DATE: April 25, 1991
SUMMARY: A stream margin exemption review is necessary for the
architectural changes purposed for a single family residence
within 100 feet of the high water line of the Roaring Fork River.
Staff recommends approval of the stream margin exemption.
APPLICANT: Ken Owen
LOCATION: 115 Neal Street, Aspen Colorado
ZONING: R -15
APPLICANT'S REQUEST: Stream Margin Exemption for the addition of
several architectural features to a single family residence.
REFERRAL COMMENTS: Please see attached referral from the
Engineering Department.
STAFF COMMENTS: Pursuant to Section 7 -504 B. the expansion,
remodeling or reconstruction of an existing development shall be
exempt from stream margin review if the development:
a. does not add more than 10% to the floor area;
b. does not require the removal of any tree;
c. is located such that no portion of the expansion, remodeling
or reconstruction will be any closer to the high water line
than is the existing development;
d. does not fall outside of an approved building envelope; and
e. is located completely outside of the Special Flood Hazard
Area and more than one hundred feet from the high water line
of the Roaring Fork River or the expansion, remodeling or
reconstruction will not cause an increase to the amount of
ground coverage of structures within the Special Flood
Hazard Area.
The applicant's proposal is to add windows to a dining room at a
45 degree angle, install a different handrail on an existing deck
and add windows to the master bedroom and bath, and first floor
bedroom. All work is proposed within the existing home structure
and complies with the standards for an exemption. A stream
margin approval was approved the development of this single
family residence in 1983. The proposed alterations do not effect
that original stream margin review.
RECOMMENDATION: Staff recommends approval of the Owen stream
margin exemption for the addition of a bay window, new hand rail,
and three new windows within the existing structure.
