The accessory dwelling unit was described as being a 580 s.f. studio apartment in the basement in the proposed residence. Redesign of the house has caused the unit to be reduced to approximately 330 s.f. Staff recommends approval of this change in the original approval without conditions. STAFF COMMENTS: Section 7-308 A. 1-5 allows the Planning Director to approve amendments to an approved development plan for a Conditional Use if it meets the following five criteria: 1) The change will not cause negative impacts on pedestrian and vehicular traffic circulation, parking or noise; and 2) The change will not substantially affect tourist or local orientation of the conditional use; and 3) The change will not affect the character of the neighborhood in which the conditional use is located; and 4) The change will not increase the use's employee base or retail square footage in the structure; and 5) The change will not substantially alter the external visual appearance of the building or its site. Only criteria 1,2,and 5 are pertinent to this request. As the approved unit is being reduced in size, staff believes these standards are being met. The unit still falls within the allowable net livable floor area requirements of the Housing Authority for accessory dwelling units. As the unit is completely below grade, no visual impacts or changes will occur with the size reduction. The Building Department will require compliance with emergency egress requirements. The three conditions attached to the original approval will remain in effect. RECOMMENDATION: Staff recommends that the Planning Director approve the insubstantial amendment to the Newman Conditional Use. SMUGGLER (LOT 1, VANDEMOER LOT SPLIT) Resolution No. 90-� WHEREAS, Joel Newman submitted to the Aspen Planning Office an application for a Conditional Use for an 580 square foot Accessory Dwelling Unit in his residence at 926 W. Smuggler St.; and WHEREAS, an Accessory Dwelling Unit is required for any development resulting from a Lot Split action; and WHEREAS, the subject parcel was created by the Vandemoer Lot Split approval in 1986; and WHEREAS, the Planning Office reviewed the application with referral comments from Engineering and recommended approval with conditions to the Planning and Zoning Commission; and WHEREAS, at their regular meeting on April 3, 1990 the Planning and Zoning Commission approved the Conditional Use with conditions, adding a third condition that the Accessory Dwelling Unit be deed restricted with the Housing Authority for resident r occupancy with 6 month minimum leases. NOW, THEREFORE BE IT RESOLVED by the Commission that a Conditional Use is approved for a 580 square foot accessory dwelling unit to be included within the basement of the residence at 926 W. Smuggler with the following conditions: 1. A plat needs to be filed with the Pitkin County Clerk and Recorder meeting Code requirements before the issuance of a Certificate of Occupancy. 2. The fence encroaching into the alley right-of-way needs to be brought into compliance or licensed by the City Council. 3. Prior to issuance of any building permits for the parcel, the Accessory Dwelling Unit shall be deed restricted as a resident occupied unit with 6 month minimum leases. The deed restrictions shall be approved by the Housing Authority and filed with the Pitkin County Clerk and Recorder. Proof of recordation shall be forwarded to the Planning Office. Planning Staff recommends approval of this Conditional Use with conditions. APPLICANT: Joel Newman, represented by Tom Landless, Charles Cunniffe & Assoc. LOCATION: 926 W. Smuggler St., Lot 1 Vandemore Lot Split ZONING: R-6 APPLICANT'S REQUEST: Conditional Use approval for an accessory dwelling unit. PROPOSAL: The proposed residence is a 4 bedroom 3,286 sq.ft. home. The applicant wishes to include a basement level caretakers unit of approximately 580 sq. ft. REFERRAL COMMENTS: Engineering: Having reviewed the above application and made a site visit, the Engineering Department has the following comments: 1. According to a previous condition of approval from the Vandemore Lot Split in 1986, a plat needs to be filed with the Pitkin County Clerk and Recorder meeting Code requirements before the issuance of a Certificate of Occupancy. 2. The fence encroaching into the alley right-of-way needs to be brought into compliance or licensed by the City Council. (Attachment "A") STAFF COMMENTS: An accessory dwelling unit is a conditional use in the R-6 zoning district. The Commission has the authority to review and approve development applications for conditional uses pursuant to the standards of Section 7-304: • A. The conditional use is consistent with the purposes, goals, objectives and standards of the Aspen Area Comprehensive Plan, and with the intent of the Zone District in which it is proposed to be located. RESPONSE: This proposed unit will allow the property to house a caretaker in a residential area, which complies with the zoning and Aspen Comprehensive Plan. B. The conditional use is consistent and compatible with the character of the immediate vicinity of the parcel proposed for development and surrounding land uses, or enhances the mixture of complimentary uses and activities in the immediate vicinity of the parcel proposed for development. RESPONSE: This use is compatible with the other single and multi -family residential uses in the surrounding neighborhood. C. The location, size, design and operating characteristics of the proposed conditional use minimizes adverse effects, including visual impacts, impacts on pedestrian and vehicular circulation, parking, trash, service delivery, noise, vibrations and odor on surrounding properties. RESPONSE: The proposed accessory unit is completely contained within the existing structure. Additional parking spaces will not be needed because one bedroom or studio accessory units carry no parking requirement. The only impacts will be those normally associated with the construction of the house. D. There are adequate public facilities and services to serve the conditional use including but not limited to roads, potable water, sewer, solid waste, parks, police, fire protection, emergency medical services, hospital and medical services, drainage systems, and schools. RESPONSE: All public facilities are all ready in place for the existing neighborhoods. E. The applicant commits to supply affordable housing to meet the incremental need for increased employees generated by the conditional use. RESPONSE: As proposed F. The proposed conditional use complies with all additional standards imposed on it by the Aspen Area Comprehensive Plan and by all other applicable requirements of this chapter.
