FOR THE APPROVAL OF MAU ACCESSORY DWELLING UNIT
Resolution No. 90--'�
WHEREAS, P. Kalei Mau submitted an application for a
Conditional Use to allow an Accessory Dwelling Unit to be
voluntarily developed within his residence at 1105 Waters Ave;
and
WHEREAS, the Planning and Engineering Departments had
reviewed the application and recommended approval with
conditions; and
WHEREAS, The Planning and Zoning Commission met on March
20, 1990 and having considered the Planning Office's
recommendation, approved the application pursuant to Section
5-508 of the Aspen Land Use Code with conditions.
NOW, THEREFORE BE IT RESOLVED by the Commission: That the
Conditional Use for an Accessory Dwelling Unit is approved with
the following conditions:
1. Inclusion on the site plan of any additional utilities or
trash access if the applicant intends to add them.
2. The owner is allowed to remove the Accessory Dwelling
Unit in the future.
3. The Accessory Dwelling Unit must be deed restricted with
the Housing Authority as a resident occupied unit with a six
month minimum lease.
APPROVED by the Commission at its regular meeting on March
20, 1990.

SUMMARY: The applicant seeks a Conditional Use approval in order
to remodel an existing bedroom, exercise room, and bathroom into
an employee housing unit of 313 square feet.
APPLICANT: P. Kalei Mau, represented by Stan Mathis
LOCATION: 1105 Waters Ave. Lot 5 Calderwood Subdivision
ZONING: R-15
APPLICANT'S REQUEST: Conditional Use approval for an accessory
dwelling unit.
REFERRAL COMMENTS:
Engineering: Having reviewed the above application and made a
site visit, the Engineering Department has the following
comments:
1. If the applicant intends to place additional utilities and
another trash access, these need to be shown on the submitted
sketch plan of the site.
2. This application meets all of the other requirements in this

PROPOSAL: The existing residence is a 4 bedroom 3,286 sq.ft.
home. The applicant wishes to remodel approximately 313 sq. ft.
into an employee housing unit. No exterior changes will be made
to the structure.
STAFF COMMENTS: An accessory dwelling unit is a conditional use
in the R-15 zoning district. The Commission has the authority to
review and approve development applications for conditional uses
pursuant to the standards of Section 7-304:

RESPONSE: Increasing the numbers of accessory dwelling units for
resident employees of the county is a major goal of the
community. This proposed unit will allow the property owner an
on -site resident during his absences and provide housing for a
local employee.

RESPONSE: This use is compatible with the other residential uses
in the surrounding neighborhood, and compliments the use on this
specific site.

RESPONSE: The proposed accessory unit is completely contained
within the existing structure. Additional parking spaces will
not be needed because one bedroom or studio accessory units carry
no parking requirement.

RESPONSE: All public facilities are all ready in place for the
existing neighborhoods.

Review Standards.: Development of Conditional Use
This conditional use is consistent with the goals, objectives, �:.
standards of the Aspen Area Comprehensive Plan, and with intent of the
Zone Chstrict in which it is located. It is compatible with the character of
the neighborhood as there are no changes to the exterior of the house. The
location, size, design and operating characteristics of this cond0i oal use
has very minimal effects on visual, pedestrian, and vehicular impacts. The
effects; of parking, trash, service deliveries, noise vibrations and odor to
surrounding properties will also be very minimal compared with the
positive effects of the accessory dwelling unit being created.
There are adequate public facilities to serve this conditional use
including but not limited to roads;, water, sewer, solid waste, parks,
poi i c:e, fire protection, emergency medical services, hospi t of and medical
services., drainage systems and schools.
Obviously, in our objective to include an accessory dwelling unit
with in this structure the are providing employee housing.
