RESOLUTION OF THE ASPEN PLANNING AND ZONING COMMISSION
FOR THE APPROVAL OF A CONDITIONAL USE FOR AN ACCESSORY DWELLING
UNIT AT THE KREBS RESIDENCE, 916 W. SMUGGLER (LOT 2, VANDEMOER LOT
SPLIT) �/
Resolution No. 90-3e2
WHEREAS, George and Alice Krebs submitted to the Aspen
Planning Office an application for a Conditional Use for a 303
square foot Accessory Dwelling Unit in their residence to be built
at 916 W. Smuggler St.; and
WHEREAS, an Accessory Dwelling Unit is required for any
development resulting from a Lot Split action; and
WHEREAS, the subject parcel was created by the Vandemoer Lot
Split approval in 1986; and
WHEREAS, the Planning Office reviewed the application in
consideration of Housing Authority standards and review criteria
for Conditional Uses contained in Section 7 -304 of the Aspen Land
use Code; and
WHEREAS, the Planning Office recommended approval of the
Conditional Use with conditions to the Planning and Zoning
Commission; and
WHEREAS, during a public hear at their regular meeting on
September 3, 1991 the Planning and Zoning Commission approved by
a 4 -0 vote the Krebs Conditional Use with conditions.
NOW, THEREFORE BE IT RESOLVED by the Commission that a
Conditional Use is approved for a 303 square foot accessory
dwelling unit to be included within the basement of the residence
at 916 W. Smuggler with the following conditions:
1. The owner shall submit an appropriate deed restriction with the
Aspen /Pitkin County Housing Authority for approval. The unit shall
be deed restricted to resident occupancy with minimum 6 month
leases. Upon approval by the Housing Authority the Owner shall
record the deed restriction with the Pitkin County Clerk and
Recorder's Office.
2. Prior to issuance of any building permits for the accessory
dwelling unit, a copy of the recorded deed restriction must be
forwarded to the Planning Office.
APPROVED by the Commission at its regular meeting on September
3, 1991.

We agreed to issue the permit for this residence as the employee unit
has been omitted from this permit and construction set. Following
the Planning Commission hearing on September 3, Fred Alderfer will
apply for a change order to allow the plumbing and fixtures which
will create the employee unit. He must also file the appropriate
deed restriction with the County Clerk prior to the change order
issuance. Please keep this info. attached to the building permit

The Planning Office has completed its preliminary review of the
captioned application. We have determined that this application
is complete.
We have scheduled this application for review at a public hearing
by the Aspen Planning and Zoning Commission on Tuesday, August 6,
1991 at a meeting to begin at 4:30 PM. Should this date be
inconvenient for you please contact me within 3 working days of the
date of this letter. After that the agenda date will be considered
final and changes to the schedule or tabling of the application
will only be allowed for unavoidable technical problems.
The Friday before the meeting date, we will call to inform you that
a copy of the memo pertaining to the application is available at

Ladies and Gentlemen:
The applicant, Aspen Construction Company proposes
an Accessory Dwelling Unit of approximately 400 SF net area
within the single - family detached residence the applicant is
currently constructing at 916 W. Smuggler, a parcel
described by meets and bounds within the City of Aspen,
County of Pitkin, State of Colorado.
The Standards for Review of Conditional Use have
been met in the following manner:
REVIEW STANDARD A: The application for conditional
use is consistent with the purposes, goals, objectives and
standards of the Aspen Area Comprehensive Plan and R -6 Zone
District, as evidenced by the enactment of Ordinance No. 1,
Series of 1990, which encourages the production of Accessory
Dwelling Units as a conditional use in this and other
residential Zone Districts.
REVIEW STANDARD B: The conditional use is
consistent and compatible with the character of the
immediate vicinity of the parcel proposed for development.
An Accessory Dwelling Unit on this site will not create any
significant impact of any sort within the immediate
vicinity.
REVIEW STANDARD C AND D: The conditional use, as
proposed, provides housing for no more than two persons, and
will have no adverse effects or impacts on the visual
character of the neighborhood, pedestrian or vehicular
circulation, parking, trash service, water supplies, sewer,
etc.
REVIEW STANDARDS E AND F: The applicant has
voluntarily elected to provide affordable resident housing
in compliance with Ordinance No. 1, Series of 1990.
