The application was originally approved for 11 additional lodge units. Phase One, for 5 of the 11 units has been completed. The applicant is now seeking to construct only 4 of the remaining 7 units approved, each unit being larger by approximately 56 square feet. The applicant is willing to vacate the 3 remaining growth management allotments. With this amendment, the two middle units will be approximately 3 feet shorter in elevation and approximately 19 feet further back from the street in plan. This amendment provides more open space, improves view corridors, decreases the site's massing, and reduces the demand for parking and general services. The HPC Project Monitors are Mary Hirsh and Roger Moyer. Each decided the changes were significant and warranted a review by the full Historic Preservation Commission. The Commission reviewed these proposed amendments on April 22 and recommended the applicant study moving the driveway to the south by 1.5 feet to allow two parking spaces to be accommodated behind the lodge units instead of adjacent to the public sidewalk. The HPC also recommended the Project Monitors review and approve the final change orders submitted. Staff recommends the Director approve the insubstantial amendments to the Conditional Use and GMQS approvals, with conditions. APPLICANT: ALH Properties. Represented by Tracy Haisfield. LOCATION: 435 West Main Street. ZONING: Office - Historic Overlay 1 REVIEW PROCEDURE: Insubstantial amendments to an approved Conditional Use may be approved by the Director pursuant to Section 26.60. Insubstantial amendments to an approved Growth Management Allotment may be approved by the Director pursuant to Section 26.100. Amendments to the development order may be approved by the HPC or the HPC Project Monitor pursuant to Section 26.72. STAFF COMMENTS: Review criteria and Staff Findings have been included as Exhibit "A." The application has been included as Exhibit `B." RECOMMENDATION: Staff recommends the Community Development Director approve the Insubstantial Amendments to the Conditional Use and Growth Management approvals with the following conditions: 1. Parking spaces #11 and #16 shall be relocated to the south side of units #13 and #14. 2. The Main Street curb cut to the "Manager's Residence" and the 3rd Street curb cut to the "office" be eliminated prior to issuance of Certificate of Occupancy for any Phase 2 lodge unit. 3. Three lodge unit GMQS allocations are hereby vacated and may not be constructed without new allocations being granted from City Council. 4. All sections of City Council Ordinance 29, series of 1995, Ordinance 31, series of 1995, and Resolution 35, series of 1995, Planning and Zoning Commission Resolution #95 -41, Planning Director's June 5, 1997, approval, and all representations made to City review boards and City Staff shall remain unchanged and conditions of approval except as amended herein. An insubstantial amendment shall be limited to changes in the operation of a conditional use which meet all of the following standards: The change will not cause negative impacts on pedestrian and vehicular traffic circulation, parking or noise. Staff F The amendment will decrease the demand for parking and should not affect traffic and pedestrian circulation. The change will not substantially affect the tourist or local orientation of the conditional use. Staff Finding: The use remains the same and does not substantially change the nature of the use. The change will not affect the character of the neighborhood in which the use is located. Staff Finding_ The change should improve the visual character of the neighborhood by providing more open space. The change will not increase the use's employee base or the retail square footage in the structure. Staff Finding; The change reduces the use's employee generation. The project does not have a retail component The change will not substantially alter the external visual appearance of the building or its site. Staff Finding: The visual appearance will change. The middle units will be further from the street than originally approved and lower in elevation. The HPC reviewed this change and considered the changes preferable. Insubstantial Amendment to GMQS Development Order Any request to change an element of a development order or any substantial change to a condition or representation of an original development order shall constitute a development order amendment. A development order approving a development allotment pursuant to the requirements of this chapter shall only be amended pursuant to the following provisions. The following activities shall be exempt from these development order amendment procedures, provided they are reviewed and approved by the Community Development Director prior to construction: any change required to be made to a development order to respond to conditions imposed upon the proposed development by the Growth Management Commission or the City Council during the review of other development applications relevant to the proposed development. Staff Finding_ This change is not in response to a condition of approval. any insubstantial modification to the development order, which shall be limited to technical or engineering considerations first discovered during actual development that could not reasonably be anticipated during the review process, or any other minor change that the Community Development Director finds has no effect on the conditions and representations made during the original project review. Staff Finding_ The change represents a minor change which reduces the general impacts of the development and improves the aesthetics of the project. The change would not be in conflict with the conditions of approval as originally granted.
