The homeowners have shown images of property damage due to such circumstances and believe that the net would significantly reduce the impact of the stray balls from the 2nd fairway of Aspen Golf Course. Staff has determined that this variance request will be a Minor Application and be reviewed by City Council. Typically, pursuant to Section 26.314.030 of the Code, requests for variance are presented to the Board of Adjustment. The Board of Adjustment responds to cases involving; (a.) Dimensional Requirements and (b.) Permitted uses, but only to allow for the temporary off-site location or storage of materials, structures or equipment pursuant to building construction or construction staging. Thus, being that a height variance does not fall under purview of the Board of Adjustment, staff has determined that this variance request will be a Minor Application and be reviewed by City Council. Staff additionally recommended that the applicant apply with a condition on the variance that the fence be taken down during winter season. The reason for this request is that the property is located adjacent to the 2nd fairway of the Aspen Municipal Golf Course and is subject to golf balls flying onto the property and doing damage to the home as well as subjecting the residents of the property to substantial safety risk of being hit by flying golf balls. The errant golf balls are a constant hazard during the season with balls flying onto the property at the rate of 8- 10 per day. The residents and property are also subject to the trespass of golfers who feel entitled to entry on to the private fenced property to retrieve their balls. To mitigate this hardship and safety hazard as well as the ongoing damage to the property, Mr. Pine has asked me to install a seasonal golf ball barrier starting from the south west corner of the property and proceeding northerly along the property boundary. The fence dimensions will be 80 ft long X 14ft high. It will be constructed of an industry standard nylon mesh and hung on 14 ft. X 2 in. steel poles spaced at 10 ft. The barrier is constructed so that it will be installed in the spring before the golf season opens and removed in the fall at the end of the golf season. Previous owners of the property have taken the steps to try to eliminate the hazard by building a berm, planting many trees, and installing protective netting over the west facing windows but these efforts have been unsuccessful in eliminating the ongoing damage and risk. I have included pictures of the property and damage done to the property including a window broken by a golf ball just last week. Your careful attention to this matter and approval of the height variance will be greatly appreciated.
