SUBJECT: East Hopkins Townhome Project GMP - Extension of Residential
Allocation
DATE: July 22, 1985
SUMMARY: The Planning Office recommends the granting of a 180 day
extension to the terms of the growth management allocation for the
East Hopkins Townhome project.
PREVIOUS COUNCIL ACTION: The applicant submitted a growth management
application for a mixed office /residential development proposal on
August 1, 1983 and December 1, 1983. The project consists of three
individual professional offices, three professional townhomes and six
deed - restricted housing units.
In the residential growth management allotment competition of 1983 the
East Hopkins Townhome Complex was scored in excess of the minimum
required threshold; however, it was scored lower than the other two
projects competing. All three projects were awarded allotments by
Resolution No. 7, Series of 1984 on March 12, 1984 contingent upon a
complete submittal by the respective applicants for building permits no
later than August 1, 1985. East Hopkins Townhome Project received an
allotment of three dwelling units.
BACKGROUND: The proposed project is in the C -1 zone and located
adjacent to the 601 E. Hopkins building. The three lots on which the
townhomes /office complex would be built are currently used as a
parking lot.
PROBLEM DISCUSSION: Section 24 -11.7 (h) establishes that the applicant
must submit plans to the Building Department sufficient for the
issuance of a building permit within thirty -three months after the
deadline for application submission. Resolution 84 -7 shortens this
time frame for the residential portion of the project to 20 months for
a complete submittal to the Building Department. The reason for the
shortened time frame was that eight units of excessive allotments were
allocated from the 1984 residential quota; and it was felt to be in
the best interest for the community that in exchange for allocating
1984 residential units, the projects should be completed more quickly.
Section 24 -11.7 (a) (4) provides that City Council may grant an
extension of the GMP expiration deadline "on a showing of diligence
and good will and based on a finding that said extension is in the
best interest of the community ". Bill Poss states that he has reached
the point where only final cost analysis and revision from the per-
spective buyers are needed before completing construction documents
for submittal to the Building Department. In addition, this project
will be built incorporating the positive features represented in the
GMP submittal, and still deserves the support given by the City at the
time of GMP competition.
ALTERNATIVES: Options open to Council are to grant the requested 180
days extension or to cause the allocation to expire at this time. We
feel that it is of benefit to the community to allow the applicant to
carry through with this project as it has been represented. The
office and townhomes space has been accounted for in the City's
respective GMP commercial and residential quotas, and, therefore, is
within the rate of growth established for the community.
RECOMMENDED NOTION:
"I move to grant an 180 day extension to the growth management
allocation for the East Hopkins Townhome Project, said extension
to expire on March 1, 1986 ".

WHEREAS, in accordance with Section 24- 11.4(a) of the Municipal •
.Code, as amended, December 1st of each year is established as a deadline •
for submission of applications for residential development allotments

within the City of Aspen; and
•
WHEREAS, in response to this provision, three projects were •
submitted for evaluation, involving a total of eighteen (18) free
market units and fifteen (15) empl units, identified as follows:

WHEREAS, according to the records of the Planning Office and
the Building Department, there are ten (10) units available for allocation
due to build -out rates in 1983; and
WHEREAS, a duly noticed public, hearing was held on January 17,
1984, by the Aspen Planning and Zoning Commission, at which time
they did evaluate and score the projects and all three projects success-
fully met the minimum required threshold of 43.8 points, with the
point subtotals awarded follows:
East Hopkins Professional Townhome Complex 44.75 •
Gordon Property PUD 46.91
700 S. Galena 45.33
WHEREAS, the Aspen,City Council did review the recommended Planning
and Zoning scoring at their regula meeting on February 27, 1984,
including an appeal of the scoring of the 700 S. Galena project;

Dear Bill:
This letter is written to inform you that pursuant to Section 24 -11.7
(a) of the Municipal Code, as amended, your East Hopkins Townhomes
Residential /Commercial GMP Allocations will expire on August -1 -, 1985.
Section 24 -11.7 (a) requires that the Planning Office notify you of the
expiration date and the requirements which you must meet in order to
avoid loss of your allocation.
The Code requires that yo,. .ubmit plans to the Building Department
sufficient for the issuance of a building permit for the project by
August 1. If you are unable to meet this deadline, but wish to retain
your allocation, please submit a letter to me, within which you
request that City Council grant an extension of the deadlines of up to
180 days. To justify the extension, please demonstrate your diligence
in pursuing this project and why the extension is in the best interests
of the Community.
