A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ASPEN, COLORADO,
APPROVING CONSTRUCTION OF THE SI JOHNSON DITCH ACCESS ROAD OVER THREE
TREES LLC, AND M.S. 4610 LLC PROPERTY FOR CONSTRUCTION AND REPAIR
PROJECTS FOR THE SI JOHNSON DITCH.
WHEREAS, the City owns the majority interest in the Si Johnson Ditch which is used to
irrigate many prominent properties within the City limits, including the Benedict Music Tent, the
Aspen Institute and several west end parks; and
WHEREAS, the City, as majority owner, performs operation, maintenance and major repairs
of the ditch, and requires occasional vehicular access to the ditch in order to conduct major repairs;
and
WHEREAS, the City and Westchester Investments, Inc. (which also owns an interest in the
Si Johnson Ditch) entered into agreements (the "Agreements ") recorded August 6, 2009 at Reception
No. 561702, with two private property owners, Three Trees LLC and M.S. 4610 LLC, whereby said
owners granted an access road easement over and through their properties to enable the City to
access the Si Johnson Ditch for major repairs; and
WHEREAS, pursuant to the Agreements, Three Trees LLC and M.S. 4610 LLC have agreed
to perform or pay for certain road construction for the access road on their properties; and
WHEREAS, pursuant to Ordinance No. 008 -2010, Pitkin County Code Section 2-30 -
30(h)(10), and C.R.S. Section 30 -28- 110(1), the City applied to the Planning and Zoning
Commission of Pitkin County ( "Planning Commission ") to obtain location and extent review
approval to construct the road; and
WHEREAS, duly noticed public hearings on the Location and Extent application were
held on April 5, 2011, and April 19, 2011, and public comment was taken; and
WHEREAS, at the public hearings, Three Trees LLC and M.S. 4610 LLC's consultants
made presentations to the Planning Commission concerning the proposed road construction and
landscaping design; and
WHEREAS, pursuant to C.R.S. 30 -28- 110(1), the Planning Commission denied the
application on the basis that it did not comply with the Aspen Area Community Plan, noting in
its subsequent resolution that the road will be constructed on a slope in excess of 45% which will
require extensive geotechnical mitigation to stabilize the slope, and that the extensive proposed
landscaping was not consistent with surrounding natural environment; and
WHEREAS, as provided in C.R.S. 30- 28- 110(1)(c), since neither the authorization nor
financing of this City project falls within the province of the board of county commissioners or
other county officials or board, the Planning Commission's denial of the Location and Extent
review application may be overruled by majority vote of the Aspen City Council, as the body
having jurisdiction over this project; and
WHEREAS, materials have been presented to City Council showing a revised proposed
landscaping design and construction that the City finds is consistent with the surrounding natural
environment and the Aspen Area Community Plan; and
WHEREAS, construction of the road is necessary to allow legal and reliable vehicular
access for major repairs of the Si Johnson Ditch; and
WHEREAS, the Si Johnson Ditch is an important City irrigation and aesthetic feature,
and the need to make the major repairs necessary to preserve this significant ditch is consistent
with the Aspen Area Community Plan; and
WHEREAS, City Council has had the opportunity to obtain such advice and information
as it deems appropriate and necessary regarding the Planning Commission's denial of a location
and extent review of the construction of the new access' road to the Si Johnson Ditch pursuant to
Ordinance No. 008 -2010, Pitkin County Code Section 2- 30- 30(h)(10), and C.R.S. Section 30-28 -
110(1)(c), and the City's need and ability to overrule that denial,
THEREFORE, BE IT RESOLVED, by the City Council of the City of Aspen, that the
Planning Commission's denial of approval of the location and extent review application for
construction of the new access road to the Si Johnson Ditch pursuant to Ordinance No. 008 -2010,
Pitkin County Code Section 2- 30- 30(h)(10), and C.R.S. Section 30 -28- 110(1) is hereby
overruled; and
FURTHER RESOLVED, by the City Council of the City of Aspen, that the City Staff is
authorized to perform any such actions as may be necessary or desirable to effectuate
construction of the new access road to the Si Johnson Ditch in accordance with the Agreements,
and substantially as shown in the design drawings submitted to City Council.
