted. For the purpose of this

year following GMP approval on the project or the property taxes
due and payable on the second year following the issuance of

MEMORANDUM

RE: Allen Conditional Use P.H. - Antique Store
DATE: October 5, 1978
Temple Allen is the record owner of the Victorian Office building located on
the corner of Main Street and Seventh. The house dates back to 1889 and has
individual historic designation as well as being located in the Main Street
Historic District. The attached letter of application requests this condi-
tional use hearing and your approval of plans to use the lower floor of the
building for an antigue shop with the upper floor being converted to an
apartment. The letter goes into some detail regarding the antigue shop and
its proposed operational procedures.
The HPC has adopted a map which they recommend as a guide for administration
of the Main Street Historic District. In addition to the goal of maintain-
ing the residential appearance, the map recommends that conditional uses
should become less impactive in a progressive manner from east to west on
Main Street. While this proposal is commercial in nature' the impact is
expected to be minimal - considerably less than the Real Estate Office which
previously occupied the building. The Planning Office feels that the pro-
posed use is clearly within the intent of the zone district and will have
minimum impact upon the residential character of the neighborhood.
We recommend you approve this conditional use with the condition that there
will be allowed no outside advertising with the exception of one sign which
will be subject to the sign code of the City of Aspen.

RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS
OF PITKIN COUNTY, COLORADO, GRANTING SPECIAL REVIEW
APPROVAL FOR SEPARATE DEVELOPMENT OF LOT 14, BLK. 3,
FILING 2 OF THE BRUSH CREEK VILLAGE SUBDIVISION
Resolution No. 78 -
WHEREAS, Hans Lull is the record owner of Lots 14 and 15, Block 3,
Filing 2 of the Brush Creek Village Subdivision, and
WHEREAS, the owner has requested permission to separately develop
Lot 14 of the Brush Creek Village Subdivision pursuant to the provisions of
Section 7.22 of the Pitkin County Land Use Code permitting the separate
development of substandard contiguous lots under single ownership upon
special review approval of the Board of County Commissioners, and
WHEREAS, The Planning and Zoning Commission considered the request at
their regular meeting on August 23, 1978, at which time they recommended
approval of the lot separation subject to a bacteriological and chemical
quality report being provided to the satisfaction of the County Engineer
and provided an engineeredfoundation is designed to mitigate the geologic
hazard, and
WHEREAS, the Board of County Commissioners has reviewed the recommen-
dation of the Commission and the evidence and testimony presented with re-
spect to the application,
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Pitkin County, Colorado, that it does hereby grant special review approval
for the development of Lot 14, Block 3, Filing 2 of the Brush Creek Subdivi-
sion with the cutbank on property to be reshaped and reduced in steepness
to a 1 to 1 slope and with revegetation and terresing required prior to
further construction or improvements.
Approved by the Board of County Commissioners of Pitkin County, Colorado at
its regular meeting held October 2, 1978.
