May 13, 1981 Mr. Roy Vroom Roy Vroom Realty 400 East Main Aspen, Colorado 81611 Dear Roy: Recently we have received several complaints concerning the disappearance of bus benches on the Mill Street side of your building. Continuing maintenance of these benches was a contingency of approval of your request to encroach on public right of way as granted by Council October 14, 1975. Would you please attempt to ascertain what has happened to these benches and inform us of your findings. Your cooperation is sincerely appreciated. It is understood that the provisions hereof shall apply to your construction of a wrought iron fence on the Mill Street right -of -way all as presented to the City Council at its regular meeting, and as shown on the site plan attached hereto and incorporated by this reference. The conditions of this grant of license to encroach are as follows: 1. That you agree that this license is given solely at the discretion of the Council, is revoc- able, and may be withdrawn for any reason at any time. You further agree that you will, on receiv- ing such request, remove the structure from the City right -of -way, and all costs of removal and /or demolition shall be assumed by you. 2. You agree that you will be responsible for any maintenance and repairs of the right -of -way encroachment necessary to keep the same, and the right -of -way, in a safe and clean condition as determined by the City of Aspen. 3. You agree to indemnify and hold the City harmless from any and all claims or liability by reason of death, injury or property damage suffered by any person as a result of the retention of your 1 Mr. Roy Vroom October 15, 1975 Page 2 `r improvements in the City right -of -way. In addition, if the City Council shall ever so require, you agree to obtain comprehensive public liability insurance covering property loss, bodily injury or death, in the amount at least equal to the comprehensive liability insurance maintained by the City at that time; and 4. The present location serves Mill St. and Main and is one of the heaviest used stops we have. Moving the location down one block to the Oden Property will jeopardise the transfer capability from the County's routes and from the pool and Snowbunny routes and reduce the efficiency and visibility of the system. 2. The bus stop was established prior to the construction of Roy Vroom's Building and therefore adequate protection of plants and fences should be supplied by the owner. 3. This complaint is in the same vain as the ones from the Logan Baylors in Basalt and the lodge owner at Cooper and Spring. Everybody wants transportation and bus stops but not in their block. 4. Roy Vroom's tenants have the habit of using the present bus stop as a loading zone. In the recent weeks I have insured that the police enforce parking regulations by calling them to the scene and blocking in offenders until they arrive. I am sure we are getting some reaction to this practice. 5. I would hypothesize that Roy or his tenants are complaining more about the crowds that gather near their exclusive shops giving them a discount house appearance rather than the destruction to metal fences and ever- green shrubs located 5 feet in from the metal fence. 6. In essence I would recommend not moving the bus stop and perhaps recommending a good fence specialist to consult with Mr. Vroom concerning the problem he perceives. The purpose for this fence would be as follows: 1. I an planning extensive landscaping along the entire front, or South side, and the entire West side of the building. The fence would be erected to both protect the landscaping, which would include shrubs, grass and trees, as well as to discourage people from lounging on that landscaped portion or the brick planters, which are a part of the building. 2. I feel that it would greatly enhance the appear- ance of the building, as well. However, the place where the fence would be installed along the Mill Street side of the building lies within the City right of way. This would constitute an encroachment, and therefore requires Council ap- proval. The fence along the Main Street side of the building will be located on private property and would not constitute an encroachment. I have enclosed a site plan showing the location of the building, the landscaped area and the location of the fence.
