CERTIFICATE
The undersigned, City Clerk of the City of Aspen,
Colorado, does hereby certify that the attached is a true
and accurate copy of an agreement between the City of Aspen
and a representative of the owners of the Woods Building
granting a license to encroach; which license was granted
for the benefit of improvements located on Lots R and S of
Block 88, City and Towniste of Aspen, / Colorado.

Re: Woods Encroachment
Dear Mr. Roy:
As you recall when the City Council at its October 29,
1973, meeting, gave permission to place a canopy over the public
sidewalk fronting Galena, that permission was subject to the
owner's acceptance of three conditions. They are:
1. That the owner (owners or their representative) agrees
that the license is solely at the discretion of the City Council
and permission may be withdrawn for any reason at any time. The
owner agrees that he will, on such request, remove the structure
from any city right of way and all costs of removal and /or
demolition shall be assumed by the owner.
2. The owner agrees that he will be responsible for any
maintenance and repair of the structure or right of way neces-
sary to keep the same in a clean, safe and attractive condition
as determined by the City of Aspen.
3. Finally, the owner agrees to indemnify and hold the City
of Aspen harmless from any and all damages or liability by reason
of death, injury or property damages suffered by any person as
a result of the placement of the structure on City property. In
addition, in the event the City shall so require, he agrees to
obtain comprehensive public liability insurance covering bodily
injury or death in the amount of at least $300,000 for each per-
son in any one accident, $300,000 for each accident, and property
damage in the amount of $100,000 for each occurrence.
Would you please forward this letter to the owner (or a
representative for more than one owner) for his signature.

MEMORANDUM
TO: MAYOR STANDLEY & COUNCIL MEMBERS
FROM: DAVE ELLIS, CITY ENGINEER
RE: ENCROACHMENT REQUEST FOR WOODS BUILDING
This request is acceptable if the support columns for
the walkway canopy are set back a minimum of 2 feet from
the face of curb to provide clearance for parking and
a clear distance of 7 feet is maintained for the side-
walk. Field measurements show these two requirements
can be met. The sidewalk should be replaced in con-
junction with the project, and I would recommend
against any sidewalk planting under or along the canopy
since it cannot be maintained. All previous conditions
of removal, maintenance, and liability for encroachments
would apply.

3. Per;ission for new lighted shallow display boxes to be mounted
or existing brick East Wall of Aspen Drug on Galena Street at
sidewalk level -- to project into the public sidewalk a minimum of
4 inches and net to exceed six inches.
