RE: Montgomery Wards - Conditional Use Application
DATE: March 17, 1977
The Planning Office has received additional information
concerning the long delayed application by Montgomery Ward's
for a conditional use approval of their catalog sales store.
Previous to the Montgomery Ward's use of this space, Alpine
Wholesale occupied this space and engaged in a general ap-
pliance- discount sale outlet operation. We consider this use
to be the same class of use as a Montgomery Ward's catalog
store.
In addition, on December 6, 1976 a City Business License
was issued to Montgomery Ward's by the City. We were under the
impression that no license was issued and that the license
was on hold pending this conditional use review.
It is the recommendation of the Planning Office
that Montgomery Ward's has a non - conforming status due to the
prior retail use of the space and the issuance of a valid
business license by the City. We will continue to work with
the Montgomery Ward's representatives to alleviate access and
parking concerns at this site.

Dear Hal:
Pursuant to your request, this is to further
explain that a 1976 city business license was
obtained for the Montgomery Ward catalog store
outlet at 414 North Mill Street. A copy of the
license is enclosed. After all the preliminaries,
business actually commenced in October, 1976.
For the past year or so, prior to the
commencement of the Montgomery Ward operation,
Alpine Wholesale occupied the exact same space
and engaged in a general appliance- discount sale
outlet operation. Montgomery Ward's operation
would not seem to be any extension or enlargement
of that pre- existing, non - conforming use.
Bob and Clyde told me they had a successful
preliminary meeting with Dave Ellis in connection
with their proposals to improve upon the attendant
parking and traffic problems. They were encouraged
with the possibilities of working out a mutually
amenable solution in connection with the City's
proposed improvements and changes along Mill Street.

All in all, we hope that the Planning Office
reconsider its objections to the conditional use
application or, in the alternative, decide that an
application for approval is not required in this
case on account of all of these unusual surrounding
circumstances.
In any event, please be well assured that all
of the traffic and parking problems cited in your
February 11, 1977 memorandum will be diligently
pursued by the owners, irrespective of the outcome
of the conditional use situation.

much appreciated.

Notice is hereby given that a public hearing will be held on February 1, 1977
at 5:15 P.M. in City council Chambers, City Hall, Aspen before the Aspen
Planning and Zoning Commission to consider the conditional use application
for a Montgomery Wards catalogue sales office to be located at 414 North
Mill Street.
A copy of the application may be examined in the office of the City /County
Planner during normal working hours.

MEMORANDUM

RE: Conditional Use - Montgomery Wards Catalogue Sales Store
DATE: February 11, 1977
This is a continued Public Hearing to consider the conditional use
request for a catalogue sales store (Montgomery Wards) to be located
at 414 North Mill Street adjacent to the Rio Grande Property in the
former "Jenkins Building ".
The square footage of the store is 2,600 sq. ft. The business consists
of taking over - the - counter and telephone orders which are then picked
up at the store location by the customer. A display room with an
assortment of sample items is maintained on the premises.
The comments of the Planning Office are as follows:
1) The application for this use was precipitated by a referral to
the Planning Office from the Aspen Building Department, inquiring
whether a catalogue sales store was allowed in the S.C.I. Zone
district. We informed the Building Department and the applicant,
Mr. Robert Andrews, by the letter dated December 27, 1976, that the
use is allowed in the S.C.I. Zone as a conditional use and informed
the applicant of the procedures necessary for review of the use.
2) The Montgomery Wards store has been in existence at this site for
an undetermined time with no prior approvals obtained. The
use question arose as a result of a request for a business license
from the City of Aspen. The Building Department normally reviews
the business license application for determination of compliance
with the City zoning law.
3) The Planning Office has reviewed the request and recomends denial
for the below listed reasons:
a. Inadequate parking exists on the site to accomodate customer
visits. No site map was submitted with the application, but we
are aware of no reserved parking for this use on this site.
b. The access to the adjacent city street, Mill Street, is hazardous
due to the continuous curb cut fronting the building.

c. Users of the building now encroach on both City and County
property for parking and storage purposes. This additional
use will exacerbate this existing problem.
d. Delivery and pick -up service to the building is seriously
constrained by the lack of a defined service area and the
inadequate access and parking design.
e. The applicant has suggested use of the Rio Grande Property
development by the City for parking. The Planning Office
has recommended against such private parking use of City
property.
4) Should members of the Planning Commission be unfamiliar with this
site, we recommend conducting a site inspection.

Dear Bob,
A catalog sales store is allowed in the Service /Commercial zone
as a conditonal use pursuant to the City of Aspen Zoning Code.
I am not aware of a previous approval being given to the Montgomery
Ward's outlet.
Please contact us as to the procedures necessary for review of
this use. A conditional use hearing is required before the Aspen
Planning and Zoning Commission with fifteen (15) day notice
to property owners within three hundred feet (300') of the site.
