For purposes of this Subsection, failure to pursue the approval of a site- specific development plan in a timely fashion shall mean a failure on the part of the applicant to take any action with the Community Development Department in furtherance of the application for a period of at least one year. An abandoned application shall render all previously issued land use approvals, which do not constitute the approval of a site-specific development plan, void unless the Community Development Director determines that reinstatement of the application is in the best interests ofthe City. Because the variances are not required "due to site specific constraints" (the first variance standard), the department will not grant then administratively. The other variance standard, the proposal provides a better design, was also discussed in our staff meeting and the Staff did not feel we could grant the requested variances based on that standard either. We feel the window standard could be met while still being true to the design of a two story room. You do have the option of requesting the variances from the Planning and Zoning Commission, but it looks like the Planning Commission agenda is booked through May. Development Design Philosophy Homestake Cottages provide one home for Marks and one home to be sold. The overarching design direction is to avoid a large single mass, and instead to break up the elements of the duplex into smaller living spaces. The goal is to give each residence, and it's appearance from the street, the feel of a distinctive, mid-size single family home, while meeting the code requirements of a duplex property. This design provides better view planes for neighbors and passers-by because of it's broken up design. The concept will incorporate a sense of minimal transition between indoor and outdoor spaces, using significant amounts of glass and numerous openings onto planted terraces. The small glass solarium-like sitting rooms adjoining each other by the common garden wall will give passers-by and rear neighbors a sense of transparency, and less building mass. Consistent with those concepts, the light wells are larger than required, resulting in reduced available FAR. We are not attempting to build the maximum number of square feet allowed on this property, but instead, building two efficient homes with unique architectural styles. The two cottages will have different, but complimentary exterior styles, again contributing to the sense that the duplex is not one large mass. Recognizing that this design philosophy is different than the typical duplex design being approved and built in the Cemetery Lane neighborhood, we seek Community Development staff input on the following potential variances we will require to meet our goals. Design Variance Request 26.410.020.D Variances 26.410.040.D.3.a Street Facing Windows Variance Request The anticipated architectural style of the two homes is expected to be somewhat contemporary in nature, and incorporate significant amounts of glass in many areas of the homes to give a sense of minimal barrier between indoors and outdoors. The home will be designed in many areas to move freely between indoors and outdoors. Therefore the front walls are expected to be primarily large narrow-framed sections of glass. Some of these glass elements may be operating windows, others will be stationary glass walls. The living room areas located in the front of each home are double height, therefore with no requirement for a ceiling/floor which would normally be in the 9 to 12 foot height area. The front walls of the one story enclosed terrace sitting areas are about 13 feet in height. We have no architectural need in either case to interrupt the sectioned glass front walls with another element (wood, steel, concrete, etc.) cutting across it. We request that we be permitted to construct the front walls primarily of glass sections and windows without interruption of other materials in the 9 to 12 foot height area. 26.410.040.D.2 One Story Element The code requires that a first-story-street facing element be at least 20% of the overall building's width. The porch of Cottage 2 fulfills the width requirement for the Cottage 2 structure. Also, if the principle masses of the two homes were to be placed together, the porch width of cottage 2 would satisfy the 20% requirement. In addition, the sitting areas also act as street-facing first story elements for the two homes. The sitting areas were recessed behind the principle masses of the main residences to reinforce the established design philosophy of breaking-up the duplex into smaller masses. We request that the width of the proposed front porch on Cottage 2 be considered adequate for purposes of the one story street facing element requirement for the overall project. By providing a] two separate main dwellings, b] Cottage 2 front wall being set back from Cottage 1, and 3] two separated one story sitting areas attached at the common garden wall, we believe that we have met the spirit of the design philosophy behind the one story element requirement. Engineering Variance Request 21.16.060 (e)(1) Driveway and curb cut specifications 21.16.070 Variations in driveways and curb cuts allowed for unusual conditions The engineering variance request is included here to facilitate communication between the staff of the planning and engineering departments. A separate application is being made directly to the engineering department for the curb-cut variance Driveway Curb-Cut Variance The two separated dwellings design is best executed with a smaller, dedicated driveway for each dwelling. The garages for both units are in the rear, as preferred by the current residential design standards. Sharing a large driveway through one owner's property is an impractical approach. We propose to construct two driveways. One driveway will be on the extreme East side and one on the extreme West side of the property. The driveways and driveway cuts will be as narrow as practical to maximize green landscape. We believe that two 10 ft driveway cuts will make much more aesthetically pleasing driveways, than the large area of concrete and central auto court of the one driveway 18 ft cut solution. The two 10 ft driveway cuts together are less than the existing 24 ft. cut. Because there is no sidewalk on Homestake Drive, there are no resulting sidewalk/driveway/curb impacts. On street parking is more than adequate and not a problem on Homestake or the neighboring streets even during special town events or during the busy tourist seasons. As is shown on the proposed site plan, the number of parking spaces across the property remains at 7 regardless of weather the curb cuts are laid-out with a] the existing 24ft wide cut, b] the allowed 18ft cut or c] the proposed two 10ft. cuts. Summary We believe that the design and engineering variances we are requesting work together to support the design philosophy of reducing scale, and the sense of large building mass. We believe that those goals are consistent with the spirit of the goals of Aspen's community development standards, and in fact speak to those goals more effectively than traditional mirror image duplex building concepts. Development Design Philosophy Homestake Cottages provide one home for Marks and one home to be sold. The overarching design direction is to avoid a large single mass, and instead to break up the elements of the duplex into smaller living spaces. The goatis to give each residence, and it's appearance from the street, the feel of a distinctive, mid-size single family home, while meeting the code requirements of a duplex properfy. This design provides better view planes for neighbors and passers-by because of it's broken up design. The concept will incorporate a sense of minimal transition between indoor and outdoor spaces, using significant amounts of glass and numerous openings onto planted terraces. *he-small glass solarium-like sitting rooms adjoining each other by the common, garden wall will give passers-by and rear neighbors a sense of transparency, and less building mass. Consistent with those concepts, the light wells are larger than require*,esulting. ini~ladge*awailable FAR. We are not attempting to build the maximum number of square feet allowed on this property, but instead, building two efficient homes with unique architectural styles. The two cottages will have different, but complimentary exterior styles, again contributing to the sense that the duplex is not one large mass. Recognizing that this design philosophy is different than the typical duplex design being approved and built in the Cemetery Lane neighborhood, we seek Community Development staff input on the following potential variances we will require to meet our goals. Engineering Variance Request 21.16.060 (e)(1) Driveway and curb cut specifications 21.16.070 Variations in driveways and curb cuts allowed for unusual conditions Driveway Variance The two separated dwellings design is best executed with a smaller, dedicated driveway for each dwelling. The garages for both units are in the rear, as preferred by the current residential design standards. Sharing a large driveway through one owner's property is an impractical approach. We propose to construct two driveways. One driveway will be on the extreme East side and one on the extreme West side of the property. The driveways and driveway cuts will be as narrow as practical to maximize green landscape. We believe that two 10 ft driveway cuts will make much more aesthetically pleasing driveways, than the large area of concrete and central auto court of the one driveway 18 ft cut solution. Because there is no sidewalk on Homestake Drive, there are no resulting sidewalk/driveway/curb impacts. On street parking is more than adequate and not a problem on Homestake or the neighboring streets. As is shown on the site plan, the two proposed 10ft driveway cuts do not reduce the parking any more than the 18ft cut allowed by code. Design Variance Request 26.410.020.D Variances 26.410.040.D.3.a Street Facing Windows Variance Request The anticipated architectural style of the two homes is expected to be somewhat contemporary in nature, and incorporate significant amounts of glass in many areas of the homes to give a sense of minimal barrier between indoors and outdoors. The home will be designed in many areas to move freely between indoors and outdoors. Therefore the front walls are expected to be primarily large narrow-framed sections ofglass. Some of these glass elements may be operating windows, others will be stationary glass walls. The living room areas located in the front of each home are double height, . therefore with no requirement for a ceiling/floor which would normally be in the 9, . to 12 foot height area.. The front walls of the one story enclosed terrace sitting areas are about 13 feet in height. We have no architectural need in either case to interrupt the sectioned glass front walls with another element (wood, steel, concrete, etc.) cutting across it. We7equest that we be permitted to construct tkie front walls primarily of glass sections and windows without interruption of.Wer materials in the 9 to 12 foot heigINLAIN~ 26.410.040.D.2 One Storv Element We request that the front porch on Cottage 2 be considered adequate fo, purposes of the one story front facing element requirement for the project. Our established design philosophy is to break up the duplex into smaller masses. With a) two separate main dwellings, b) Cottage 2 front wall being set back from Cottage 1, and 3) two separated one story sitting areas attached to the common garden wall, we believe that we have met the spirit of the design philosophy behind the one story element requirement. Summary We believe that the design and engineering variances we are requesting work together to support the design philosophy of reducing scale, and the sense of large building mass. We believe that those goals are consistent with the spirit of the goals of Aspen's community development standards, and in fact speak to those goals more effectively than traditional mirror image duplex building concepts. A conditional approval would serve the applicant in that the applicant could proceed with a little more reliance but also serve the planning department in that the staff is not completely writing blank check approval for a sensitive request. A conditional approval could be based on a secondary administrative planning staff review to confirm that the overall fenestration of the glass and materials of the house are in keeping with the goals of the residential design standards. k I will outline this further in the upcoming land use application for next week. Development Design Philosophy Homestake Cottages provide one home for Marks and one home to be sold. The overarching design direction is to avoid a large single mass, and instead to break up the elements of the duplex into smaller living spaces. The goal is to give each residence, and it's appearance from the street, the feel of a distinctive, mid-size single family home, while meeting the code requirements of a duplex property. This design provides better view planes for neighbors and passers-by because of it's broken up design. The concept will incorporate a sense of minimal transition between indoor and outdoor spaces, using significant amounts of glass and numerous openings onto planted terraces. The small glass solarium-like sitting rooms adjoining each other by the common garden wall will give passers-by and rear neighbors a sense of transparency, and less building mass. Consistent with those concepts, the light wells are larger than required, resulting in reduced available FAR. We are not attempting to build the maximum number of square feet allowed on this property, but instead, building two efficient homes with unique architectural styles. The two cottages will have different, but complimentary exterior styles, again contributing to the sense that the duplex is not one large mass. Recognizing that this design philosophy is different than the typical duplex design being approved and built in the Cemetery Lane neighborhood, we seek Community Development staff input on the following potential variances we will require to meet our goals. Design Variance Request 26.410.020.D Variances 26.410.040.D.3.a Street Facing Windows Variance Request The anticipated architectural style of the two homes is expected to be somewhat contemporary in nature, and incorporate significant amounts of glass in many areas of the homes to give a sense of minimal barrier between indoors and outdoors. The home will be designed in many areas to move freely between indoors and outdoors. Therefore the front walls are expected to be primarily large narrow-framed sections of glass. Some of these glass elements may be operating windows, others will be stationary glass walls. The living room areas located in the front of each home are double height, therefore with no requirement for a ceiling/floor which would normally be in the 9 to 12 foot height area. The front walls of the one story enclosed terrace sitting areas are about 13 feet in height. We have no architectural need in either case to interrupt the sectioned glass front walls with another element (wood, steel, concrete, etc.) cutting across it. We request that we be permitted to construct the front walls primarily of glass sections and windows without interruption of other materials in the 9 to 12 foot height area. 26.410.040.D.2 One Storv Element ~ The code requires that a first-story-street facing element be at least 20% of the ,~/ overall building's width. The porch of Cottage 2 fulfills the width requirement for \ the Cottage 2 structure. Also, if the principle masses of the two homes were to \ be p/aced together, the porch width of cottage 2 would satisfy the 20% J requirement. In addition, the sitting areas also act as street-facing first story elements for the two homes. The sitting areas were recessed behind the principle masses of the main residences to reinforce the established design philosophy of breaking-up the duplex into smaller masses. We request that the width of the proposed front porch on Cottage 2 be considered adequate for purposes of the one story street facing element requirement for the overall project. By providing a] two separate main dwellings, b] Cottage 2 front wall being set back from Cottage 1, and 3] two separated one story sitting areas attached at the common garden wall, we believe that we have met the spirit of the design philosophy behind the one story element requirement. Engineering Variance Request 21.16.060 (e)(1) Driveway and curb cut specifications 21.16.070 Variations in driveways and curb cuts allowed for unusual conditions The engineering variance request is included here to facilitate communication between the staff of the planning and engineering departments. A separate application is being made directly to the engineering department for the curb-cut variance Drivewav Curb-Cut Variance The two separated dwellings design is best executed with a smaller, dedicated driveway for each dwelling. The garages for both units are in the rear, as preferred by the current residential design standards. Sharing a large driveway through one owner's property is an impractical approach. We propose to construct two driveways. One driveway will be on the extreme East side and one on the extreme West side of the property. The driveways and driveway cuts will be as narrow as practical to maximize green landscape. We believe that two 10 ft driveway cuts will make much more aesthetically pleasing driveways, than the large area of concrete and central auto court of the one driveway 18 ft cut solution. The two 10 ft driveway cuts together are less than the existing 24 ft. cut. Because there is no sidewalk on Homestake Drive, there are no resulting sidewalk/driveway/curb impacts. On street parking is more than adequate and not a problem on Homestake or the neighboring streets even during special town events or during the busy tourist seasons. As is shown on the proposed site plan, the number of parking spaces across the property remains at 7 regardless of weather the curb cuts are laid-out with a] the existing 24ft wide cut, b] the allowed 18ft cut or c] the proposed two 10ft. cuts. Summary We believe that the design and engineering variances we are requesting work together to support the design philosophy of reducing scale, and the sense of large building mass. We believe that those goals are consistent with the spirit of the goals of Aspen's community development standards, and in fact speak to those goals more effectively than traditional mirror image duplex building concepts.
