THEREFORE, DECLARANT HEREBY RESERVES THE SPECIAL DECLARANT RIGHTS AND RESERVED DEVELOPMENT RIGHTS DESCRIBED ELSEWHERE IN THE CONDOMINIUM DECLARATION AND ON THIS CONDOMINIUM MAP AND THE SPECIAL DECLARANT RIGHTS AND RESERVED DEVELOPMENT RIGHTS SET FORTH BELOW. DECLARANTS SPECIAL DECLARANT RIGHTS AND RESERVED DEVELOPMENT RIGHTS INCLUDE, WITHOUT LIMITATION, THE RIGHT TO: (A) CREATE AND PHYSICALLY CONSTRUCT, ALLOCATE AND DESIGNATE ALL OF THE UNITS, THE GENERAL COMMON ELEMENTS AND THE LIMITED COMMON ELEMENTS IN THE LOCATIONS AND CONFIGURATIONS DESCRIBED ON THIS CONDOMINIUM MAP AND ELSEWHERE IN THIS DECLARATION; (B) CREATE AND CONSTRUCT FUTURE UNIT 301 AND TO UTILIZE, CREATE, ALLOCATE AND REALLOCATE COMMON ELEMENTS IN ORDER TODD SO AS SHOWN ON THIS CONDOMINIUM MAP; (C) EXPAND UNIT 201 AND /OR UNIT 207 AND TO UTILIZE, CREATE, ALLOCATE AND REALLOCATE COMMON ELEMENTS IN ORDER TO DO SO; AND (D) CREATE, CONSTRUCT AND ALLOCATE TO THE UNITS AND FUTURE UNIT 301, THE LIMITED COMMON ELEMENTS APPURTENANT THERETO AS SHOWN ON THIS CONDOMINIUM MAP. IN CONNECTION WITH THE COMPLETION OF THE DEVELOPMENT PLAN AND THE EXERCISE OF SPECIAL DECLARANT RIGHTS AND RESERVED DEVELOPMENT RIGHTS DECLARANT RESERVES THE RIGHT TO CONVERT COMMON ELEMENTS INTO UNITS, FUTURE UNITS OR PARTS OF UNITS, CONVERT GENERAL COMMON ELEMENTS INTO LIMITED COMMON ELEMENTS AND CONVERT LIMITED COMMON ELEMENTS INTO GENERAL COMMON ELEMENTS, ALL AS IDENTIFIED IN THE CONDOMINIUM DECLARATION OR ON THIS CONDOMINIUM MAP. FURTHER, DECLARANT RESERVES THE RIGHT TO CONVERT UNIT 204 FROM A COMMERCIAL UNIT INTO AN AFFORDABLE HOUSING UNIT, CONSTRUCT UNIT 204 AS AN AFFORDABLE HOUSING UNIT, AND TO UNILATERALLY FILE A CONVERSION MEMORANDUM DESCRIBED IN SECTION 15.1 BELOW TO MEMORIALIZE SUCH CONVERSION WITHOUT ANY REQUIREMENT TO OBTAIN APPROVAL FROM THE ASSOCIATION OR ANY OTHER OWNER WITH RESPECT TO SAID CONVERSION OR CONSTRUCTION RELATED THERETO. FURTHER, DECLARANT RESERVES THE RIGHT TO CONVERT THE AREA ON THE SECOND FLOOR, ADJACENT TO UNITS 201 AND 207, CURRENTLY LABELED - GCE' ON THE CONDOMINIUM INTO UNIT SPACE THAT IS A PART OF EITHER UNIT 201 AND /OR UNIT 207 AS DESCRIBED IN THE DEVELOPMENT PLAN. DECLARANT MAY EXERCISE ITS SPECIAL DECLARANT RIGHTS AND RESERVED DEVELOPMENT RIGHTS ON ALL OR ANY PORTION OF THE PROPERTY IN WHATEVER ORDER OF DEVELOPMENT DECLARANT, IN ITS SOLE DISCRETION DETERMINES. DECLARANT SHALL RECORD ANY AND ALL AMENDMENTS TO THIS CONDOMINIUM MAP AND THE CONDOMINIUM DECLARATION AS ARE NECESSARY TO LEGALLY ESTABLISH SAID UNITS, INCLUDING, EXPANDED UNIT 201, EXPANDED UNIT 207, FUTURE UNIT 301 AND COMMON ELEMENTS AND LIMITED COMMON ELEMENTS AND TO ALLOCATE INTERESTS IN THE COMMON ELEMENTS AMONG ALL THE UNITS AT THE TIME OF EXERCISE OF SAID DEVELOPMENT RIGHTS. (E) THE RIGHT TO CONSTRUCT UTILITY LINES, PIPES, WIRES, DUCTS, CONDUITS AND OTHER FACILITIES THROUGH, ACROSS OR UNDER ANY PORTION OF THE PROPERTY FOR THE PURPOSE OF FURNISHING UTILITIES AND OTHER SERVICES TO IMPROVEMENTS TO BE CONSTRUCTED ON THE PROPERTY; (F) THE RIGHT TO WITHDRAW AND GRANT EASEMENTS AND LICENSES TO PUBLIC UTILITY COMPANIES AND TO CONVEY IMPROVEMENTS WITHIN THOSE EASEMENTS ANYWHERE IN THE DEVELOPMENT NOT OCCUPIED BY THE BUILDING FOR THE PURPOSES MENTIONED. (G) THE RIGHT TO RECONFIGURE ANY OR ALL OF THE UNITS AND CONSTRUCT AND COMPLETE THE UNITS AS RECONFIGURED, TOGETHER WITH THE COMMON ELEMENTS, ALL IN A MANNER CONSISTENT WITH THE DEVELOPMENT PLAN. THE DECLARANT SHALL HAVE THIS RIGHT TO RECONFIGURE UNITS THE DECLARANT DOES NOT OWN. ALL OWNERS ACQUIRED THEIR UNIT(S) EXPRESSLY SUBJECT TO DECLARANTS SPECIAL DECLARANT RIGHTS AND RESERVED DEVELOPMENT RIGHTS, INCLUDING BUT NOT LIMITED TO DECLARANTS RIGHT TO COMPLETE THE DEVELOPMENT PLAN.
