Parcel ID: 2735-024-030-03 WHEREAS, the Community Development Department received an application from Philip Pine, represented by Matthew Ferguson and Ryan Pardue of Garfield & Hecht P.C, requesting approval of a variance to allow a fourteen foot fence made of golf netting; and, WHEREAS, pursuant to Section 26.314, the City Council may approve a Variance, during a duly noticed public hearing after considering a recommendation from the Community Development Director, and recommendations from relevant referral agencies; and, WHEREAS, upon review of the application and the applicable code standards, the Community Development Department recommended approval of the requested variance with conditions; and, WHEREAS, during a duly noticed public hearing on June 8,2009 and continued to June 22,2009, the City Council approved Resolution No. 36, Series of 2009, by a four to zero (4 - 0) vote, approving a Variance; and, WHEREAS, the Aspen City Council has reviewed and considered the development proposal under the applicable provisions of the Municipal Code as identified herein, has reviewed and considered the recommendation the Community Development Director, the applicable referral agencies, and has taken and considered public comment at a public hearing; and, WHEREAS, the City Council finds that the development proposal meets or exceeds all applicable development standards and that the approval of the development proposal, with conditions, is consistent with the goals and elements of the Aspen Area Community Plan; and, WHEREAS, the City Council finds that this Resolution furthers and is necessary for the promotion of public health, safety, and welfare. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ASPEN AS FOLLOWS: Resolution No 36, Series 2009 Page l of 3 Section 1: Pursuant to the procedures and standards set forth in Title 26 of the Aspen Municipal Code, the City Council hereby approves a variance to permit a fourteen foot high fence made of golf netting be constructed on the property. The fence shall only be erected when the Aspen Municipal Golf Course is running golf operations. Section 2: Fence Location & Material The fence shall be located at the base of an existing berm that is located partially on the Golf Course property and on the Applicant's property until it reaches the existing wood fence, at which point the golf netting fence will enter the Applicant's property and be woven through the existing stand oftrees, see Exhibit A to this Resolution. The fence poles shall be painted a dark color to better blend in with the existing vegetation. Section 3: Parks Department The Applicant is required to acquire an approved work under the drip line permit (tree removal permit) prior to installation of the fence. Any trimming of tree branches must be kept to a minimum and all tree work should be accomplished by a professional tree care company. All work on trees must comply with city tree code #13.20, The Parks Department shall verify compliance with this requirement. Section 4: Golf Course Encroachment and License Agreement City Council hereby authorizes the City Manager to enter into a license agreement between the Applicant (and any future owners of !495 Homestake) and the City of Aspen that would permit a portion of the fence to encroach onto a portion of Golf Course property, as illustrated in Exhibit A to this Resolution, The encroachment license shall be automatically renewed on a yearly basis, but may be reviewed for compliance by City Council ancFor City Staff at the year intervals. The City may revoke the encroachment license at any time if the terms are violated. Section 5: Golf Course PUD City Council hereby directs the Community Development Department to approve an Administrative PUD Amendment for the Golf Course PUD to allow the golf netting fence to be construction on a portion of Golf Course (city) property. Section 6: All material representations and commitments made by the Applicant pursuant to the development proposal approvals as herein awarded, whether in public hearing or documentation presented before City Council, are hereby incorporated in such plan development approvals and the same shall be complied with as if fully set forth herein, unless amended by an authorized entity. Section 7: This resolution shall not affect any existing litigation and shall not operate as an abatement of any action or proceeding now pending under or by virtue of the resolutions or ordinances Resolution No 36, Series 2009 Page 2 of 3 repeated or amended as herein provided, and the same shall be conducted and concluded under such prior resolutions or ordinances. Section 8: If any section, subsection, sentence, clause, phrase, or portion of this resolution is for any reason held invalid or unconstitutional in a court of competent jurisdiction, such portion shall be deemed a separate, distinct and independent provision and shall not affect the validity of the remaining portions thereof. PINE ("Pine") on the one side and the CITY OF ASPEN ("CITY") on the other side. Each party hereto is hereinafter collectively referred to individually as a "Party" and collectively as the "Parties." RECITALS A. Pine is the owner of Unit 2 of the Homestake Condominiums, commonly known as 1495 Homestake Dr., #2, Aspen, Colorado, and legally described as Unit 2, HOMESTAKE CONDOMINIUMS, according to the Condominium Plat thereof recorded April 18,2000, in Plat Book 53 at Page 4 as Reception No. 442468 and as defined and described in the Condominium Declaration for Homestake Condominiums recorded April 19, 2000, at Reception No. 442476 ("Pine Property"). Unit 2 is improved with an approximately 4,410 square foot residential structure ("Pine Residence"). B. The City of Aspen is the owner of the Aspen Golf & Tennis Club, 1000 Truscott Place, Aspen, Colorado 81611 ("City Land"). C. The Pine Residence is situated along the second fairway ofthe Aspen Golf & Tennis Club. D. By Resolution #36, Series 2009, Aspen City Council approved a variance for a fourteen foot fence made of golf netting ("golf ball safety net") and authorized a license agreement allowing for a portion ofthe golfball safety net to encroach on City property E. The golf ball safety net will be located in the area of the Pine Property's western property line at the base ofan existing benn, located partially on City Land and partially on Pine Property. Starting from the front-most fagade ofthe Pine Residence, the golf ball safety net will run south approximately forty (40) feet on City Land until it reaches the Pine Property (see 447082-1 GOLF BALL SAFETY NET LICENSE Page 2 of 6 Exhibit "A"), at which point the remaining portion ofthe golf ball safety net will be installed on Pine Property in accordance with variance approval. F. The golf ball safety net will not encroach onto City Land beyond the eastern base of the existing berm, as depicted in Exhibit "A." G. Pine will paint the posts of the golf ball safety net to blend in with existing vegetation. H. Pine will remove the posts and netting portions of the golf ball safety net during the winter months, from approximately November to April, when the Aspen Golf & Tennis Club is closed for golfing operations. AGREEMENT For good and valuable consideration ofthe terms, conditions, and promises contained in this License, the sufficiency ofwhich is hereby acknowledged, the Parties agree as follows: 1. Grant of License. The License shall become effective upon signature of the last Party to the License. For the purposes set forth herein, if all requirements are met, but a PUD amendment should require time to complete, the City hereby assigns, transfers and grants Pine the right to use the portion of City land described above so that the golf ball safety net can be installed when the license becomes effective and when other installation requirements are met. 2. Maintenance. The golf ball safety net will be installed and maintained by Pine. 3. Liability and Indemnity. In the event that any ofthe parties might otherwise be liable under applicable state statutes, Pine hereby agrees, to the extent permitted by law, to indemnify and hold the City harmless from and against claims or awards for loss, damage or any liability including reasonable attorneys' fees and costs, which may result from Pine's acts or omissions covering and including installation, maintenance, repair, replacement, and public use ofthe golfball safety net. 447082-1 GOLF BALL SAFETY NET LICENSE Page 3 of 6 4. Assignment of Rights. Each Party to this License represents and warrants that it or he/she has not sold, assigned, conveyed, or otherwise transferred, prior to the final execution ofthis License, any interest in the City Land. 5. Voluntary Agreement. The Parties agree and understand thht this License has been freely and voluntarily entered into and that no representations or promises of any kind other than those contained in this License have been made by any Party to induce any other Party to enter into this License. The Parties have read and understand this License in its entirety. The Parties acknowledge that each ofthem has been, or has had the opportunity to be, represented by counsel in connection with the negotiation, drafting, and execution ofthis License. 6. Authority to Enter Agreement. Each person and entity executing this License warrants that he/she/it is the duly authorized representative of the person or entity for which he/she/it acts and is fully and legally empowered to execute and deliver this License. 7. Interpretation of License. Each Party acknowledges and agrees that this License shall not be deemed prepared or drafted by any one Party. In the event of any dispute between the Parties concerning this License, the Parties agree that any rule o f construbtion, to the effect that any ambiguity in the language of the License is to be resolved against the drafting Party, shall not apply. 8. Governing Law, Jurisdiction and Venue. This License shall be governed and construed in accordance with the laws ofthe State of Colorado. Jurisdiction hnd venue for any action arising out of this License shall rest exclusively with the County Court or District Court for Pitkin County, Colorado, as may be appropriate, except that the Parties may agree to mediate or arbitrate any disputes that may arise in the event of any action for breach of, to enforce the provisions of, or otherwise involving, this License. 447082-1 GOLF BALL SAFETY NET LICENSE Page 4 of 6 9. Parties to Bear Own Attorneys' Fees and Costs. Except may otherwise provided, each Party shall bear his/her/its own attorneys' fees and costs incurred in connection with this License. 10. Modification of Agreement. No provision or term of this License may be amended. modified, revoked, supplemented, waived, or otherwise changed except by written instrument duly executed by all ofthe Parties hereto. 11. Counterparts/Facsimile. This License may be executed in counterparts, each of which shall be an original, and all of which together shall constitute the License. Facsimile signatures shall be binding. 12. Binding Effect. The terms and conditions contained in this License shall inure to the benefit of and be binding upon, the respective representatives, successors, heirs and assigns ofthe Parties. The License shall automatically renew on a yearly basis, but may be reviewed for compliance by City Council and/or City Staff at yearly intervals. The City may revoke the encroachment license at any time upon thirty (30) days written notice given by the City to Pine. 13. Entire License. The Parties agree that this License constitutes *e final and entire agreement among the Parties and thereby supersedes and voids any and all prior agreements, letters, or understandings, whether written or oral, which may have existed regarding the subject matter ofthis License. 14. Effective Date of this License. The Effective Date of this License shall be the date upon which the last Party signs the License. 15. Headings and Captions. All ily#Nvor, motion carded~ ~~ RESOLUTION #36, SERIES OF 2009 - Dimensional Variance 1495 Homestake Drive Fence Jessica Garrow, community development department, reminded Council at the last public hearing, they directed staff to return with an agreed upon location for this fence. City staff met on site with the applicant and agreed on a location, which is shown in exhibit C. A portion o f the fence is on city property, under where a berm exists, which helps minimize the visual impacts ofthe fence. The fence then goes onto the applicant's property and weaves through the trees. The resolution approves a 14' height variance on the applicant's properly and allows the city to enter into a license agreement for that part of the fence on city property. Ms. Garrow noted there is a letter from the owner of the other half of the duplex, who will have to agree on the location of the fence. Ms. Garrow said this is a private property matter. Ms. Garrow said staff feels it is important the fence enter the applicant's property where shown on exhibit C to minimize visibility from the gol f course, to minimize visibility from the adjoining property owners, and it is better for the trees. Brian Flynn, parks department, told council the reason the proposed location for the fence is threaded through the trees is these are spruce trees and some lower branches need to be trimmed and the parks department will do it on the branches already dead. Staff showed Council example of the fence that will be used. Mayor Ireland opened the public hearing. There were no comments. Mayor Ireland closed the public hearing. Mayor Ireland moved to approve Resolution #36, Series of 2009; seconded by Councilman Johnson. All in favor, motion carried. REQUEST OF THE CITY COUNCIL: The Applicant, Philip Pine, is requesting Council approval of a dimensional variance to erect a fourteen (14) foot fence made of golf netting. The applicant is making this request to address property damage and safety issues related to golf balls landing on the property from the Aspen Municipal Golf Course. PREVIOUS ACTION BY CITY COUNCIL: After hearing presentations from both staff and the Aprlication, City Council continued the matter on June 8, 2009 to June 22,2009. At the June 8t public hearing. Council directed staff and the Applicant to return with an agreed upon location of the fence that would allow a portion of the fence to be on the Golf Course. City 1 Council closed the public hearing on June 8th, and indicated that the item should be brought back on June End. REQUIRED REVIEWS: Dimensional variances for height are reviewed by City Council. The Applicant requests the following reviews: • Dimensional Variance from the height requirements to erect a fourteen (14) foot high fence pursuant to Land Use Code Chapter 26.314, Variances (City Council is the final review authority). Other applicable code sections include: • Fences, section 26.575.050 of the I.and Use Code. This section states, "Fences shall be permitted in every zone district provided that no fence shall exceed six (6) feet above natural grade or as otherwise regulated by the Residential Design Standards..." BACKGROUND: The property is located adjacent to the Aspen Municipal Golf Course's second hole fairway. The Applicant has provided pictures illustrating the damage caused to the property from golf balls being hit from the second hole. The Applicant would like to install a seasonal fence made of golf netting to protect the home from the golf balls. PROJECT SUMMARY: The Applicant requests a dimensional varianee to permit a seasonal fence made of golf netting to be constructed along the western property line. The fence is proposed to be fourteen (14) feet high and run approximately eighty (80) feet along the one- hundred and twenty (120) foot long western property line. The proposed fence would not go forward of the garage, which is the front-most fa~ade of the house. The fence is proposed to be made of similar material as the existing golf netting near the driving range on the golf course, and will be seasonal in nature. The applicant would install holes in the ground that the fence posts and the netting would be connected to during golf season (approximately May through October) - both the posts and netting would be removed when the golf course is not in operation for golfing activities. Update since June 88 Council Meeting: City staff from the Manager's Office, Parks Department, and Golf met on site on June 9th to determine what location of the fence would be acceptable. After that meeting, City staff concluded that the fence could be allowed to encroach onto the Golf Course near an existing berm, but that the fence should enter the Applicant's property where staff had originally indicated in the June 8111 Council memo (see Exhibit C). i Following that site visit, staff from the Parks, Golf, and Community Development Departments met on site with the Applicant's representatives to finalize an agreed upon fence location. Attached as Exhibit F is a picture indicating the pole locations that would be located on the Golf Course. Both staff and the Applicant have agreed to allow an encroachment on Golf Course property to allow the fence to be placed at the base of the existing berm, as indicated in Exhibit F. ' There is an existing 42 inch fence located near the rear of the property. As Exhibit C indicates, the fence would be brought into the Applicant's property where this fence begins and then be "weaved" through the trees. 2 STAFF COMMENTS: Staff comments and findings related to the Variance review criteria are included below. Detailed staff findings are found in Exhibit A. VARIANCE: Variances from the Land Use Code are deviations that "would not be contrary to the public interest when, owing to special circumstances or conditions, the literal enforcement of the provisions of this Title would result in undue and unnecessary hardships. Staff finds that this lot is uniquely situated to warrant a dimensional variance for fence requirements. The parcel is located adjacent to the second hole on the Aspen Municipal Golf Course. and is located in such a way that drives from the tee box enter the property. While there are other parcels adj acent to the golf course, there are no other properties that are in "line-drive" territory when golfers tee off. This is a unique situation that encumbers this lot and no others. Staff finds that because of this parcel's location in relation to the golf course, that it is uniquely situated to be impacted by errant golf balls. The proposed golf netting makes sense in this context. GOLF COURSE CONSIDERATIONS: In order to allow the fence to encroach on the Golf Course property, an administrative PUD Amendment for the Golf Course PUD will be required. Additionally, the City and Applicant must execute an encroachment license to permit the Applicant to maintain the golf netting fence on the Golf Course property. ENVIRONMENTAL IMPACT: Not applicable FISCAL IMPACT: Not applicable. RECOMMENDATION: Staff recommends approval of the variance to allow the fence to be located on a portion of Golf Course property at the base on an existing berm, and then enter the property through the cluster of trees in the south-western portion o f the property. Staff also recommends approval of the encroachment of the fence onto city property (the Golf Course) as indicated in Exhibit F. The Resolution has been written to allow this encroachment through a one-year encroachment license that automatically renews. but can be revoked by the City at any time. The Resolution has also been written to authorize the Community Development Director to approve an administrative PUD Amendment for the Golf Course to allow for this fence encroachment. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ASPEN AS FOLLOWS: Resolution No 36, Series 2009 Page 1 of 3 Section 1: Pursuant to the procedures and standards set forth in Title 26 of the Aspen Municipal Code, the City Council hereby approves a variance to permit a fourteen foot high fence made of golf netting be constructed on the property. The fence shall only be erected when the Aspen Municipal Gol f Course is running gol f operations. Section 2: Fence Location & Material The fence shall be located at the base of an existing berm that is located partially on the Golf Course property and on the Applicant's property until it reaches the existing wood fence, at which point the golf netting fence will enter the Applicant's property and be woven through the existing stand of trees, see Exhibit A to this Resolution. The fence poles shall be painted a dark color to better blend in with the existing vegetation. Section 3: Parks Department The Applicant is required to acquire an approved work under the drip line permit (tree removal permit) prior to installation of the fence. Any trimming o f tree branches must be kept to a minimum and all tree work should be accomplished by a professional tree care company. All work on trees must comply with city tree code #13.20. The Parks Department shall verify compliance with this requirement. Section 4: Golf Course Encroachment and License Agreement City Council hereby authorizes the City Manager to enter into a license agreement between the Applicant (and any future owners of 1495 Homestake) and the City of Aspen that would permit a portion of the fence to encroach onto a portion of Golf Course property, as illustrated in Exhibit A to this Resolution. The encroachment license shall be automatically renewed on a yearly basis, but may be reviewed for compliance by City Council and/or City Staff at the year intervals. The City may revoke the encroachment license at any time if the terms are violated. Section 5: Golf Course PUD City Council hereby directs the Community Development Department to approve an Administrative PUD Amendment for the Golf Course PUD to allow the golf netting fence to be construction on a portion of Golf Course (city) property. Section 6: All material representations and commitments made by the Applicant pursuant to the development proposal approvals as herein awarded, whether in public hearing or documentation presented before City Council, are hereby incorporated in such plan development approvals and the same shall be complied with as if fully set forth herein, unless amended by an authorized entity. Section 7: This resolution shall not affect any existing litigation and shall not operate as an abatement of any action or proceeding now pending under or by virtue of the resolutions or ordinances Resolution No 36, Series 2009 Page 2 of 3 repealed or amended as herein provided, and the same shall be conducted and concluded under such prior resolutions or ordinances. Here is what I have: This particular easement on the City Golf Course will allow for additional safety. The fact that this agreement is revocable each year reduces the setting of precedence for this type of issue, to a degree. 1 Exhibit A See. 26.314.040. Standards applicable to variances. A. In order to authorize a variance from the dimensional requirements of Title 26, the appropriate decision-making body shall make a finding that the following three (3) circumstances exist: 1, The grant of variance will be generally consistent with the purposes, goals, objectives and policies of the Aspen Area Community Plan and this Title; Staff Finding: Staff finds that the proposed variance is generally consistent with the Aspen Area Community Plan (AACP) and the Land Use Code. The AACP is an aspirtational document that does not address specific circumstances such as fence height variations. The AACP states that it is "broad in scope and does not address every issue or parcel ipdividually. The plan should be interpreted to apply generally to all properties and issues in Aspen..." The Design Quality section of the AACP discusses the importance of context when making decisions about form, mass, color, materials, etc. This proposal is generally consistent with the plan in general, and with this idea of paying attention to context in design situations. The properly is located adjacent to the golf course, and is uniquely situated to be impacted by errant golf balls. The proposed gol f netting makes sense in this context, much more than a fourteen foot high fence made of wood or stone. The proposal is also generally consistent with the Land Use Code. The proposal does not trigger a Residential Design Review or any other land use review. The proposed fence is temporary in that it would only be erected during the golf season. The applicant is requesting a fence material that is relatively transparent, and is flexible so it can be inter-woven between existing vegetation. Staff believes that individuals have a reasonable expectation to be safe when on their property. The current condition of the property does not protect the parcel, building, or people that might be on the property at any given time from errant gol f balls. Staff finds that the proposed fence will create a safer environment on the parcel by preventing errant golf balls from impacting the property and any people on the property. Section 6.1 (b) states that " ...without the prior written consent of all Owners, no Owner shall:(d) modify or remove any of the fences on the property. The addition of this netting fence is a modification. Notwithstanding the above, it is my belief that the addition of this netting is a safety issue, and should Ug approved by the City of Aspen, however, NOT as designated in the attached plan above that is entitled "Homestake netting plan NOT approved' Allowing this fence to be built alongside the 1495 side fence, could also decrease the liability of the Golf Course in the event of a debilitating accident, if the City of Aspen has attempted to mitigate the dangers, by allowing this netting fence to be constructed. The safety issue can be addressed just as effectively if the netting fence is wrapped around the outside of the property, along the 1495 side fence, and not through the trees. It can even be wrapped around the outside of the tree, if necessary, or, as we discussed, if that tree extends over the Golf course, it can be reduced in height at that section, or the tree could be trimmed as gently as possible, to allow for it. If directed through the trees, it will be an unsightly addition to an otherwise idyllic view from the property,(a large part of my reason for purchasing it) actually not only for me, but also for the owner of Lot 2 (Mr. Pines), while not creating any additional effectiveness that could not be achieved as above stated. It would therefore decrease the value of both properties, as it would visually create concerns 1 .brolult 1,3 about the Golf Course dangers every time we look out of our windows onto the Golf Course or back yards. In regards to the City hearing, I am therefore hereby voicing my opposition to the 2nd plan above that goes through the trees, and indicating my approval of the 1st plan above, that goes along the 1495 side fence. As the only other member of the Homestake Condominiums, I am hereby declaring my refusal of consent to construct the netting fence through the trees, but will give my consent to its construction along the 1495 Side of the property. I would be grateful if Ms. Garrow could acknowledge the receipt of this letter and confirm it's inclusion in the hearing package for June 8th, 2009. The applicant is requesting a height variance to construct a 14' fence made of golf netting to be up during the golf season, May to October. The applicant requests the fence be placed along the western property line; staff met with the applicant on site and recommends the fence run along the western property line and turn into the applicant' s property. Ms. Garrow illustrated staffs proposed alternative for the fence. Ms. Garrow said there is an existing 42" high split rail fence and the golf netting would weave through the trees and not encroach into city property on the golf course. This alternative is preferred because it does not encroach on city property and it will protect a large stand of trees at the back ofthe property. Ms. Garrow said weaving the fence through the trees willlower the visibility of the fence. Ms. Garrow outlined the 3 standards to meet in order to grant a variance. Ms. Garrow noted Council can consider whether there are circumstances that are unique to that parcel and that do not result from actions by the applicant. Staff finds that all 3 conditions arc met and recommends approval of the variance. There are few, if any, lots in the city that would be affected this way. Ms. Garrow said a 14' high, removable fence, is the minimum variance that would allow reasonable use ofthis parcel. Councilman Skadron asked i f staff received comments from neighbors. Ms. Garrow noted there is one letter in the packet from the owner of the other half of the duplex, who would prefer the fence run along the propert~ line. Ryan Pardue, representing the applicant, noted this house sticks into the 2'1 fairway and people have driven balls into this house. Pardue said there is a safety risk. Pardue presented an alternative location for the fence which would include an encroachment onto the golf course and would work with city staffon precise placement of the fence. Pardue said this location will keep balls in play, prevent the loss of golf balls, and reduce trespassing on the applicant's property. Mayor Ireland asked if there is a limitation on the city's ability to put a net on the golf course. John Worcester, city attorney, said netting on the gol f course is not an abnormal function of the golf course. Mayor Ireland said he would like staff to make sure the netting is bird friendly. Councilman Torre asked about liability to the city. Pardue said the applicants would be willing to sign a license. Ms. Garrow said the reason staff recommended the placement of the fence is to protect the trees. Councilman Johnson said there is a perceived narrowing here and with improved technology, people are hitting balls farther. Councilman Johnson asked if winding the fence through the trees will cause a problem with the trees. Brian Flynn, parks department, told Council staff wants to keep the liability offthe city property and supports the fence on the applicant's property. Mayor Ireland said if the majority of Council is okay with the fence on city property, Council could direct staff to create an encroachment and bring it back to the next Council. Councilman Torre stated he supports staff recommendation to have the fence on the applicant's property; it is not up to the city to protect this property. Councilman Skadron said he, too, would support 10 Regular Meeting Aspen Citv Council June 8,2009 staff's recommendation. Councilman Johnson said he supports putting a net somewhere. Councilman Romero said he would be comfortable with an encroachment agreement and having the net on city property. Council requested staff prepare an encroachment agreement for the next packet. REQUEST OF THE CITY COUNCIL: The Applicant, Philip Pine, is requesting Council approval of a dimensional variance to erect a fourteen (14) foot fence made of golf netting. The applicant is making this request to address property damage and safety issues related to golf balls landing on the property from the Aspen Municipal Golf Course. REQUIRED REVIEWS: Dimensional variances for height are reviewed by City Council. Tile Applicant requests the following reviews: 1 • Dimensional Variance from the height requirements to erect a fourteen (14) foot high fence pursuant to Land Use Code Chapter 26.314, Variances (City Council is the final review authority) Other applicable code sections include: • Fences, section 26.575.050 of the Land Use Code. This section states, "Fences shall be permitted in every zone district provided that no fence shall exceed six (6) feet above natural grade or as otherwise regulated by the Residential Design Standards..." BACKGROUND: The property is located adjacent to the Aspen Municipal Golf Course's second hole fairway. The Applicant has provided pictures illustrating the damage caused to the property from golf balls being hit from the second hole. The Applicant would like to install a seasonal fence made of golf netting to protect the home from the golf balls. PROJECT SUMMARY: The Applicant requests a dimensional variance to permit a seasonal fence made of golf netting to be constructed along the western property line. The fence is proposed to be fourteen (14) feet high and run approximately eighty (80) feet along the one- hundred and twenty (120) foot long western property line. The proposed fence would not go forward ofthe garage, which is the front-most fa~ade of the house.' The fence is proposed to be made of similar material as the existing golf netting near the driving range on the golf course, and will be seasonal in nature. The applicant would install holes in the ground that the fence posts and the netting would be connected to during golf season (approximately May through October) - both the posts and netting would be removed when the golf course is not in operation for golfing activities. yhe Applicant requests that the proposed fence be located along the western property line. Staff from the Community Development, Parks, and Golf departments conducted a site visit to determine how the proposed fence placement would impact the golf course. Staff comments can be found in Exhibit B. Due to a significant stand of mature trees located in the south-western portion of the site, placing the golf-netting fence along the property line would create an encroachment into the golf course (City) property. Staff does not recommend the fence be permitted to encroach on the City property, and does not recommend approval of the application if the fence would encroach on City property. The Application (Exhibit D) includes a site plan illustrating the location o f the fence in this alternative. Staff discussed an option of running the proposed fence along the property-line until it reaches the stand of trees, and then turning the fence into the property and weaving it through the property. Exhibit C includes a staff illustration of the approximate location of the fence in this scenario. Because the fence is flexible, staff believes it can be weaved through the tree stand without damaging the trees. Staff also believes this solution will better conceal the proposed fence from view, as the trees are taller than fourteen (14) feet and will provide visual relief. This is staffs pre ferred alternative, which staff recommends approval of. ~ Pursuant to Land Use Code section 26.410.040.A.3, Residential Design Standards, Site Design - Fences. fences forward of the front fa~ade of a residential building cannot exceed 42 inches in height. Because the proposed fence does not go forward of the front faqade of the building, the Residential Design Standards are not triggered. 2 STAFF COMMENTS: Staff comments and findings related to the Variance review criteria are included below. Detailed staff findings are found in Exhibit A. VARIANCE: Variances from the Land Use Code are deviations that "would not be contrary to the public interest when, owing to special circumstances or conditions, the literal enforcement of the .. provisions of this Title would result in undue and unnecessary hardships. Staff finds that this lot is uniquely situated to warrant a dimensional variance for fence requirements. The parcel is located adjacent to the second hole on the Aspen Municipal Golf Course, and is located in such a way that drives from the tee box enter the property. While there are other parcels adjacent to the golf course, there are no other properties that are in "line-drive" territory when golfers tee off. This is a unique situation that encumbers this lot and no others. Staff finds that because of this parcel's location in relation to the golf course, that it is uniquely situated to be impacted by errant golf balls. The proposed golf netting makes sense in this context. RECOMMENDATION: Staff recommends approval of the variance to allow the fence to be located along the property line. and then enter the property through the cluster of trees in the south-western portion of the property. Section 2: Fence Location & Material The fence shall be located on the Applicant's property along the western property line of the property until it reaches the existing wood fence, at which point the golf netting fence will enter the property and be woven through the existing stand of trees. The fence is not permitted to encroach on the City's golf course property. Section 3: Parks Department The Applicant is required to acquire an approved work under the drip line permit (tree removal permit) prior to installation of the fence. Any trimming of tree branches must be kept to a minimum and all tree work should be accomplished by a professional tree care company. All work on trees must comply with city tree code #13.20. The Parks Department shall verify compliance with this requirement. Section 4: All material representations and commitments made by the Applicant pursuant to the development proposal approvals as herein awarded, whether in public hearing or documentation presented before City Council, are hereby incorporated in such plan development approvals and the same shall be complied with as if fully set forth herein, unless amended by an authorized entity. Section 15: This resolution shall not affect any existing litigation and shall not operate as an abatement of any action or proceeding now pending under or by virtue of the resolutions or ordinances repealed or amended as herein provided, and the same shall be conducted and concluded under such prior resolutions or ordinances. Section 16: If any section, subsection, sentence, clause, phrase, or portion of this resolution is for any reason held invalid or unconstitutional in a court of competent jurisdiction, such portion shall be deemed a separate, distinct and independent provision and shall not affect the validity of the remaining portions thereof. In order to authorize a variance from the dimensional requirements of Title 26. the appropriate decision-making body shall make a finding that the following three (3) circumstances exist: 1. The grant of variance will be generally consistent with the purposes, goals, objectives and policies of the Aspen Area Community Plan and this Title; Staff Finding: Staff finds that the proposed variance is generally consistent with the Aspen Area Community Plan (AACP) and the Land Use Code. The AACP is an aspirtational document that does not address specific circumstances such as fence height variations. The AACP states that it is "broad in scope and does not address every issue or parcel individually. The plan should be interpreted to apply generally to all properties and issues in Aspen..." The Design Quality section of the AACP discusses the importance o f context when making decisions about form, mass, color, materials, etc. This proposal is generally consistent with the plan in general, and with this idea of paying attention to context in design situations. The property is located adjacent to the golf course, and is uniquely situated to be impacted by errant gol f balls. The proposed gol f netting makes sense in this context, much more than a fourteen foot high fence made of wood or stone. The proposal is also generally consistent with the Land Use Code. The proposal does not trigger a Residential Design Review or any other land use review. Staff finds this criterion to be met. 2. The grant of variance is the minimum variance that will make possible the reasonable use of the parcel, building or structure; and Staff Finding: Staff finds that the request is the minimum variance that will allow reasonable use of the parcel. The proposed fence is temporary in that it would only be erected during the golf season. There are other golf netting fences that are available for purchase, but these are higher in height, and are not temporary. The applicant is requesting a fence material that is relatively transparent, and is flexible so it can be inter-woven between existing vegetation. Staff believes that individuals have a reasonable expectation to be safe when on their property. The current condition of the property does not protect the parcel, building, or people that might be on the property at any given time from errant golf balls. Staff finds that the proposed fence will create a safer environment on the parcel by preventing errant golf balls from impacting the property and any people on the property. Staff fins this criterion to be met. Exhibit A, Staff Findings Page 1 of 2 Exhibit A 3. Literal interpretation and enforcement of the terms and provisions of this Title would deprive the applicant of rights commonly enjoyed by other parcels in the same zone district and would cause the applicant unnecessary hardship, as distinguished from mere inconvenience. In determining whether an applicant's rights would be deprived, the Board shall consider whether either of the following conditions apply: a. There are special conditions and circumstances which are unique to the parcel, building or structure, which are not applicable to other parcels, structures or buildings in the same zone district and which do not result from the actions of the applicant: or Staff Finding: Staff finds that there are unique circumstances on this parcel that are not the result of any action by the applicant. This parcel has been adjacent to the golf course since the golf course was created. The parcel is located adjacent to the second hole on the Aspen Municipal Golf Course, and is located in such a way that drives from the tee box enter the property. While there are other parcels adjacent to the golf course, there are no other properties that are in 'line-drive" territory when golfers tee off. This is a unique situation that encumbers this lot and no others. Staff finds this criterion to be met. b. Granting the variance will not confer upon the applicant any special privilege denied by the Aspen Area Community Plan and the terms of this Title to other parcels, buildings or structures, in the same zone district. Staff Finding: Staff finds that because of the unique circumstances o f this lot, the proposal will not confer any special privileges on this lot that are denied by the Aspen Area Community Plan or the Land Use Code. The AACP does not address this kind of situation specifically. Staff believes this situation is unique and warrants a variation in the height requirements imposed by the land use code. Section 6.1 (b) states that "..,without the prior written consent of all Owners, no Owner shall:(d) modify or remove any of the fences on the property. The addition of this netting fence is a modification. Notwithstanding the above, it is my belief that the addition of this netting is a safety issue, and should Ug approved by the City of Aspen, however, NOT as designated in the attached plan above that is entitled "Homestake netting plan NOT approved". Allowing this fence to be built alongside the 1495 side fence, could also decrease the liability of the Golf Course in the event of a debilitating accident, if the City of Aspen has attempted to mitigate the dangers, by allowing this netting fence to be constructed. The safety issue can be addressed just as effectively if the netting fence is wrapped around the outside of the property, along the 1495 side fence, and not through the trees. It can even be wrapped around the outside of the tree, if necessary, or, as we discussed, if that tree extends over the Golf course, it can be reduced in height at that section, or the tree could be trimmed as gently as possible, to allow for it. If directed through the trees, it will be an unsightly addition to an otherwise idyllic view from the property,(a large part of my reason for purchasing it) actually not only for me, but also for the owner of Lot 2 (Mr. Pines), while not creating any additional effectiveness that could not be achieved as above stated. It would therefore decrease the value of both properties, as it would visually create concerns 1 Talhiloit tb about the Golf Course dangers every time we look out of our windows onto the Golf Course or back yards. In regards to the City hearing, I am therefore hereby voicing my opposition to the 2nd plan above that goes through the trees, and indicating my approval of the 1st plan above, that goes along the 1495 side fence. As the only other member of the Homestake Condominiums, I am hereby declaring my refusal of consent to construct the netting fence through the trees, but will give my consent to its construction along the 1495 Side of the property. I would be grateful if Ms. Garrow could acknowledge the receipt of this letter and confirm it's inclusion in the hearing package for June 8th, 2009. It is possible that I will send a representative to the hearing as I am unable to make a trip to Aspen myself for June 8th. Community Development Department staff has suggested that Dr. Pine request a variance from Section 26.575.050 of the City of Aspen I.and Use Code ("Code") in order to install a short span of protective golf safety netting. This Code section states that "no fence shall exceed six (6) feet about natural grade." Dr. Pine proposes a seasonal, fourteen (14) foot tall golf safety net (interpreted by staff to be a "fence" under the I.and Use Code) that would protect his property, family, occupants, dog and their home from golf balls driven on to his property during the golfing season. The Pre-Application Conference Summary (attached as Exhibit "A") identifies and implicates the City of Aspen Land Use Code Section 26.314 (Variances) as an avenue for solution. The application of this Code section, and the review standards thereunder, are discussed in Section 2 below. 1. Background 1495 Homestake Drive, Aspen, Colorado is located adjacent to the second fairway of the Aspen Municipal Golf Course ("AMGC"). During the golfing season, approximately eight (8) to ten (10) golf balls are driven onto the property each day. These projectiles present a constant hazard to the Pine Home, to the health and safety of the homeowners, occupants, guests, and particularly to Dr. Pine's small children and their dog. Aerial photographs o f the property and AMGC are Exhibit "B." 1 he golf safety net is not a barrier to stop these trespasses. It will allow golf balls to remain in play. Dr. Pine seeks to install a seasonal, golf safety net spanning eighty (80) feet in length by fourteen (14) feet in height, along the southwest corner of the property. Photographs of the southwest corner are Exhibit "C." The golf safety net will address the safety hazards and ongoing property damage caused by golf balls. See Exhibit "D" containing photographs of the Pine Home's broken windows as well as hard wood and chimney damage. The net is made of black nylon, is basically invisible and, in this case, will be obscured in trees and other vegetation on the Pine lot (a sample of the netting is included with this application). The proposed golf safety netting will be draped from fourteen (14) foot tall by two (2) inch wide steel poles. Photographs of the netting and poles, from the manufacturer, are Exhibit "E." As done in other municipalities, the steel poles will be painted green to blend in with surrounding vegetation and trees. A condition of the variance will be to remove the golf safety net and poles during AMGC's seasonal closing. AMGC Manager, Steven Aiken, has no objection to placement of the net on the Pine property. The previous owners of the Pine Ilome installed an elevated berm in the yard and draped protective netting over the Home's lower windows. See Exhibit "F." Additionally, Dr. Pine has spent over $10.000 planting trees. These measures have not eliminated the ongoing risk and damage caused by the golf balls. Dr. Pine purchased his home, in March of 2007, so that his family could ultimately live in Aspen full-time. His goal is to have his children attend Aspen schools. Until then, Dr. Pine had sought to rent the Pine Ilome. One family of renters broke their long-term lease, citing safely concerns for their own children, trespass by golfers, and broken windows and windshields. This incident cost Dr. Pine over $60,000 in lost rental income and brokers' fees. Continued advances in golf club and golf ball technology allow all golfers to hit golf balls harder, higher and farther. The Pine Home is increasingly vulnerable. The AMGC's layout. which the City wants to change, actually places the Pine Home directly in line with the second fairway's driving tees. The sport's technology has increased the risks. At a December 2008 meeting to address the issue, Mr. Aiken suggested a realignment and reconfiguration of the second fairway. This realignment has been under consideration for several years. The driving range netting is thirty (30) feet high. It is over twice the height of the Applicant's proposed golf safety net. Presumably the City's netting is not considered a "fence." Dr. Pine' s proposal is a common sense approach to this safety and property issue. lhe netting will reduce AMGC's liability and improve play. It will benefit the public and also protect Dr. Pine's family and home. 2. Compliance with Land Use Review Standards The folIowing section of this application considers the relevant review standards set forth in the Code. Code Section 26.314.010 (Variances: Purpose) Variances are deviations from the terms of this Title which would not be contrary to the public interest when, owing to special circumstances or conditions, the literal enfurcement Of the provisions of this Title would result in undue and unnecessary hardship. Variances shall only be granted in accordance with the terms o.fthis Chapter. I)r. Pine treats the golf safety netting as a 'fence" for purposes at this application as suggested by Community Development Department staff in meetings and in their Pre- Application Conference Summary. I Ie requests a fence height variance to address the safety issues and physical damage to his home. These safety issues are unique to the Pine Home because of its particular positioning along the second fairway of the AMGC and because o f the increased ability of gol fers to drive golf balls into the Pine Home. A fence, as defined by the Code, is "a constructed barrier. including berms, intended to prevent escape or intrusion or to mark a boundary or shield or screen view or to perform any similar function." While the netting may fall under this catchall definition in the Code, it is instructive and may be helpful for this review that another jurisdiction has specifically exempted golf safety nets from its land use code definition of "fence." In 2008, the City of Thornton, Colorado passed an ordinance amending Chapter 18 of their City Code to allow for the installation of golf safety nets, in all zone districts, in side and rear yards on properties adjacent to and across the street from golf courses and golf driving ranges. Thornton redefined the term "fence" to specifically exclude golf safety nets. Thornton then amended their Code by adding golf safety nets to its Specific Accessory Uses section (the fhornton Code sections are Exhibit "G"). The Thornton regulations for golf safety nets include: a maximum height limitation of sixty feet, a building permit requirement, certain construction requirements, visual obstruction 372819-9 ® Printed on recycled paper GARFIELD & HECHT, RC. The intent of the Thornton ordinance is to protect the properties adjacent to golf courses and driving ranges from golf ball damage allowing the reasonable enjoyment of property by owners and promoting public health, safety, and welfare. Dr. Pine's proposed golf safety net is not contrary to the public interest. The golf safely netting will allow the Pines to safely use and enjoy their home. The impacts of the golf safety netting are minimal as the net is made of black nylon, is basically invisible. and the poles will be painted to match surrounding vegetation. If the City deems the golf safety netting to be a "fence" and then denies the variance, then enforcement of the Code's standard fence provision would lead to continued undue and unnecessary hardship to the Applicant. Code Section 26.314.030 (Authorized variances) Variances may only be granted.from the.following requirements of this Title 26: (A) Dimensional requirements. To the extent that the golf safety netting is considered a fence, Dr. Pine requests a height variance from the dimensional requirements imposed by Section 26.575.050 of the Code which states that "no fence shall exceed six (6) feet about natural grade." The Code's dimensional requirements are understandable, especially for standard types of fences. The golf safety netting, however. does not consist of traditional fence materials and, as demonstrated by the City of Thornton, is a device that does not fall squarely under the Code definition for "fence"or other Code sections. The City of Thornton's ordinance, as discussed above, allows for netting "not... more than 60 feet above grade when located in the rear or side yard." AMGC's driving range nets are thirty (30) feet high. Dr. Pine's proposed golf safety netting will be fourteen (14) feet in height. The City of Seattle's Department of Planning and Development Director, in 2004. recommended City Council approval of a netting system ranging in height from sixty (60) feet to one hundred fifteen (115) feet surrounding their local golf course. In making the recommendation, the Director stated, "The proposed reconfiguration...is expected (to) reduce the number of golf balls exiting the site. Golf balls have shattered vehicle windshields and have come dangerously close to hitting pedestrians." Dr. Pine's renters also cited broken windshields as a reason to breach their two-year lease. Tile Seattle example demonstrates the fact that other jurisdictions have tackled similar safety issues and have done so with golf safety netting. Dr. Pine's proposed golf safety net, though much lower, will solve similar safety concerns. Code Section 26.314.040 (Standards applicable to variances) (A) In order to authorize a variance from the dimensional requirements of Title 26, the appropriate decision-making body shelli make a finding that the following three (3) circumstances exist: (1) The grant of variance will be generally consistent with the purpose, goals, objectives and policies of the Aspen Area Community Plan and this Title. City Council can make this finding. Dr. Pine submits this application at the suggestion and guidance of Community Development Department staff and in accordance with the relevant Code sections identified in their Pre-Application Conference Summary. The proposed golf safety netting is consistent with the Aspen Area Community Plan and the Code because it advances goals expressed in these documents. One of the primary goals expressed in the 2000 Aspen Area Community Plan is to preserve the well-being of the Aspen community and its citizens. A draft of the Executive Summary to the Community Vision for the Aspen Area states a desire to ensure that, through planning, "people feel safe within our community." Because of the present threat of golf balls exiting AMGC and entering the Pine's property, Dr. Pine, his family and occupants of their home are not safe and certainly do not feel safe. Dr. Pine's proposed golf safety netting will reduce these threats, ensure the safe use and occupancy of the Pine Home, and reduce AMGC liability and improve AMGC play. These positive outcomes are entirely consistent with the Code and Community Plan' s goals of ensuring the well-being and safety of Aspen citizens. (2) The grant of variance is the minimum variance that will make possible the reasonable use of the parcel, building or structure. City Council can make this finding. This small span of golf safety netting is the minimum variance from the Code's fence height standard that will make possible the reasonable use of the Pine Home and achieve the purposes of the golf safely netting. The golf safety netting will not be contrary to the public interest and will only impact the Pine Home insofar as it adds the needed protection. The seasonal golf safety netting will not be visible from any public right of ways and will largely be hidden in trees. Dr. Pine has chosen the lowest golf safety net. There are higher models available that have not been chosen for this application. Other protective measures have not eliminated the ongoing risk and damage caused by golf balls. The variance request for seasonal golf safety netting is a minor change to the property and will not impact other homeowners with near or direct views. lhis simple, seasonal solution requires a variance to fence height under this application as interpreted by Community Development Department staff. The net will be removed from approximately late October through early April. Similar commercial-grade safety nets are installed around AMGC's driving range. Dr. Pine's proposal is sixteen (16) feet lower in height and will be obscured in vegetation. (3) Literal interpretation and enforcement Of the terms and provisions of this Title would deprive the applicant of rights commonly enjoyed by other parcels in the same zone district and would cause the applicant unnecessary hardship, as distinguished from mere inconvenience. In determining whether an applicant's rights would be deprived, the Board shall consider whether either of the following conditions apply: (a) There are special conditions and circumstances which cire unique to the parcel, building or structure, which are not applicable to other parcels, structures or buildings in the same zone district and which do not result from the actions ofthe applicant: or (b) Granting the variance will not confer upon the applicant any special privilege denied by the Aspen Area Community Plan and the terms of this Title to other parcels, buildings or structures, in the same zone district. City Council can make these findings. The City has acknowledged, in previous meetings, that the Pine LIome and second fairway suffer unique problems. In fact, AMGC has sought to redesign this hole. The Pine Home's positioning on the golf course, directly in line with the second fairway's tee boxes, makes the home and its occupants particularly vulnerable to the threat from golf balls and improving golf technology. Aerial photographs (see Exhibit "B") of AMGC and the Pine Home clearly demonstrate the Pine Ilome's unique positioning to the second fairway's tee boxes and sand traps. The threat and danger to the Pine Home will only increase as golfing technology advances and golfers hit golf balls harder, higher and longer. Conclusion Dr. Pine requests a variance to the Code's fence height standard to install a seasonal golf safety net. The proposal is a common sense approach to address issues of safety, threats to health and life, and reoccurring property damage. Dr. Pine has exhausted his other options. He submits this variance request at the Community Development Department staffs' suggestion. The Applicant meets the requirements of the Code for the reasons set forth here. (Supplement No. 68) Sec. 18-3. Definitions. Fence means any structure that is comprised of posts, boards, wire, stakes, rails or any combination of similar elements that provides a physical barrier, enclosure, or boundary, except this definition does not include golf safety nets as defined in Section 18-356(14) Sec. 18-356. Specific accessory uses. The following accessory uses are subject to the general provisions in Section 18-355 and the regulations and restrictions outlined as follows: (14) Golf safety net. a. Definition. A barrier consisting of support posts and netting panels erected adjacent to a golf course or golf driving range for the purpose of preventing golf balls from entering property adjacent to the golf course. b. Distnbts permitted By SUP only in all zoning districts including all existing and future PD districts. c. Required off-street parking. None. d. Required off-street loading. None. e. Additional provisions. 1. Golf safety nets may be permitted only on lots whose side or rear yard abut a golf course or golf driving range or are across the street from a golf course or golf driving range. 2. Golf safety nets may be erected on property adjacent to or across the street from the golf course or golf driving range. The restriction in Subsection 18-355(b) requiring an accessory use to be located on the same lot as the main use does not apply to this use. 3. A person shall not erect or maintain a golf safety net more than 60 feet above grade when located in the rear or side yard. Golf safety nets are prohibited in the front yard. 4. In the event a Development Permit and Specific Use Permit is approved with golf safety net standards different from the standards in this subsection, the standards established in the Development Permit and Specific Use Permit review process shall control. 5. Golf safety nets may not be located within a floodplain easement without consideration of flooding conditions and as approved by the Floodplain Administrator. 6. The location of a golf safety net shall comply with all visual obstruction regulations contained in Subsection 18-456(c). 7. Flags, signs, banners and other appurtenances are prohibited from being attached to the support structure or netting. 8. Golf safety nets shall be constructed in accordance with the following minimum standards: All golf safety nets require a building permit. EXHIBIT 1 E-1 i. Support posts and netting shall be consistent in all detail, including height, color and style, with existing golf safety nets surrounding an adjacent golf course or driving range, if any. ii. All golf safety nets shall be constructed in accordance with the manufacturer's recommendations. iii. Support posts shall be constructed of rust-resistant metal approved by a structural engineer and shall meet all requirements of the City's Building Code and all other applicable codes. iv. Netting material shall be black in color and of a quality designed for the purpose of obstructing golf balls. Netting shall also be designed to withstand the area's climate conditions and shall meet all requirements of the City's Building Code and all other applicable codes. v. Support structures should be fitted with a device, such as a halyard, that allows the net panel(s) to be removed for repair or storage. 9. Golf safety nets shall be maintained and repaired by the property owner in accordance with the following minimum standards: i. Any missing or broken support post that was a component of the original design of the golf safety net shall be repaired or replaced with similar material. ii. Torn netting which not longer serves the intended purpose shall be repaired or replaced with similar material.
