MINUTES OF AUGUST 17, 2011
Chairperson, Andrew Kole called the meeting to order at 8:30 a.m.
Commissioners in attendance were: Fred Ayarza, Don Sheeley, Terry Butler.
Excused were Siam Castillo and Bill Dinsmoor.
Outside dining — enforcement

Andrew inquired about enforcement on the malls and outside dining on the streets
such as Asie on Main Street. The question is why it got changed around and what
should happen now.
Kathryn said she realizes the CCLC board is around Aspen more on the weekends.
The city attorney reviewed the powers and duties and it was determined that
advisory boards cannot enforce. Tony Kornasiewicz is the enforcement office
from the Engineering Department for the right -of -ways. We have measured all the
restaurants and marked them. At the beginning of the year a letter will be send out
to all mall lease holders and outside dining restaurants on the right -of -way
regarding the regulations etc. Diagrams and photographs will need to be provided.
Kathryn said there needs to be some kind of conduit for CCLC to get the
information to the appropriate staff person.
Andrew commented that the retailers don't know who is doing enforcement and
the restaurants are unclear.
Andrew mentioned Escobar and the fact that he had to go to the City Manager to
get approval.
Don said it doesn't have to do with enforcement. We are trying to say if a
restaurant owner comes to me with a mall lease question right now you go to the
city and fill out a complaint form. We want to be able to discuss with restaurants if
they are encroaching and be able to discuss this with the owner and resolve it on
the spot.
Andrew said this commission has diminished over the years.

Fred said he loves giving back and to sit down here and not have any authority to
help out should be changed.
Kathryn said Tony and I measured all the restaurants and on coach row they are to
have 18 inches between the street and right -of -way. We didn't want to make them
purchase new furniture this year. Next year they will have to comply. We can
meet with the attorney's office and discuss some alternatives. Right now you can
only recommend. We would have to change the by -laws.
Terry said 12 '/2 years ago we discussed alfresco dining. Within three years we had
7 restaurants and as it grew CCLC took control. Everyone wants to be outside.
Anything we can do to encourage outside dining such as Escobar is our mission.
Andrew said Pacifica got bigger due to the plant grates. It is the home run of
restaurants.
Fred said you have 7 people on this board so take advantage of it.
Kathryn suggested CCLC draft something up as to how CCLC can help and then
we can take it to the attorney. Kathryn explained that she doesn't want CCLC
making decisions etc. without the attorney's approval.
Tony pointed out that he doesn't work on the weekends.
Kathryn said per code you need six feet of walkway.
Kathryn said we need to make sure CCLC has the right directions.
Tony said some issues would be formal action through the Liquor board,
Engineering Dept. or Clerk's office. There is the initial establishment of
encroachments and there is a clear seat of guidelines. It has to be six feet wide. As
the summer goes on we get creep.
Kathryn said we need a process.
Don said we can solve a lot of problems for Engineering and the Clerk's dept.
Newspaper racks

Fred also mentioned graffiti on the news paper racks. Some of the racks are unsafe
and should be removed. There are racks of all different colors with nothing in
them.
Mitzi Rapkin said she had a meeting with the new publisher of the Aspen times
and they are having an art contest to paint the news paper racks.
Kathy said two were removed on Galena and the Engineering Department put a
notice on the box that they would be removed in 30 to 60 days for health and safety
reasons.
Tony said he will discuss this with Trish Aragon, department head for Engineering.
Pro - cycling Race
Mitzi said the organizers had three meeting with businesses and owners to inform
them of the race. The finish line is in front of the court house. The expo will be at
Wagner Park. There will also be a jumbo tram at that location. Main Street will be
closed at 6 a.m. The city has delivered pamphlets to everyone along the street
closures. From 2:00 p.m. to 5:00 p.m there will be no vehicle movement. The
racers end about 3:30. There will be a spill over on Hyman for large trucks.
Andrew asked about bookings in rooms for the event. Mitzi said rooms are not
filled and she is going to a meeting at 11:00 to find out the bookings. There are
three sponsorships, Escobar and two others.
Comments
Andrew said there is a meeting at 11:00 on the lighting update.
Outside dining and mall leases
CCLC commented that outside dining is very important in Aspen. Everyone wants
to eat outside.
MOTION: Terry moved that the mall leases and outside dining encroachments be
extended to November 1 st at no additional cost; second by Andrew. All in favor,
motion carried.
Staff said they would send the information to the appropriate departments.
Saturday Market

Andrew asked the board if they had any issues with sending out letters to those
artisans in the market that we definitely want back in advance of the December
application.
Everyone agreed that some of the vendor's with quality work should be asked to
come back. They can fill out the application in December but will know in
October.
Kathy said she had no problem with that. There are about 15 that should be
included in the list.
MOTION: Terry moved to adjourn; second by Don. All in favor, motion carried.
