SUMMARY: The Planning Department recommends approval of this
Conditional Use to allow an antique store on the first floor of a
historic structure locat d in the O-Office zone.

APPLICANT'S REQUEST: Approval of Conditional Use for an 800 square
foot antique store on thelfirst floor of the Carriage House.
REFERRAL COMMENTS:
Engineering: Chuck Roth �as forwarded the following comments:
1. The building is already displaying the name Stuart Buchanan.
Is the business already oplen prior to receiving approval to do so?
2. The sidewalk area in front of the property contains a hazardous
condition. It is suggested that approval for the conditional use
not be granted until this 'condition is remedied.

The inclusion of antique stores in the list of conditional uses for
the Office Zone was an incentive to encourage innovative uses of
historic resources in the Main Street Historic District.
Parking: The HPC has reviewed the parking requirements for the
parcel and has granted a variation for a reduction in the required
spaces, finding that the maximum number of parking paces are
included on -site.
Other Concerns: Signage - the three signs in front of the
structures are overkill. It is recommended that the largest non-
conforming free-standing sign be removed. Landscaping - a
landscape plan was worked out with HPC. The landscape should be
completed this spring. (Attachment "B")
STAFF COMMENTS: In December 1989, Planning Director Amy, City
Attorney Fred Gannet, Zoning Officer Francis Krizmanich, and
Planner Leslie Lamont came to an agreement to allow temporary
occupancy of the carriage house. At that time, the owner agreed
to expedite the conditional use application and comply with any
conditions of approval by the Planning Commission. (Attachment
licit)
Section 7-304 requires the following standards be met to approve
a Conditional Use:
A. The conditional use is consistent with the purposes, goals,
objectives and standards of the Aspen Area Comprehensive Plan,
and with the intent of the Zone District in which it is
proposed to be located.
Response: An antique store is specifically listed as a conditional
use in any structure that has received historic landmark
designation in the Office Zone. It is consistent with the goals
and objectives of the Comprehensive Plan.
B. The conditional use is consistent and compatible with the
character of the immediate vicinity of the parcel proposed
for development and surrounding land uses, or enhances the
mixture of complimentary uses and activities in the immediate
vicinity of the parcel proposed for development.
Response: The carriage house and main structures are being
restored in compliance with the immediate vicinity's Victorian
character. There are at least three other antique stores on Main
Street within four blocks from this property. The Stuart Buchanan
store will further enhance the mixture of uses and activities in
the vicinity.
C. The location, size, design and operating characteristics of
the proposed conditional use minimizes adverse effects,
including visual impacts, impacts on pedestrian and vehicular
circulation, parking, trash, service delivery, noise,
vibrations and odor on surrounding properties; and
Response: The store is located on the first floor of the carriage
house in approximately 800 s.f. of area. The low traffic volume
with this business will minimize impacts on pedestrians, vehicular
circulation, parking, trash, noise and odor. This store relies
primarily on client referral rather than walk-in traffic. There
should be little need for parking, trash, and service delivery.
D There are adequate public facilities and services to serve
the conditional use including but not limited to roads,
potable water, sewer, solid waste, parks, police, fire protec-
tion, emergency medical services, hospital and medical
services, drainage systems, and schools.
Response: There are adequate public facilities and services in
place to serve the antique store as a conditional use.
E. The applicant commits to supply affordable housing to meet
the incremental need for increased employees generated by the
conditional use; and
Response: The employee number proposed for the antique store is
1.5, which is less than the potential employee demand for currently
approved office use of the same space. Additionally, Stuart
Buchanan has rented the upstairs one bedroom apartment for use by
the employees.
F. The proposed conditional use complies with all additional
standards imposed on it by the Aspen Area Comprehensive Plan
and by all other applicable requirements of this chapter.
Response: The proposed use complies with all other standards set
forth in the Comprehensive Plan and other requirements of Article
7.
STAFF RECOMMENDATION: Staff recommends approval of a Conditional
Use for the operation of an antique store in the first floor of
the Smith-Elisha Carriage House with the following conditions:
1. Improvement of the sidewalk conditions on the property as
required by the Engineering Department and excavation permit
processes to be completed no later than May 15, 1990.
2. Completion of HPC approved landscape by June 1, 1990.

Additional information concerning the above referenced land use
application have been brought to my attention.
1. There are several property line issues between this property
and the McDonald property to the east. The foundation of the
carriage house is on or near the McDonald property.
2. The Building Department may have other issues.
3. There is a fence dispute, and a tree was taken down and was
supposed to be replaced. The terrace effect of the property was
to be left in place.

Having reviewed the above referenced application, and having made
a site inspection, the engineering department has the following
comments:

APPLICATION FOR CONDITIONAL USE
Pursuant to Article 7, Division 3, of the Aspen Land Use Code,
this Application seeks approval of a conditional use for the Smith-
Elisha Carriage House, located on Lots N,O,P, of Block 44, also
known as 320 West Main Street. The subject property has received
historic landmark designation. On behalf of the owner, Alan J.
Shada, we hereby respectfully request approval of a conditional use
for an antique store to be located on the first floor of the
carriage house, a use permitted by special review in the office (0)
zone. The antique store will be operated by Stuart Buchanan.
The standards for approval of this conditional use have been
met as set forth below:
I. Approval Standards
A. Use of the space as an antique store is consistent with
the purposes, goals, objectives and standards of the
Aspen Area Comprehensive Plan, and with the intent of the
office zone. An antique store is specifically listed as
a permitted conditional use in any structure that has
received historic landmark designation in the office zone
subject to standards and procedures set forth under
Article 7, Division 3. Section 5-213 (C)(1).
B. The antique store use is consistent and compatible with
the character of the immediate vicinity of the subject
property. The adjacent, main, Victorian house was
restored in conjunction with the carriage house and is
currently being used for offices. There are several
historic, victorian buildings within the two or three
block area on Main Street, with various office,
commercial and residential uses. There are at least
three other antique stores on Main Street, located
approximately four blocks in either direction from this
property. The Stuart Buchanan antique store will further
enhance the mixture of uses and activities in the
immediate vicinity.
C. The store will be located on the first floor of the
carriage house, estimated at 800 square feet. The low
volume traffic involved with this business will minimize
any adverse effects, such as visual impacts, impacts on
pedestrians, vehicular circulation, parking, trash,
service delivery, noise, vibrations and odor on
surrounding property. The Stuart Buchanan store relies
primarily upon individual client referral rather than
walk in traffic. There is very little need for parking,
trash and service delivery.
D. There are adequate public facilities and services to
serve the antique store as a conditional use. The
carriage house is serviced by City water and sewer.
There is an RFTA bus stop on the same block, within a few
yards of the property. There is typically plenty of
parking on both the north and south sides of Main Street
near the property, and there are two off-street parking
spaces on the alley in the rear of the carriage house.
5. There will be no increase in employee generation by the
antique store over the current approved office use. In
fact, there are currently plans for 1.5 employees for the
store which is significantly less than the potential
employee demand for office use of the same space.
Furthermore, the owner has rented the upstairs one
bedroom apartment to Stuart Buchanan for use by the
employees.
6. The proposed use complies with all other standards set
forth in the Aspen Area Comprehensive Plan and other
requirements of Article 7.
