Main, Lots K and L, Block 18, Original Aspen Townsite Zoning: "0" - Office Applicant's Request: The applicant is requesting the approval of a proposed expansion of a conditional use - Sorensen's Danish Antiks. The expansion is to be 536 square feet which is to be exempt from GMP require- ments as well as exempt from floor area calculations as the space is subgrade and will be used for furniture storage. The request for the expansion of the conditional use is made pursuant to Section 24-3.3(c) of the Code regarding modification, expan- sions and enlargements of a conditional use. Review Criteria: Section 24-3.3(c) states that no approved conditional use may be modified, structurally enlarged or expanded in ground area unless such changes receive prior approval from P & Z. The approval of an expansion must be reviewed according to the same three criteria considered in the ori.gi.nal conditional use approval. The three review criteria, found i'n Section 24-3.3(b) of the Code, include the following: 1. Does the proposed use comply with all requirements imposed by the zoning code? 2. Is the proposed use consistent with the objectives and purposes of the zoning code and the applicable zoning district? 3. Is the proposed use designed to be compatible with sur- rounding land uses and uses in the area? Planning Office Review: The applicant proposes to excavate below an existing porch to provide a 536 square foot space for furniture storage. This space is 100% subgrade and will be accessed from an alley by means of a hydraulic lift and an exterior stairway. The proposal meets the first two review criteria regarding com- pliance'with the zoning code and the Office Zone District. The expansion is exempt from GMP requirements and floor area calcula- tions since the proposed space is 100% below grade. The third criteria, compatibility with surrounding land uses, does not appear to present any problems si.nce the expansion space is only 586 sq-care feet and is only to be used for storage. The review of the compatibility of a proposed project has typically included concerns regarding parking, noise and the local versus tourist orientation of a project. In this case, parking is not a problem in that the proposed storage space does not reduce onsite parking and also will not generate any need for additional parking. The proposed storage space should not generate any negative noise impacts. Sorensen's Danish Antiks primarily services the local population. Also, the antique furniture sales will not be expanded since only storage space is being added. The storage is to be used in place of storage space that has previously been rented at the Airport Business Center. A full year's stockof the furniture to be. stored is brought in from Denmark once a year, so the impacts of deliveries to the storage space will be insignificant.. Light and ventilation into the proposed expansion area would preclude any use but storage. The Assistant City Attorney stated that the proposed expansion of a conditional use should be reviewed according to Section 24-3.3 of the Code. Planning Office Recommendation: The Planning Office recommends the approval of the proposed expansion of the conditional use at Sorensen's Danish Antiks at 734 West Main. Approval is subject to the proposed expansion being 100% or more subgrade and used exclusively as storage space. MEMORANDUM TO. RE: Expansion of Conditional Use DATE: 12 May 1982 Pursuant to the requirements of section 24-3.3(c), the owners of Sorensen's Danish Antiks, 734 W. Main, request approval from the Commission for an expansion of their Conditional Use. Please find enclosed a check for $225.00(the Conditional Use Application Fee), five sets of architectural drawings, and the names and addresses of the 39 property owners within 300 feet. The applicant proposes to excavate below the existing porch to provide a 536 square foot "root cellar" for furniture storage. This space is more than 100% subgrade and is accessed only from the alley by means of a hydraulic lift and an exterior stairway. It will be suitable only for it's intended use: storage. Each spring, Liz Sorensen and Mary Webster go to Denmark to buy their entire year's inventory of Danish antique furniture and accessories. A full year's stock is much more than any store can hold, so they have been renting storage space at the Airport Business Center at a cost of more than $6000 a year. This new storage can be constructed at slightly more than one year's rent at the Airport Business Center and solves these problems and concerns: 1. A full year's inventory is unloaded from its container once a year and stored in one location. 2. Reduced truck traffic between the Airport Business Center and town to replace inventory. 3. No reduction in onsite parking is necessary by using the the hydraulic lift instead of ramps. 4. No increase in F.A.R. results since subgrade space is excluded. 5. Non-public storage space does not increase the impact of the existing commercial use. Your timely consideration of this application is appreciated.
