HomeMy WebLinkAboutresolution.hpc.016-2011 A RESOLUTION OF THE ASPEN HISTORIC PRESERVATION COMMISSION RECOMMENDING THE ASPEN CITY COUNCIL GRANT CONCEPTUAL MAJOR DEVELOPMENT PLAN REVIEW FOR HISTORIC PROPERTIES AND CONCEPTUAL COMMERCIAL DESIGN REVIEW OF THE PROPERTIES LOCATED AT 517 EAST HYMAN AVENUE, 521 EAST HYMAN AVENUE, AND THE PARKING LOT ON THE CORNER OF HUNTER AND HYMAN STREETS, LEGALLY DESCRIBED AS LOTS E - I, BLOCK 95, INCLUDING UNITS 1, 2 AND THE COMMON AREA OF THE BENTON BUILDING CONDOMIUMUMS, CITY AND TOWNSITE OF ASPEN, COLORADO, CITY AND TOWNSITE OF ASPEN, COLORADO. RESOLUTION # 16, SERIES OF 2011 PARCEL ID: 2737 - 182 -54 -001 2737 - 182 -54 -002 2737- 182 -54 -800 2737 - 182 -24 -002 2737- 182 -24 -004 WHEREAS, the applicant, Aspen Core Ventures, LI.C, represented by Stan Clauson Associates, Inc., submitted an application to voluntarily participate in the AspenModern Ninety -Day Negotiation Period for the properties located at 517 East I lyman Avenue (Lot E, Block 95), 521 East Hyman Avenue (Units 1 and 2 of the Benton Building Condominium, aka Lot F, Block 95) and the parking lot located at the southwest corner of Bunter and Hyman Streets; and WHEREAS, the subject properties are located within the designated boundaries of the Commercial Core I listoric District as described in City Council Ordinance number 49, series of 1974; and WHEREAS, the applicant submitted a letter dated November 29, 2011 requesting that the property be added to the AspenModern map and requesting voluntary designation in exchange for specific benetits through the AspenModern negotiation; and WHEREAS, pursuant to Aspen Land Use Code §26.415.025.C(1) the Ninety -Day AspenModern negotiation commenced on November 29, 2011; and WHEREAS, pursuant to Aspen Land Use Code §26.415.025.C(1)(b) the Community Development Department conferred with the Historic Preservation Commission, at a duly noticed public hearing on December 14, 2011, continued from December 7, 2011, to discuss the proposed land use application and nature of the property and to provide City Council with a recommendation regarding Conceptual Commercial Design Review and Conceptual Major Development Plan Review for Historic Properties and Landmark Designation, WHEREAS, at their regular meeting on December 14, 2011 continued from December 7, 2011 the Historic Preservation Commission considered the application during a duly noticed public 517 and 521 E. Hyman Ave. RECEPTION #: 585430, 12/28/2011 at AspenModern Recommendation 03:52:14 PM, HPC Resolution 1#16, Series of 2011 1 OF 2, R $16.00 Doc Code RESOLUTION Janice K. Vos Caudill, Pitkin County, CO hearing, the staff memo and recommendation, and public comments, and found the proposal consistent with the review standards by a vote of 4 to 1. NOW, THEREFORE, BE IT RESOLVED: That HPC hereby recommends City Council grant Conceptual Commercial Design Review and Conceptual Major Development Plan Review for Historic Properties for the development proposed at 517 and 521 East layman Avenue, and the parking lot on the corner of Hunter and Hyman Streets, Lots E — 1, Block 95, City and Townsite of Aspen, Colorado with the condition that the applicant continue to study the setback of the third floor closest to the Benton Building (521 East Hyman Avenue).
