Welton Anderson, Chairman Aspen Planning and Zoning Commission On November 7, 1989 the Aspen Planning and Zoning Commission approved the conditional use review of an accessory dwelling unit for the Means residence subject to conditions. The property is located at 711 West Sleeker Street. A RESOLUTION OF THE ASPEN PLANNING AND ZONING COMMISSION RECOMMENDING THE APPROVAL OF MEANS CONDITIONAL USE REVIEW FOR ACCESSORY DWELLING UNIT Resolution No. 89- Whereas, the Aspen Planning and Zoning Commission held a public meeting November 7, 1989; and Whereas, the Means Conditional Use Review was included on the agenda; and Whereas, the Planning staff recommended approval of the conditional use for an accessory dwelling unit with conditions. NOW, THEREFORE, BE IT RESOLVED by the Planning and Zoning Commission: That it does hereby approve the Means Conditional Use review for an accessory dwelling unit at 711 West Sleeker, Aspen with the following conditions: 1. Prior to the issuance of a Certificate of Occupancy an approved and recorded copy of the deed restriction for the accessory dwelling unit shall filed with the Housing Authority. 2. The accessory dwelling unit shall be deed restricted to a 6 month minimum lease requirement. 3. The applicant shall provide an easement of sufficient size for phone and cable only, if necessary. 4. The applicant shall join a Special Improvement District if one is formed. APPROVED by the Commission at their regular meeting November 7, 1989. An accessory dwelling unit is subject to standards as defined in Section 5 -508 of the Land Use Code. Staff recommends approval of the conditional use. APPLICANT: Graeme and Elizabeth Means LOCATION: 711 West Sleeker, Lots E & F, Block 18, Aspen ZONING: R -6 APPLICANT'S REQUEST: Conditional use approval for an accessory dwelling unit contained within a single family residence. REFERRAL COMMENTS: In an October 20, 1989 memo, Elyse Elliott of the Engineering Department supported the proposal for construction of an employee unit. The Engineering Department waives the requirement for an additional parking space. The Department recommends the donation of a 4x4 pedestal easement. The applicant should also be required to join an Improvement District if one is formed. STAFF COUNTS: Section 7 -304 outlines the criteria for conditional use review for an accessory dwelling unit as follows: A. The conditional use is consistent with the purposes, goals, objectives and standards of the Aspen Area Comprehensive Plan, and with the intent of the Zone District in which it is proposed to be located. RESPONSE: The provision of an accessory dwelling unit is in line with the goals of the community to provide more affordable housing. This proposal is also consistent with the residential zoning of R -6. B. The conditional use is consistent and compatible with the character of the immediate vicinity of the parcel proposed for development and surrounding land uses, or enhances the mixture of complimentary uses and activities in the immediate vicinity of the parcel proposed for development. r \ o / R RESPONSE: The surrounding land uses are primarily residential. Main street is one street over with a mix of business and residential uses. C. The location, size, design and operating characteristics of the proposed conditional use minimizes adverse effects, including visual impacts, impacts on pedestrian and vehicular circulation, parking, trash, service delivery, noise, vibrations and odor on surrounding properties. RESPONSE: The accessory unit is contained within the single family home thus visual impacts will be minimized. Although the additional unit may increase the number of autos, the code does not require parking for deed restricted dwelling units. the applicant also contends that this area does not have a high parking problem, with which staff concurs. The primary residence is providing four parking spaces, one space per bedroom, as required by the code. D. There are adequate public facilities and services to serve the conditional use including but not limited to roads, potable water, sewer, solid waste, parks, police, fire protection, emergency medical services, hospital and medical services, drainage systems, and schools. RESPONSE: There are adequate public facilities in place to service this studio apartment. E. The applicant commits to supply affordable housing to meet the incremental need for increased employees generated by the conditional use. RESPONSE: There will be no increased employee generation because of this accessory dwelling unit. F. The proposed conditional use complies with all additional standards imposed on it by the Aspen Area Comprehensive Plan and by all other applicable requirements of this chapter. RESPONSE: The accessory dwelling unit complies with the standards imposed upon accessory dwelling units pursuant to Section 5 -508. The unit is approximately 600 square feet, is contained within the primary residence and will be deed restricted to the housing guidelines for a resident occupied unit. Staff does have some concern regarding the below grade nature of this unit, however an accessory dwelling unit is not counted within the allowable FAR if it is one is below grade. A below grade unit, however is a questionable kind of living situation because of light and air and livability. RECOMMENDATION: Staff recommends approval of this conditional 2 use with the condition that prior to the issuance of a Certificate of Occupancy the accessory dwelling unit to be reviewed and approved by the Housing Authority shall be deed restricted to a resident of Pitkin County and minimum 6 month lease and the applicant shall provide a 4x4 pedestal easement and join an Improvement District if one is formed. 11 /means 3 MEMORANDUM TO: City Engineer FROM: Leslie Lamont, Planning Office RE: Means Conditional Use Review DATE: October 11, 1989 Attached for your review and comments is an application from Graeme Means for Conditional Use approval of an accessory dwelling unit. Response to Attachment 4, Review Standards for Your Application The residence (currently under construction) at 711 West Bleeker will contain approximately 2800 square feet of countable floor area and three above grade bedrooms. A fourth bedroom and bath of approximately 600 square feet is located below grade. This bedroom meets all U.B.C. codes including light, ventilation and exit requirements and has an entrance directly to the outside. This application requests approval to add a kitchenette to this space and for approval to rent it to those who would qualify as Pitkin County residents as defined by the Housing Authority. It is understood that the parking requirements for this unit will be waived. This approval is being applied for as per section 5 -510 of the Aspen City Code. We believe this application is supported by all applicable sections of the Aspen Land Use Code and respond to the specific review standards as follows: A. This conditional use is consistent with the city governments' desire to provide affordable housing to Pitkin County residents. It is also consistent with the, stated purpose of the R -6 zone, which is to service as a residential district. B. The immediate vicinity is surrounded by R -6, L -P, R -MF, R -15 and 0 zone districts and is primarily residential. The proposed use is consistent and compatible with these uses. C. The proposed use as designed will have minimal impact on those concerns outlined in this section. One additional vehicle might be added to the city streets, but this is an area that does not have the severe parking problems that exist in many parts of the city. D. There are adequate public facilities in place to service this studio apartment. E. There is no employee generation due to this project. F.
