HomeMy WebLinkAboutcoa.en.Morse 3rd & Main.1977 MEMO TO: MEMBERS OF CITY COUNCIL FROM: DAVE ELLIS CITY ENGINEER DATE: February 8, 1977 Re: Encroachment Request - Morss Property at Third and Main This request is for use of the Third Street right -of -way as private parking to reduce the non - conformity of an historic building which the applicant is remodeling. Several possibilities have been discussed by the applicant and engineering. The engineering department's concerns are to maintain a standard five foot sidewalk area, to restrict the use of continuous curb cuts and to use the alley as access. The last two items will maximize on- street parking and eliminate the hazards of backing onto Third Street so close to the intersection The applicant is submitting two alternatives and we support alternative 1. Alternative 1 provides three more spaces than the present situation, but would require a variance in the amount of required parking from 7 spaces to 4 spaces. This would seem justified since one more on- street space will be created than now exists resulting in an effective reduction of only two spaces. The property is also well situated in relation to the transit routes. cc: Russ Pielstick T Morss Main Street Block 44, Lots K $ hL Aspen, Colorado The purpose of this Council submittal is to obtain approval for parking to encroach on the public right -of -way along part of Third Street. After submitting an application to the Board of Zoning Adjustment, we were referred to the City Engineer who, in turn, has referred us to Council. The need for this approval is due to the zoning classification rendering this property non - conforming and thereby creating a hardship to the owner who is attempting to improve and renovate this historic structure within sound economic constraints. The City Council has to first approve the parking encroachment before the City Engineer can approve the curb cut. After Council makes a decision, the Board of Zoning Adjustment can act on the application to them to grant a variance on the number of parking spaces required. (See application to Board of Zoning Adjustment dated January 27, 1977.) The solution is for (see "Alternate #1 - Proposed Parking "): A. Council to grant approval for the parking encroachment. B. The City Engineer to recommend approval of the curb cut from Third Street. C. The Board of Zoning Adjustment to grant a variance reducing the required parking spaces to 5 for office use. (Please note the park- ing arrangement will not significantly interfere with the future sidewalk.)
