According to Section 24-3.3 of the Municipal Code, the Planning Director may determine that minor modifications to a conditional use are acceptable without necessitating P&Z review and approval. As such, I approve of the following changes: 1. Installation of one coin -operated ticket dispenser. 2. Installation of nine (9) concrete and pipe posts which would serve to demark your property, demark parking rows and spaces, support cable, and support lights. 3. Placement of railroad ties or railroad tie planters protruding no more than three feet onto City right-of-way of Original and Hyman Streets to define borders of the parking lot. Subject to the conditions that: 1. The property boundaries be identified by a surveyor and corners established with rebar corner monuments for the property prior to construction. 2. Any proposal for light poles shall be submitted through the Planning Office for review by the Planning and Zoning Commission of an amendment to the conditional use. Any railroad tie placement should be of a temporary nature and, in the event planters are constructed, should protrude minimally into the right-of-way (i.e. no more than 3 feet). The curb -to -curb width of the street in the block that you are talking about is 50 feet, as opposed to 53 feet in the next block. However there are other downtown blocks with 50 foot curb -to -curb widths which have the parking configuration that you request. I checked with the street superintendent for his comments. He said that angle parking would not work on your block because of the snow that piles up there during the winter which forces cars back further out into the street. So we would have to extend the city time parking onto that block and provide the "no parking 3 AM to 7 AM" zone in order to permit snow removal so that parked cars do not project out into the travel lanes. We can do the time parking on that block, but that leaves us with one more downtown block requiring more snow removal, and it is questionable if the street department can handle that increase in its work load without additional equipment, personnel and budget. However, we are willing to try it. I would suggest that the city sign the block for a two hour parking limit with no parking 3 AM to 7 AM. I have also checked with the Police Department since this would increase the amount of time parking area in the city which they would have to patrol. They would have a similar increase in personnel for enforcement as the street department, but they too are willing to try the system. Would you please contact me to let me know if this meets with your approval? Regarding your request for loading zone on the street in front of your building, we cannot support that request. Alleys have been provided for the use of delivery vehicles to service adjacent property owners in lieu of using the streets for such purposes. I inspected your alley when I visited the area, and it had a great number of what appeared to be illegally parked cars in it. Please call the police department to enforce alley usage ordi- nances. City of Aspen Account. • • • • MEMORANDUM TO: Aspen Planning and Zoning Commission FROM: Steve Burstein, Planning Office RE: Double K Parking Conditional Use DATE: October 17 1985 LOCATION: Lots E, F, G, H and I, Block 105, original townsite of Aspen, southwest corner of Hyman Avenue and Original Street, opposite the Aspen Athletic Club. ZONING: 0-Off ice. APPLICANT'S REQUEST: The applicants (Kraut and Kelly) request condi- tional use approval to use the subject property as a commercial parking lot. The original sketch showed 62 parking spaces on 15,000 sq. ft. The second sketch plan, which has been dimensioned off, contains 40 spaces. BACKGROUND: This application is being made pursuant to Ordinance 85- 40 adopted by City Council on August 12, 1985. The ordinance amended the list of conditional uses in the 0-Office zone district to include: "Commercial parking lot or parking structure that is independent of required off-street parking, provided that it not be abutting Main Street." The property had been used as a parking lot for several years. Complaints were received about the dust and unsightly collection of j un ker s on the lot. Consequently, the owner agreed to clean up the lot and put gravel down. Both have been accomplished at this time. The Code amendment mentioned above was initiated with specific consider- ation of the Kraut property and the knowledge that the owner desired to use this site for a commercial parking lot or structure. APPLICABLE SECTION OF ZONING CODE: Section 24-3.3 (b) of the Municipal Code states the criteria by which the Planning and Zoning Commission shall consider the suitability of a conditional use, as follows: "(1) Whether the proposed use otherwise complies with all require- ments imposed by the zoning code, (2) Whether the proposed use is consistent with the objectives and purposes of this zoning code and the applicable zoning district and, (3) If the proposed use is designed to be compatible with surround- 00 • • ing land uses and uses in the area." PROBLEM DISCUSSION: A. Referral Comments 1. Engineering Department: City Engineer Jay Hammond in a September 19, 1985 memorandum gave the following comments: a. Ingress and egress should occur only from the alley. b. Parking should not extend into any of the street's right-of- way. C. Circulation lanes shown on the original sketch appear in- adequate. d. Dimension of spaces, how the spaces and rows are to be deline- ated, and any landscaping scheme should be shown on a more detailed sketch plan. e. If the parking lot is intended to be a permanent, income - producing use, it may be appropriate to obtain sidewalks at this time. 2. Environmental Health - In a memorandum dated October 1, 1985 from Lee Cassin of Environmental Health the following comments were made: a. The main environmental concern is that the parking lot be maintained with an adequate amount of gravel on it at all times. This will require regrading the lot periodically, as well as occasional addition of gravel. Regrading should occur every spring at a minimum. b. Use of chip and seal instead of gravel would be an improvement, and encouraged. C. Depending on the final lay out, a posted limit of 5 m.p.h. should be required. d. A fugative dust control plan under Air Pollution Control Commission Regulation No. 1 will be required by the Environ- mental Health Department. STAFF COMMENTS: The Planning Office offers the following comments with regard to the Double K Parking application: 1. The proposed commercial parking lot use appears to comply with the requirements of the zoning code, specifically regarding the amended Section 24-3.2 (conditional uses in the Office zone - 2 - • • 016 district). 2. A parking lot in this location should serve commercial and business areas with needed parking. It can be viewed as an appropriate use in this location in the Office zone district, thereby meeting the criterion of Section 24-3.2(b) (2) . 3. There may be problems with noise and fumes caused by excessive idling of cars and buses parked in the Double K Parking Lot. Restricting the idling time to 5 minutes, as applies to RFTA buses, should be sufficient for bus engine warm-up, and would minimize the nuisance. In particular, guests of the Buckhorn Lodge adjacent to the property could be adversely effected by vehicle noise and exhaust. 4. To the west of the subject property is an A -frame residence. A landscaping barrier such as a berm or hedge should be placed along the western edge of the parking lot in order to give some privacy to the residence and reduce visual, noise and fume impacts of the proposal. 5. The Planning Office feels that landscaping along Hyman and Original Streets would make the parking lot more attractive and compatible within the neighborhood. It was suggested by one of the applicants that the parking lot may be a temporary use and that the possibility of a parking structure is being investigated. Therefore, the applicant does not want to spend a lot of money on landscaping that may be soon moved or uprooted. However, there is no assurance that this property will not remain a parking lot for a long time, nor that a parking structure would necessarily cause a landscaping scheme to be destroyed. We suggest that a minimal landscaping arrangement of rocks or shrubs located along the northern and eastern edges of the property be described in a detail sketch submittal for Planning Office and Engineering Department review and approval. 6. At the present time there are pedestrian problems along both Original and Hyman Streets beca,sbe of the lack of sidewalks adjacent to this property. This peripheral area to the commercial core is heavily used by pedestrians. Hanna Dustin has committed to laying down a sidewalk on Hyman Street. If a sidewalk were placed along the edge of the Double K property, the whole block would be paved. 7. The parking lot configuration shows two ingress/egress passages from the alley and forty spaces of widths in excess of the 8 1/2 foot measurement stated in Section 24-4.2 of the Municipal Code (off-street parking, requirements) . The arrangement meets City of Aspen parking standards and provide for adequate circulation. It would be acceptable to the Planning Office if the applicant reduced the widths of parking spaces, including some spaces less than 8 1/2 feet in width for compact cars. Signs should be - 3 - posted specifying spaces for compact cars. 8. The method and materials for delineating rows and spaces should be described in a detailed sketch plan submittal. 9. It would be acceptable to the Planning Office if short-term rental of parking spaces as well as long-term were allowed. RECOMMENDATION: The Planning Office recommends approval of the Double K Parking Conditional Use permit, subject to the following conditions: 1. The parking lot shall be maintained with an adequate amount of gravel at all times in order to reduce dust generation. 2. A fugitive dust control plan, pursuant to Air Pollution Control Commission Regulation No. 1, shall be submitted to the City/County Environmental Health Department. 3. We represent Elaine Kraut, the owner of the above -described property, and Simon. P. Kelly; who will be operating the parking lot on that property pursuant to agreement with Ms. Kraut. We request approval from the Planning and Zoning Commission for use of the property as a parking lot pursuant to the recently enacted Ordinance 85-40, Series of 1985, which amended Section 24-3.2 of the Code to identify parking lots and structures in the office zones as a conditional use, provided they are not located along Main Street. The above -described property is located on the southwest corner of Hyman Avenue and Original Street, opposite the Aspen Athletic Club. The property has been historically used as a parking lot. The owner of the property has recently cleared the lot, graded it, and put gravel down to improve its appearance and control dust. This parking lot is to be managed by Simon P. Kelly, who owns and operates the Buckhorn Lodge which is directly adjacent to the south of the parking lot property. The parking lot will be rented on a weekly r monthly basis for parking. Because of the crowdedpar ing situation on the streets in Aspen, a parking lot such as this is a necessary and valuable use in the downtown Aspen area. This application complies with the requirements set forth in Section 24-3.3(b) of the Code in that: 1. the proposed use otherwise complies with all requirements imposed by the zoning Code; 2. the proposed use is consistent with the objectives i Mr. Alan Richman August 29, 1985 Page 2 and purposes of the zoning Code and the applicable zoning district; and, 3. the proposed use is compatible with surrounding land uses and uses in the area. This lot consists of 15,000 sq. ft. or 0.34 acre and is designed to accommodate 62 parking spaces. The main concern of this office is that the parking lot be maintained with an adequate amount of gravel on it at all times. This will require regrading of the lot periodically, as well as occasional addition of gravel, and we would like this to be a condition of approval. It is our belief that regrading will be required every spring as a minimum. This is due to the redistribution of the gravel that will occur during the winter. It is necessary to maintain a sufficient thickness of gravel to prevent reintrainment of the dirt beneath the gravel. Use of chip and seal instead of gravel would be an improvement and will be encouraged, but not required, unless future complaints warrant such a change. Depending on the final layout of the lot, a posted speed limit of 5 mph will be required if greater speeds would be likely. Using equations provided by the Environmental Protection Agency (EPA) and Colorado Health Department, emissions from this lot will be between 100 and 200 kg/yr of particulates. The emissions of particulates less than 10 microns in diameter, for which Aspen may be required by the EPA to implement control measures in the future, is from 60 to 110 kg/yr. This assumes that the parking lot is always completely covered with gravel. Emissions would be much greater if the gravel were worn down and auto traffic over dirt areas occurred. This represents a small fraction of the emissions in the Aspen area and the situation has been improved greatly by the owner's recent application of gravel and grading of the lot. We would stress that, as shown in the sketch, ingress and egress occur from the alley. 2. Since the sketch has no apparent scale, the area designated for parking is difficult to evaluate. The parking should not extend into any of the street rights of way. 3. Circulation lanes between the parking rows would appear to be inadequate. It may be necessary to eliminate one row to provide adequate circulation (see attached standard). 4. It would be appropriate to get a more detailed sketch plan to better address dimensions, how the spaces and rows are to be delineated, and whether some landscaping to screen the lot is possible. 5. If the parking lot is intended to be a permanent, income -pro- ducing use, it may be appropriate to obtain sidewalks at this time since the lot is now "developed."
