We recommend using 1.5 spaces per 1000 sq, feet which would require a minimum of seven parking spaces. jk M E M O R A N D U M TO: Aspen Planning and Zoning Commission FROM: Richard Grice, Planning Office RE: Mesa Store - Conditional Use DATE: November 30, 1978 This is a public hearing to consider the attached letter of application which requests conditional use approval to use the Mesa Store building for a combination furnitureand art gallery. The ground floor and base- ment will be used for the furniture gallery and the upper floor will be used for the art gallery. The Planning Office and Engineering feel that both of these uses will be low trip generators and appropriate uses for the existing historically designated building. We have received a comment from Steen Gantzel of the Christiana Lodge which indicates his enthustiasm for the conditional use as proposed. We expect Mr.Gantzel's enthustiasm is shared by other residents of the area. Dave Ellis has commented that he has only one problem with the proposal. That is, the Municipal Code requires at least 1.5 parking spaces per 1,000 square feet of building in the 0- Office Zone. The building is 4800 square feet in size including the basement and the two upper floors. The Code requirement is based on the size of the structure rather than upon the amount of space dedicated to a particular use. Therefore there is simply no alternative for the applicant other than to provide 7 parking spaces. Engineering recommends you approve this conditional use with the clear understanding that the minimum parking requirements must be met as a con- dition of this approval. The Bakery building is located at 500 West Main Street. The proposed restaurant consists of approximately 1,875 square feet and will occupy the entire second floor of the Mesa Store Building. The applicant has received approval from the Historic Preservation Committee for historic designation of the building and approval of the stairway addition to the Mesa Store building. The Planning Office recommends conditional use approval of the restaurant provided the following conditions are met: 1. The present bakery is a non - conforming use in the 0 -2 zone, and as such cannot be expanded. The use creates significant traffic congestion problems on Main Street due to its high rate of customer turnover (applicant states volume of 1700 persons per day). It is important that this restaurant expansion be for the purpose of providing full dinner services, and not extending the short order bakery service. 2. We feel the applicant should make an effort to reduce the congestion and general nuisance complaints which have been transmitted to the Planning Office concerning operation of the Bakery. Such efforts could include the following measures: a. The bakery is currently open to the public until 2:30 a.m. This creates substantial disturbance in the area. The hour of closing should be set no later than 12:00 a.m. after the bakery operation. MEMORANDUM Planning Commission Mesa Store Bakery October 30, 1975 Page Two b. No curb cuts should be allowed on 4th Street. c. The area immediately in front of the store where the fire plug exists should be red marked by the City to prohibit parking. d. Food preparation for the bakery occurs all night in the kitchen quarters. Evidently a large fan is operated at all times to properly ventilate the kitchen area. The fan creates a noise problem in the area. Measures should be taken to reduce such noise. 3. Historic designation for the building should be required as a condition of approval. 4. Full compliance with the uniform building code should be required. 5. Adequate parking for the restaurant and bakery should be provided accessed only from the alley. The zoning code requires eight (8) spaces for the upstairs restaurant and only one (1) space for the non - conforming bakery. The parking area should be paved; visually screened from Main Street; and properly landscaped. COLD. 81611 /003) 92S -5104 PROPOSED IMPROVEMENTS FOR THE MESA STORE BAKERY • Outline of the Proposed Improvements The objectives of the proposed improvements are to -- * preserve the "corner bakery" character of the Mesa Store, * provide facilities for new products and enhanced customer service, and * improve the overall appearance of the property The specific building improvements proposed are as follows: 1. remodeling of the upstairs space for additional seating and customer service. 2. replacement of the existing stairway for increased customer safety and convenience. 3. installation of decking, walkways, paving and landscaping. Recent Business Background The Mesa Store Bakery was established about four years ago by R. K. Young. After experiencing almost continous problems and management change, the Bakery was purchased by Jim and Anita Bradley in March of 1974. At that point in time, the Bakery had a very poor image and reputation for -- * a limited variety of products of low overall quality * inexperienced personnel * poor financial standing and credit rating * an alleged hangout for drug users - both customers and employees. Proposed Improvements for the Mesa Store Bakery, page 2 In the past few months, under new ownership and management, steady progress has been made through the following improvement programs: 1. Hard rules prohibiting the use of drugs or alcohol on premises have been established and strictly enforced. 2. A strong financial business base and credit rating has been established. 3. An orderly supervisory and management structure with job descriptions and training programs has been implemented resulting in a complete change in all former personnel. 4. A semi - annual on -site training program utilizing a professional baker was instituted. 5. A new "Home Baked" section was created utilizing premium ingredients (i.e. honey, fresh eggs, creamery butter, etc.) in non - commercial recipes. 6. Participation in the Rocky Mountain Bakers Associa- tion along with studies of prominent Denver bakeries, has led to a complete re- organization and upgrading of back room production equipment and facilities. 7. The small customer service area was re- arranged and proper tables and seating installed. 8. New hot food items were introduced such as Quiche Lorraine and Pizza. We recognize a continuing need for improvement, however at this point in time space is our single most critical problem. Problem Analysis and Requirements Throughout America today the "corner bakery" is rapidly becoming a thing of the past because of powerful economic pressures applied to the small businessman, combined with regulations limiting his ability to cope with rapid changes. This past summer season in Aspen has presented the Mesa Store Bakery with some unique challenges. The unprecendented demand for our products and services completely outstripped our limited customer service facilities. To illustrate the critical nature of our customer service problem we offer a comparison to an identified Aspen problem: City Market Mesa Store Bakery Customers served per day 4,000 (approx.) 1,700 Customer Service Area 10,000 sq.ft.(est.) 375 sq. ft. Space per 100 customers 250 sq.ft. 22 sq. ft. Proposed Improvements for the Mesa. Store Bakery, page 3 Based on the above comparison, the Mesa Store Bakery is experiencing a space problem ten times more critical than City i1arket . Additional customer service space will allow us to continue to change the character of the bakery from a fast food take out facility to a food service establishment more in keeping with the plan for Main Street. Additional space will allow us to implement the following customer service improvements: 1. Table service for a majority of customers in a First Class Family Restaurant Environment. 2. A major reduction in single use paper plates, cups, plastic, etc., (which is ecologically wasteful and generates a solid waste disposal problem) by installa- tion of commercial dishwashing equipment and tableware which is uneconomical and impractical within existing space. 3. Introduction of additional new hot food items to serve the needs of locals and the guests of the numerous lodges in the immediate two block walking area. 4. A desirable separation of functions required to serve the needs of food service customers and "corner bakery" customers in a more natural and orderly flow. Summary We believe that the proposed changes -- * Increased customer service space, * Replacement of the existing stairway, and * Exterior property improvements - - are in the best interest of serving the needs of our customers and the image of Main Street Aspen. Our proposal met all planning office guidelines, provided for the required off - street parking, and was recommended by the planning office for approval. The sole reason for denial was on the basis of antici- pated additional traffic and parking congestion in the immediate area. No factual traffic or parking data was presented, requested, or considered. The close 4 to 3 vote was based on entirely subjective opinions regarding potential traffic and parking concerns. During the two recent high volume weeks of Christmas and New Years, I personally conducted my own survey of parking spaces available in the immediate area along Main Street and Fourth. The observations were made during the anticipated restaurant peak period between 6 P.M. and 10 P.M. (the dinner hours). In over ten random observations, I found considerable available on- street parking spaces, not counting the proposed new off- street spaces or the spaces available on Bleeker Street in residential area. I am respectfully requesting that the Aspen Planning and Zoning Commission conduct a similar survey to gather objective data on available parking pending my request for a review of the November decision. COLO. 81611/(303) 925-5104 November 4, 1975 Aspen Planning and Zoning Commission City of Aspen Gentlemen: As provided under the current Zoning Code, we are requesting your approval of our plans and proposal to create a new restaurant at 500 West Main Street occupying the second floor of the Mesa Store Bakery Building. This is a Historic Structure and official Historic Designation Procedures have been formally initiated. The Historical Preservation Committee conducted a preliminary review October 28, 1975 and approved the proposed exterior changes. We believe the plans and proposal meet the Planning Office restaurant definitions and guidelines. Full meal table service will be provided beginning at 7 :00 a.m. for breakfast, lunch, and dinner, closing at 12:00 midnight. The restaurant will have a separate entrance and its own kitchen facilities. The required off- street parking will be provided from the back alley on the vacant lot just west of the building, but will be screened from Main Street view by a small deck area and privacy fence. As owners of the existing Mesa Store Bakery operation located on the first floor of this building, we believe and plan for this new restaurant to have a significant positive impact on the area by reducing the present take out food business. Further, should this request be approved, the new restaurant would provide the income and economic justifi- cation necessary to encourage this desirable shift in business and we would agree to reduce the downstairs seating from 38 to 28 persons, and change the closing hour for the Bakery from 2:30 a.m. to 12:00 midnight in an effort to control the late night customer noise in the neighborhood. Box V Aspen, Colorado 81611 Dear Members of the Planning & Zoning Commission: it is my understanding that the Mesa Store Bakery, housed in an historic old building on the corner of 4th & Main, has applied to the Commission for added space to be used as an additional eating facility. As a permanent resident and a property owner for the past eight years, I wish to register my strong objection to Mr. and Mrs. Bradley's request for a second story resturant. As it now operates, the Mesa Store Bakery is almost a 24 hour operation. The short order busin- ess which has developed is open from early in the morning until 2:30 a.m., and has resulted in an admitted 1700 customers a day. This operation has caused considerable traffic congestion and parking problems, with some of the traffic parking a block away in front of my house on Sleeker St. Because of inadequate parking for the Bakery, many patrons double park, causing an additional traffic hazard. An inadequate trash facility behind the Bakery is most often filled to capacity and running over, which adds litter to the neighborhood, and also quite a number of hungry dogs. After speaking with Mr. Bradley and looking over his plans for the additional eating facility and a beer and wine license, I cannot see how any of the above problems, plus the additional noise, will be improved upon - -only compounded. I therefore urge the Commission to refuse the conditional use request of the Bakery in order to protect the surrounding residential area from more traffic and parking problems, more trash and more noise. We wish. to go on record as opposing this request for the following reasons: In late August there were complaints from the Sanitarian's Department. They cited litter, junk cars in alley and around property and even shut down the operation for several hours in order that the Bakery be cleaned up. There is a possible fire hazard on second floor of old building. Numerous complaints from adjacent residences regarding excessive parking, noise pollution, disturbing hours for restaurant and bakery operation, negligent trash removal, illegal overnight camper parking. In view of the fact that many of the neighbors are part -time residents, it may be difficult for you to get a realistic reading regarding the present operation, however, West Side Improvement Association has been apprised of the problems which already exist. As Aspen property owners at 504 West Bleeker, we wish to protest granting of this variance. The reason for this protest is based upon the operati:n of this business establishment in the past. We object to: 1. Overly-long business hours: i.e. early morning. until 2:30 A.M. No place else in town is on so late, certainly not one adjacent to a residential area. 2. Short -order nature of the business: it has superseded the bakery business (the quality of which has definitely gone down - hill). Because of these two factors, the place has become a "hang -out" and the traffic and conesti_.n pose a safety threat both on Main Street and on Fourth, since there is no parking. In addition to this, the noise generated (particularly in the late hours) is objectionable to the residents. The mess created by a short -order establishment (i.e. paper cups, plates, nap- kins, plastic tableware, etc.) is also prevalent around the building and the neighborhood. They are permitted in historic structures along Main Street as a special review use in the 0 -2 district pending adequate off - street parking and request for official historic designation. The code does not, however, define the range of food service outlets to be included in the term restaurants, and restaurants along Main Street should be allowed only when they do not conflict with the planning considerations developed for Main Street. The planning considerations for Main Street are as follows: 1. Main Street should be maintained as the primary east- west thoroughfare in Aspen for the present and fore- seeable future. 2. Main Street provides the major vehicular access to the City and as such, establishes the first image or impress- ion that tourists have of the City. Therefore, the appealing qualities of the town and Main Street (Victorian architecture, residential -lodge character, small scale structures, etc.) should be preserved as an important support to the tourist economy. 3. The number of existing lodges without food service along or near Main Street establishes a limited demand for such services. However, these restaurants should operate in such a way that they do not a) create excess- ive traffic congestion or b) detract from the visual image of Main Street. The present code attempts to address these first two planning considerations. Hence, the higher turn -over parking (five to ten minutes) along Main Street creates an obstruction to free flowing traffic and potential traffic hazards. Therefore, the Planning Office recommends an amendment to Chapter 24 -3.1 to include a definition of restaurants that separates short order food services from full dinner services. A copy of the January 15, 1976, letter from Mr. Bradley is enclosed in your packet. The Planning Office feels that such a study would not significantly contribute to addressing the central issue which affected the Planning and Zoning Commission's decision to deny the conditional use request for a restaurant at the Mesa Store. Our understanding is that the Planning Commission was concerned about the additional congestion created by a restaurant in the contiguous residential area and the possible expansion of the nuisances encountered currently by the residents in the surrounding neighborhood. Should such a traffic study confirm the availability of parking, this would not necessarily produce a reduction in the nuisance and congestion problems.
