RE: Metsoluna Restaurant Conditional Use Approval

BACKGROUND INFORMATION
Applicant: RCT Incorporated
Applicant's Representative: Rich Luhman
Location: Hunter Plaza Building (Old Texaco site) Northeast
corner of Cooper and Hunter Streets.
Zoning: C -1
APPLICANT'S REQUEST:
The applicant is requesting conditional use approval to operate
an Italian restaurant and bar in the C -1 zone district (see
attachment 1). The restaurant intends to offer moderately priced
meals of fresh Italian pasta and vegetables. It also intends to
offer desserts and an after hour menu intended to cater to
locals. There is also proposed to be a bar similar in style to
the Ute City Bank.
Referral Comments
Engineering Department: The engineering Department has no comment
concerning the application (see attachment 1).
Zoning Official The Zoning Official commented on the phone
that it is very difficult to control whether or not a restaurant
is locally oriented. He believes that the intent of the C -1 zone
is slowly being compromised as CC zone type uses move toward the
east side of the downtown.
Planning Office Comments
According to the Municipal Code, a restaurant is a conditional
use in the C -1 zone district. The following criteria which are
found in section 24 -3.3 of the Municipal Code are to be used to
evaluate Conditional use requests.
1. Criteria - Whether the proposed use otherwise complies
with all requirements imposed by the zoning code.
Response - The proposed use will be located within the
Hunter Plaza building which received a commercial
Growth management Quota System allocation last year as
part of the 1986 competition. Within the application,
it was stated that a restaurant was being contemplated
as a proposed use.
2. Criteria - Whether the proposed use is consistent with
the objectives and purposes of this zoning code and the
applicable zoning district. The intent of the C -1 zone
district is "to provide for the establishment of
commercial uses which are not primarily oriented
towards serving the tourist population."
Response - The applicant states that the menu of the
restaurant will be oriented to locals and the restaur-
ant will be operated "virtually" year round. The main
concern of the Staff is that if the restaurant opens as
a local oriented restaurant it continue to be operated
as such. It is difficult to require a restaurant to
remain locally oriented, especially since "locally
oriented" is a term which is difficult to define.
Conditions may , however, be tied to the conditional
use approval of this proposal which specify exactly
what type of use is being approved. Any modifica-
tion from this approved use would require additional
conditional use approval from the P &Z.
The applicant is requesting approval to operate a quiet
bar as an accessory use to the restaurant. A disco
type atmosphere is not proposed. Once again the type of
bar in a restaurant is a difficult activity to regu-
late. For instance, we do not think it is appropriate
for the City to say that it is an acceptable condi-
tional use to have a bar if the bar plays acoustical
music, but rock and roll is prohibited. On the other
hand, it may be reasonable to say that if neighboring
properties are not disturbed by the use it is accept-
able, but if they are then it is unacceptable.
3. Criteria - If the proposed zoning is compatible with
the surrounding land uses in the area.
Response - The area in the vicinity of the Hunter Plaza
building is an area in transition. Hunter Plaza will
replace the old Texaco gas station. A new commercial
building is being constructed on the northwest corner
of Hunter and Cooper within the CC zone district. The
southwest corner of the intersection contains retail
stores in the CC zone district. The southeast corner

of the intersection is the location of a mixed use
development containing retail operation including a
restaurant on the ground floor and condominiums above.
Just to the north of the Hunter Plaza building fronting
on Hunter is Ozzies Shoe store, a primarily locally
oriented facility and a retail building housing another
restaurant.
With the construction of the gondola on the south end
of Hunter Street and the approval of the proposed
Little Nell Hotel, the character of the area around the
subject site has begun to change. More and visitor
oriented uses are relocating closer to the gondola
(particularly ski shops).
Based upon these changes in the area and the represent-
ations made by the applicant in attachment 1 it appears
that a restaurant operated as described would be
compatible with the neighborhood.
PLANNING OFFICE RECOMMENDATION
Even though the restaurant as currently proposed may not create
substantial impacts on surrounding land uses, the restaurant may
change operations in the future to become more visitor oriented.
Therefore, if the restaurant is approved it should be understood
that representations made by the applicant in Attachment 2 will
be adhered to. Given our review of the zoning criteria addressed
above and the changes which are taking place in the area surroun-
ding Hunter Plaza the Planning Office recommends approval of the
conditional use request subject to the following conditions:
1. All representations made by the applicant in attachment
1 shall be adhered. Operating the restaurant in a
manner inconsistent with representations made in the
letter are grounds for revocation of the conditional
use approval.
2. Changes to the operation of the restaurant or to its
size will be subject to review pursuant to conditional
use procedures in the Code.
3. Live music shall be prohibited.
4. The restaurant /bar will not operate as a "dance disco"
operation.
5. The restaurant shall remain open during the spring and
fall off- seasons.

Dear Alan:
Please consider this an application for a grant of
conditional use in the C -1 District pursuant to Section
24 -3.2 and Section 24 -3.3 of the Aspen Municipal Code. My
client, R.C.T., Inc. intends to open an Italian pasta
restaurant serving Italian cuisine in the new building to be
constructed at the present Texaco location. This building,
with a restaurant use, was approved in the Commercial GMP.
Pursuant to the grant of conditional use I offer the
following information: the owner of the restaurant intends
to offer moderately priced meals of fresh Italian pasta and
vegetables. It also intends to offer desserts and an after
hour menu intended to cater to locals. It is the intent of
my clients to have the restaurant open virtually year round.
We believe that with keeping the restaurant open virtually
year round and with its proposed hours of operation it will
primarily accommodate the local population. It is our intent
to have a bar similar to the bar at the Ute City Banque where
people can quietly sit, drink and meet. This restaurant is
to be located in a new building next to the commercial core
and I believe the area near this building has a character
closer to the commercial core character than to the C -1
character. An examination of that corner suggests that major
changes are taking place in the area. Texaco is being
replaced by a commercial building, the Shaft building is
being replaced with a new commercial building and the tone
and feel of that corner is in line with C -C uses rather than
C -1 uses. In addition, behind this building there is a
Mexican restaurant which has applied for a liquor license and
is open until very late at night. Despite the restaurant's
proximity to the C -C type uses, it is not the owner's intent
to create an atmosphere of loud music or noise but it is

crucial for a viable restaurant operation to be able to sell
food and liquor in the late hours. The hours of operation
will be between 11:00 a.m. and 2:00 a.m. and a seating
capacity of approximately 100 is anticipated. Since the new
building with its restaurant use was recently approved in the
GMP I believe that the concerns of Section 24 -3.3 have been
reviewed by the Planning and Zoning Commission. Since the
adoption of the C -1, Sumo's restaurant and the Weinerstube
have both been approved as conditional uses in the C -1
District. These supplement the existing restaurant uses in
the C -1 zone. I believe that time has shown that restaurant
uses in the C -1 zone are appropriate and have not become a
burden or inconvenience for any of the adjacent property
owners. I believe therefore that a restaurant such as being
proposed by my clients should be approved as a conditional
use in the C -1 zone district. I would appreciate your
placing this on the next available P & Z agenda since it is
important for us to begin the process of preparing
construction documents as soon as possible. Enclosed please
find the planning fee. A list of the adjacent property
owners will be supplied.
