HomeMy WebLinkAboutcoa.en.Wille sculpture 1975 CITY • i �' , � SPEN 130 so . -. ; street aspen, 81611 December 16, 1975 Mr. Lou Wille Tyrolean Lodge 200 West Main Street Aspen, Co. 81611 Re: Relocation of Conquistador Sculpture Dear Mr. Wille: I am advised that, pursuant to oral agreement between you and Mick Mahoney, your Conquistador Sculpture will be re- located on a pedestal located on the City owned Rio Grande property. At your request, I am outlining the elements of your agreement (as I understand them) as follows: 1. It is agreed that the sculpture will, at City expense, be moved and installed at the axis of the extensions of Galena and Bleeker Streets on the Rio Grande tract, and mounted on a pedestal pursuant to instructions and specifications itemized by you. 2. The sculpture will at all times remain your property (except as described in Paragraph 3) although available for public enjoyment for the benefit of City /County residents. 3. In the event the City or County shall, singly or jointly, wish to purchase the sculpture, it is acknow- ledged that, although it has a market value of $15,000.00, the same may be purchased for the sum of $10,000.00 payable in installments or in a lump sum, under terms or conditions to be negotiated by the parties hereto. Provided, however, that nothing herein shall be construed to require purchase by either City or the County. This option to purchase is non - assignable and shall inure only to the benefit of the City of Aspen and Pitkin County, Colorado. Mr. Lou Wille December 16, 1975 -Page 2- 4. Finally, the City agrees to indemnify and hold harmless Lou Wille from any and all claims or liability by reason of death, injury or property damage suffered by any person by reason of the location of the sculpture on City owned property during the term of this agreement.
