RE: Use Determination - Chocolate Soldier
DATE: January 14, 1977
This is a public hearing to consider the request for conditional use
approval of the Chocolate Soldier to be located in a new building
presently under construction at 308 South Hunter Street. The use will
consist of retail sales of candy items. No manufacturing or sit -down
restaurant service will exist on the premises. The store will occupy
600 square feet of gross space with approximately 450 square feet to
be used for sales.
The Planning and Zoning Commission has approved two food type uses in
the C -1 district as conditional uses, ie.e, cheese shop and bakery.
Our general concern with food service uses is that sit -down restaurant
service not be allowed.
The Planning Office recommends approval of the candy store as a
conditional use in the C -1 zone.

Notice is hereby given that a public hearing will be held January
1977 at 5:00 P.M. in the City Council Chambers before the Aspen
Planning and Zoning Commission to consider the conditional use of
candy store (Chocolate Soldier) to be located at 308 South Hunter
Street. The property is zoned C -1. The store will consist of 600
square feet with approximately 450 square feet used for sales. A
copy of the application may be examined in the office of the City/
County Planner during normal working hours.

SUBJ: USE DETERMINATION permitting the operation of a retail candy
store to be called THE CHOCOLATE SOLDIER at 308 South Hunter.
Zoning is C -1
It is requested that a determination be made that the subject
retail sales business be a suitable use in the established zone for
the following reasons:
1. It is located on the east side of Hunter Street in a
traffic area used 'Vy both locals and tourists.
2. It is across the street from C -C zoning.
3. It is consistent with the determinations given other
carry out food type stores such as Say Fromage, Gerards Bakery,
and Nature's Store House, all within the C -1 zone.
4. The proposed mall extension will be within i block of the
store, both north and south.
5- Other uses in the same building are to be a jewelry store,
a lingerie store, a °urniture store and a clothing store; all
mutually complementary to a candy store,
It is our intent to feature boxed and bulk chocolates, hand
candies, and candies appropriate to the seasons and holidays throughout
the year, We hope to offer to Aspenites a product not presently
available in m mpeting stores,

T_t is my desire to open a retail candy store to be called THE
CHOCOLATE SOLDIER in a new building presently under construction at
1 09 South Hunter Street. This will be strictly a retail. store and
there will be no manufacturing of any goods. We will occupy 600
square feet, with approximately 450 square feet being used for sales.
The balance will be used for storage, a small office and contain a
lavatory.
Our store will be a year around operation, selling boxed and
bulk chocolates, hard candies and candies appropriate to tt:e seasons
a holidays. There 9s no intent or desire to ever expar3 into selling
ice cream. We are hoping to open for business as soon. as the building
is completed, which is the first :reek In December.

Dear Hal:
I apologize for the urgency of the accompanying request. I have
been procdeding toward opening our candy store, assuming we would meet
with no difficulties, inasmuch as wd would be within what I understand
to be the spirit of +he C -1 zone, Scott Reindl mailed me notice df the
turndown on "'ovember 5th and I didn!t receive it until today. Had the
notice not been so delayed by the mail, I wouldn't be asking y u for
such special teeatment.
We are in hopes of opening by early December, anticipating com-
pletion of the building by then. I have verbally cleared our operati.or
with Tom Dunlop, city sanitarian, and am giving to him plans of our
layout today.
Please call me if you need clarification of any of the items
submitted and I can furnish them immediately. I appreciate very much your
help in this matter,
