Adjourn MEMORANDUM TO: Commercial Core and Lodging Commission FROM: Sara Adams, Senior Planner THE CITY OF ASPEN Community Development Department (970)429 -2778 or sara.adams @ci.aspen.co.us RE: Vacation Rentals Update SUMMARY: Short-term or vacation rentals in residential dwellings exist throughout the City in nearly every neighborhood. This type of use is generally only permitted in zone districts with a lodge designation, with the exception of 2 rentals allowed each year for residential properties. Approximately half of the 300+ rentals listed on vrbo.com are not permitted according to listings in February 2011. During a worksession last June, City Council directed staff to research other communities and to propose amendments to current short term rental regulations. BACKGROUND: Over the past year, the Finance Department has been trying to identify the majority of vacation rentals to procure uncollected tax dollars and to require all operators receive a business license. This seems simple enough however the City cannot issue a business license because the vacation rentals are often not permitted within the property's zone district. Currently there are no controls in place to mitigate impacts on residential neighborhoods and the City's only recourse for complaints is to bring the operator into municipal court to cease operations. There are two major areas that need to be addressed: 1.) Vacation rentals are operating out of compliance and without any control in place to mitigate impacts on neighborhoods and 2.) The City is not collecting lodging and sales taxes. Vacation rentals need to play by the same rules as hotels and lodges. With the popularity and prevalence of vrbo.com (vacation rental by owner) and similar sites, Aspen is clearly not the only resort town that grapples with this issue. Community Development put together a short online survey for the CAST (Colorado Association of Ski Towns) communities and received 20 responses upon which we based some of our proposed language. The Finance Department put together some projections using the VRBO data and data from an outside consultant "mtrip" to calculate that the city is missing out on collecting sales tax and lodging tax revenues between $190,078 - $219,302 a year (this is split 40/60 between ACRA/COA). PROPOSAL: In an effort to address the existing situation, Community Development is proposing a code amendment that would allow these types of rentals if they meet specific requirements: parking, association with a local property management company, clearly defined trash area, etc. Each rental would receive an annual revocable vacation rental permit that is issued with a business license and the process would be handled administratively. Vacation rentals would be permitted for all legal residential dwelling units, unless otherwise restricted (i.e. covenants prohibiting the use), with consent of the HOA if applicable. A follow up worksession to the initial discussion in June 2010 is scheduled with City Council on June 21, 2011 to conceptually discuss the amendment. Planning and Zoning Commission public hearings are scheduled on July 5 and the 19th to forward a recommendation to City Council. Please contact me if you would like to discuss the code amendment. Last month brought the Big Apple Barbecue Block Party to Madison Square Park, and August holds the smoky promise of the Big Aspen Barbecue Block Party, In between, on July 11, expect to see srnoke signals rising from Governors Island In the middle of New York Harbor as the Meatopia BBQ NYC extravaganza kicks into gear. For the first time since ns inception, the cookout, which brings together chefs from near and far plus hundreds of pounds of heritage meats, will be open to the public. This year's roster of cooks will include Chris Hart, of I-Que, in Lynchburg, Tennessee; Seamus Mullen, of Boqueria; Jonathan Waxman, of Barbuto; and Robbie Richter, of Fatty 'Cue.
