FOR THE APPROVAL OF A CONDITIONAL USE FOR AN ACCESSORY DWELLING
UNIT FOR LOT 26 OF ASPEN WEST SUBDIVISION (1605 SILVERKING DR.)

WHEREAS, Carl Schiller applied to the Planning Office for a
Conditional Use approval for a 650 square foot Accessory Dwelling
Unit to be voluntarily developed within the basement of an
existing single family residence at 1605 Silverking Dr.; and
WHEREAS, the Aspen/Pitkin County Housing Authority and the
Planning Office reviewed the proposal and recommended approval of
the Conditional Use request with conditions; and
WHEREAS, the Planning Commission reviewed the request and
referral comments, and approved the Conditional Use at a public
hearing on February 19, 1991.
NOW, THEREFORE BE IT RESOLVED by the Commission: that
Conditional Use is approved for an Accessory Dwelling Unit at
1605 Silverking Dr. with the following conditions:
Prior to issuance of Building Permit for the Accessory Dwelling
Unit:
1. The Owner shall submit a deed restriction for resident
occupancy with a 6 month minimum lease with the Aspen/Pitkin
County Housing Authority for approval. Upon approval by the
Authority the Owner shall record the deed restriction with the
Pitkin County Clerk and Recorder's Office.
2. A copy of the recorded deed restriction must be forwarded to
the Planning Office.
APPROVED by the Commission at its regular meeting on
February 19, 1991.

MEMORANDUM

RE: Schiller Conditional Use for an Accessory Dwelling Unit
DATE: February 8, 1991
SUMMARY: The applicant seeks a Conditional Use approval in order
to voluntarily construct a studio accessory dwelling unit of
approximately 650 square feet in a single family residence
located at 1605 Silverking Dr. Planning Staff recommends
approval of this Conditional Use with conditions.
APPLICANT: Carl Schiller, represented by Don Huff
LOCATION: 1605 Silverking Dr. (Lot 26, West Aspen Subdivision)
ZONING: R-15
APPLICANT'S REQUEST: Conditional Use approval for an accessory
dwelling unit.
PROPOSAL: The existing residence is a 3 bedroom home of approx.
3040 sq. ft. The applicant wishes to remodel a storage area into
a studio accessory dwelling unit of approximately 650 sq. ft. The
unit will be a "walk -out" in the basement level. Please see
Attachment "A" for a plan of the unit and the site.
REFERRAL COMMENTS:
The Housing Authority requires that accessory dwelling units
comply with the following standards:
The accessory dwelling unit shall contain between 300 to 700
square feet of net livable area and be located within or attached
to a principal residence. It shall meet the housing designee's
guidelines for such units. The unit shall be deed restricted by
Owner to meet the definition of a Resident Occupied Unit and be
rented for period of six months or longer. The Owner of the
principal residence shall have the right to place a qualified
employee or employees of his or her choosing in the accessory
dwelling unit. Occupancy of the accessory dwelling unit is not
mandatory. The recommended conditions are:
1. Prior to issuance of any building permits for the accessory
dwelling unit, Owner shall submit an appropriate deed restriction
with the Aspen/Pitkin County Housing Authority for approval.
Upon approval by the Authority the Owner shall record the deed
restriction with the Pitkin County Clerk and Recorder's Office.

STAFF COMMENTS: An accessory dwelling unit is a conditional use
in the R-15 zoning district. The Commission has the authority to
review and approve development applications for conditional uses
pursuant to the standards of Section 7-304:
A. The conditional use is consistent with the purposes, goals,
objectives and standards of the Aspen Area Comprehensive
Plan, and with the intent of the Zone District in which it
is proposed to be located.
RESPONSE: This proposed unit will allow the property to house a
local employee in a residential area, which complies with the
zoning and Aspen Comprehensive Plan.
B. The conditional use is consistent and compatible with the
character of the immediate vicinity of the parcel proposed
for development and surrounding land uses, or enhances the
mixture of complimentary uses and activities in the
immediate vicinity of the parcel proposed for development.
RESPONSE: This use is compatible with the other residential uses
in the surrounding neighborhood. Located in the basement, the
unit is not visible from the outside as a separate unit.
C. The location, size, design and operating characteristics of
the proposed conditional use minimizes adverse effects,
including visual impacts, impacts on pedestrian and
vehicular circulation, parking, trash, service delivery,
noise, vibrations and odor on surrounding properties.

D. There are adequate public facilities and services to serve
the conditional use including but not limited to roads,
potable water, sewer, solid waste, parks, police, fire
protection, emergency medical services, hospital and medical
services, drainage systems, and schools.
RESPONSE: All public facilities are all ready in place for the
existing neighborhood.
E. The applicant commits to supply affordable housing to meet
the incremental need for increased employees generated by
the conditional use.

RESPONSE: This is a voluntarily provided unit and will contribute
to the affordable housing stock.
F. The proposed conditional use complies with all additional
standards imposed on it by the Aspen Area Comprehensive Plan
and by all other applicable requirements of this chapter.
RESPONSE: This use complies with the Aspen Area Comprehensive
Plan and any other applicable conditional use standards.
Note: As this unit is not 100% above grade, a floor area bonus
cannot be granted to the primary residence.
STAFF RECOMMENDATION: Planning recommends approval of this
conditional use with the following conditiorJ;

This proposed Accessory Dwelling Unit is located at 1bub
Silverking Dr.,Aspen,CO.
The ADU shall consist of approx. 650 sq.ft. of living space
located within a single family dwelling unit. The unit will
contain a 'studio style' living space, consisting of a
sleeping area, living space, dining area, full Kitcrien taci3-
ities, full bath, and adjacent storage and utility areas.
It is accessed from the exterior via an entrance opening to
the south. It will also have access to the main dwelling unit
with a door located at the lower level of the structure.
The unit is located within the structure below the garage,
on the east end of the building. The lot slopes to the soutti
which creates a 'walk -out' situation along the soutn wall.
The ADU shall not increase the floor -area -ratio of the
existing structure. The exterior modifications shall consist,
of (2) new windows, a 4'x4' casement keast), and a b'x4' Dow
window (south), new 3' door (south).
The needed modifications to transform the existing storage
space to the ADU are already permitted at the buildiny wept.,
except for the addition of a kitchen space.
