(million gallons) clear well (reservoir). The configuration of the proposed solar array would be rectangular. as displayed in Exhibit E. This configuration includes an area of approximately 190 feet by 108 feet (20.520 square feet) which is consistent with the shape o f the existing cover on the clear well. I he proposed height would be twelve feet on top of the cover of the clear well which is approximately two feet five inches above existing grade for a total of 14.5 feet above grade. History: Ordinance No. 7. series of 1980 created the SPA designation for the Water Plant Site. Ordinance No. 18, Series of 1983 rezoned the underlying zone district of the Castle Creek Water l'reatment Plant from R-15/SPA to Public (PUB)/SPA. Ordinance No. 18 (Exhibit -A") included a plan which approved upgrading utilities, new structures (clarifier and treatment plant), a storage building. a parking area and other improvements to Site. Subsequently. through Ordinance No. 23. Series of 1996 the City granted final SPA approval. Subdivision, Conditional lise Approval and dimensional requirements for affordable housing in the PUB Zone district, and Special Review for Parking for the City of Aspen Water rireatment Plant and Affordable housing project situated on Lot 2 and 4 of the Thomas Property. STAFF EVALUATION: Per the Application, the request is to add 190'x 108' (20.520 square feet) of solar array to the cover on an existing reservoir structure. The total height ( 14.5') of the reservoir and the proposed solar structure on top would be within maximum height limitations (253 of the SPA. The location of the reservoir does not encroach upon the required 100 foot development setback. The Applicants proposed solar array is consistent with current and historic uses of the property. I he proposed structure is acceptable given the purpose and permitted uses of the underlying zone district (see Exhibit Dj. Additionally, the proposed solar array meets the requirements for an insubstantial amendment to an SPA (see 1.xhibit C, Review Criteria). DECISION: The Community' Development Director finds the administrative application for an Insubstantial SPA Amendment to the Water Plant SPA as noted above to be consistent with the review criteria . :hibit C). ORDINANCE NO. ~~ (Series of 1983> AN ORDINANCE AMENDING SECTION 24-2.2 OF THE MUNICIPAL CODE (ZONING DISTRICT MAP) BY REZONING THE CASTLE CREEK WATER TREATMENT PLANT PARCEL FROM R-15/SPA TO PUB-PUBLIC AND ACCEPTING A PLAN SETTING THE AREA AND BULK REQUIREMENT FOR THE PARCEL WHEREAS, the City of Aspen is the owner of record of a parcel of land used for its water treatment facility more specifically described as Lot 4, City Thomas Property Subdivision Exception, City of Aspen, Pitkin County, Colorado; and WHEREAS, the Aspen Planning and Zoning Commission did hold a public hearing on March 22, 1983, to consider the rezoning of said property and did recommend that it be rezoned from R-15/SPA to Pub-Public; and WHEREAS, as required by Section 24-3.4 of the Municipal Code, the Planning Commission did further recommend the adoption of a precise plan as the area and bulk requirements for the site, more specifically described in Exhibit "A", attached hereto and incor- porated by reference; and WHEREAS, proposed additions to the plant are for utility upgrading purposes and consist of two new structures ( clarifier and treatment plant), additional filter beds, construction of a 24" pipeline by the Meadowood Pump Station, and a construction road; and WHEREAS, upgrading is necessary to permit the full renovation of the existing water treatment plant, to provide system redun- dancy, backup capability and the ability to meet further need for water treatment; and WHEREAS, this upgrading and addition to the plant is consis- tent with the scheduled implementation of the Comprehensive Water Management Plan of 1980, as amended; and RECORD OF PROCEEDINGS 100 Leaves - 5, C. I ' CO WHEREAS, the rezoning has been evaluated according to the criteria of Section 24-12.7(d)(1) through (6) of the Municipal Code and found to be in substantial compliance therewith; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ASPEN, COLORADO: Section 1 That Section 24-2.2 (Zoning District Map) be and hereby is amended to change the zoning of the City's Castle Creek Water Treatment Plant parcel, more specifically described as Lot 4, City Thomas Property Subdivision Exception, City of Aspen, Pitkin County, Colorado, from R-15/SPA to Pub-Public. Section 2 That the precise plan submitted for this site, more specifi- cally described in Exhibit "A", be and hereby is adopted as the area and bulk requirements for this site. Section 3 That the City Engineer be and he hereby is directed to amend the Zoning District Map to reflect the change in zoning of the Castle Creek Water Treatment Plant parcel from R-15/SPA to Pub- Public. He is further directed to record the plat of the expan- sion plan as the precise development plan for the parcel. Section 4 If any section, subsection, sentence, clause, phrase or portion of this ordinance is for any reason held invalid or unconstitutional by any court of competent jurisdiction, such portion shall be deemed a separate, distinct and independent provision and such holding shall not affect the validity of the remaining portions thereof. An insubstantial amendment to an approved development order for a linal development plan may be authorized by the Community Development Director. The Water Plant SPA was created in 1984, and has undergone several development projects since, such as the Water Plant Affordable Housing and expansions to the office and work areas near the water plant. Upon receiving an electrical permit through the Building Department, Planning Staff became aware of the proposed PV equipment. This permit, 0237.2010.AELE, was intended to complete PV installation work that had begun in 2008 (0193.2008.AELE). After reviewing the permit, and the previously completed work, it was Staffs determination that the project should have received a review by Com Dev for an SPA amendment. Before zoning can approve the current electrical permit, Staff is requiring a land use application be filed to satisfy the SPA amendment. This review will be handled administratively. The purpose of this is to ensure the correct land use process is handled before work is completed, and also establish parameters around future work regarding the PV area.
