The Housing Office recommends approval for the requested accessory
dwelling unit based on the following conditions:
Accessory dwelling units shall contain not less than three hundred (300) square feet of allowable floor
area and not more than seven hundred (700) square feet of allowable floor area. The unit shall be
deed restricted, meeting the housing authority's guidelines for resident occupied units and shall be
limited to rental periods of not less than six (6) months in duration. Owners of the principal residence
shall have the right to place a qualified employee or employees of his or her choosing in the
accessory dwelling unit.
The applicant states that the unit is to be a studio approximately
385 square feet of net liveable area, and to be incorporated in the
lower level of a new 4,650+ square foot single family residence.
According to the plans, the unit has a separate entrance and is a
completely private unit. The plans also show that the kitchen
meets our definition of same as stated below:
Kitchen - For Accessory Dwelling Units and Caretaker Dwelling units, a minimum of a two- burner
stove with oven, standard sink, and a 6 -cubic foot refrigerator plus freezer.
Before the applicant can receive building permit approval, the
applicant must provide a signed and recorded Deed Restriction,
which can be obtained from the Housing Office. The Housing Office
must have the recorded book and page number prior to building
permit approval.

Statement addressing the review standards for this conditional use.
This conditional use Accessory Dwelling Unit in the R -6 Zone District
complies with the purposes of the Comprehensive Plan and the Zone
District by supplying an affordable Resident Occupied Unit to an
employee working in Pitkin County which is necessary for a balanced
community.
This conditional use Accessory Dwelling Unit will be contained
within a new Single Family Dwelling which is consistent with the
surrounding single family dwellings in the neighborhood. The location
within the lower level of the new single family dwelling and the
size of 3851 sq. ft. with separate rear yard entry minimize any
visual or circulation impacts. The Accessory Dwelling Unit will be
accessed from Lake Avenue by a driveway which is located in proximity
to the existing driveway therefore maintaining existing traffic
flow and access to the site. All necessary utilities are present
in Lake Avenue. Existing taps will be utilized as much as possible
to minimize neighborhood inconvenience during construction. Trash
facilities shall be shared with the single family dwelling on site.
The conditional use Accessory Dwelling Unit is a studio type unit
containing approximately 385 sq. ft. of net liveable space with
full bathroom and compact kitchen unit. The bathroom shall contain
2 lavatories, tub with shower head, water closet and walk -in
clothes closet. The compact Kitchen will contain a minimum two - burner
stove with oven, standard single bowl kitchen sink and a minimum
6 cubic foot refrigerator plus freezer and be in compliance with
the 1994 Affordable Housing Guidelines. Soundproofing insulation
will be provided in all walls and ceilings shared with the principal
residence. The below grade entry patio and exterior stairs shall be
snowmelted.

on the Accessory Dwelling Unit and the overall project.

Dear Kim,
This letter is to describe my understanding), our several recent
conversations regaring the proposed Single Family Residence with
Accessory Dwelling Unit at 315 Lake Ave.
1.) The Accessory Dwelling Unit will require Conditional Use
Review and approval from the Aspen Planning & Zoning Commission.
To initiate this process I will have a preapplication
conference with you on May 13, 1994 @ 2:00.
2.) To establish natural grade on site prior to development, I will
get a Surveyor's estimate of natural grade and have this
document reviewed by Francis Krizmanich of your department.
3.) The proposed setbacks of 10' front yard on the south facing
North St., 10' side yard on the east facing Lake Ave., 20' rear
yard on the north and 8.5' side yard on the west are
acceptable to you.
4.) The 500 Sq. Ft. garage Floor Area exemption per dwelling unit
in the Aspen Zoning Ordinance applies only to the principal
residence and not to the Accessory Dwelling Unit since no parking
is required for a studio or 1 bedroom A.D.U.
5.) No uncovered porches, slabs, patios, walks or steps which are
more than 30" above or below natural grade can be in the
required yards including a pool or spa. The only exception may
be window wells for required egress and these must be the
minimum dimensions allowable.
6.) No GMQS exemption review is required for the A.D.U.
7.) Balconies & roof overhangs more than 3' from the exterior wall
of the building shall be counted in the Floor Area if they
exceed 15% of the allowable Floor Area.
If my understanding of any of these items in not as you intended,
please notify me immediately.

NOTICE IS HEREBY GIVEN that a public hearing will be held on
Tuesday, July 5, 1994 at a meeting to begin at 4:30 pm before the
Aspen Planning & Zoning Commission, 2nd Floor Meeting Room, City
Hall, 130 S. Galena, Aspen to consider an application submitted by
Joseph and Lillian McCoy, 604 N. 3rd St., Aspen, CO, requesting
approval of a Conditional Use Review for an approximately 385 net
liveable square foot accessory dwelling unit in the lower level of
a proposed new single family residence. The property is located
at 315 Lake Avenue; a part of Lots 11 & 12, Block 102, Hallam's
Addition. For further information, contact Kim Johnson at the
