The proposal would eliminate some of the storage area and convert it to an office. The changes are shown in Exhibit A. The reconfiguration of space requires an insubstantial PD Amendment to the original approval, Ordinance 1, Series of 2006. BACKGROUND: The Limelight Lodge Subdivision/PD was originally approved via Ordinance 1, Series of2006. The original approval consisted of 125 Lodge units and 15 free market residential units located on two parcels. The subject properties are zoned Lodge with a PD overlay. The Limelight Lodge is located on the South Parcel and the Monarch on the Park Residences are located on the North Parcel. The Limelight Lodge, on the south parcel, was approved as a four-story lodge with a subgrade parking structure that included storage, housekeeping and mechanical rooms. Ordinance 1, Series of 2006 required a Final PD Plat and Agreement be recorded showing easements, encroachment agreements, physical improvements, and an illustrative plan showing dimensional requirements and architectural character. Included in the recorded plat are floor plans for alllevels. The recorded plat is shown in Exhibit D. REQUESTED REVIEW: • Insubstantial PD Amendment per Section 26.445.110(A) related to a request for a change to the parking level storage area. The Community Development Director may approve, approve with conditions, or deny this request based on the criteria found in Exhibit B to this memo. 1 PROPOSED CHANGES: The applicant is proposing to revise the layout ofthe subgrade parking level by reducing the size of the bike and ski storage area and creating an office to be used by the Limelight Lodge. The current storage area spans most of the subgrade parking area's south wall, measuring approximately 47'10" in width and approximately 724 square feet. The proposal would reduce the bike storage area to approximately 409 square feet and would measure 29'9" in length along the south wall. The office would measure approximately 310.5 square feet and 19'7" in length as measured along the south wall. STAFF EVALUATION: The documents on file at the building department contained an area tabulation sheet showing the entire subgrade parking area as "non-room area." Current area calculations would refer to that type of space as non-unit space. Both the storage and office areas would count as non-unit space allocated toward the Lodge use. Since the office would continue to be non-unit space used as an accessory use to the primary lodge use of the structure, the proposed alteration is allowed. The space will continue to be non-unit space accessory to the primary use, so the alteration does not result in any change in the floor area allocation for the property. There is no requirement in the original approval for the size of the ski and bike storage area and the reduction in size does not create a conflict with the original approval. It was also noted during review that a storage area adjacent to the ski and bike storage area was shown and was not included in the recorded plat or original approval. A previous building permit application was approved showing the storage area in question and the two parking spaces moved to accommodate the storage area but did not eliminate any parking spaces. All alterations are consistent with the original approvals for the site. This Order allows an Insubstantial Planned Development Amendment to add a window and door, expand the size of a second window, eliminate the roof deck and access stairs, and expand the size of the useable area of the second-level deck but does not increase the overall dimensions of the deck pursuant to the provisions of the land use approvals, described herein. The effective date of this Order shall also be the initiation date of a three-year vested property right that is specific to this Insubstantial Amendment. The vested property right shall expire on the day after the third anniversary of the effective date of this Order, unless a building permit application submittal is accepted and deemed complete by the Chief Building Official, pursuant to Section 26.304.090, or unless an exemption, extension, reinstatement, or a revocation is issued by City Council pursuant to Section 26.308.010. After Expiration of vested property rights, this Order shall remain in full force and effect, excluding any growth management allotments granted pursuant to Section 26.470, but shall be subject to any amendments to the Land Use Code adopted since the effective date of this Order.
