RE: Subdivision Exemption - River's Edge
SUMMARY: The applicants, Ralph and Lynne Whipple, seek to
condominiumize their duplex. The applicants have submitted a
condominium plat for review and recordation.
LOCATION: 855 and 851 Gibson Avenue, Aspen
PROPOSAL: To condominiumize a new duplex. The applicants received
a conditional use approval for the inclusion of an accessory
dwelling unit.
STAFF COMMENTS: Pursuant to Section 24-7-1007, which was recently
amended in 1993, the applicant shall submit a condominium
subdivision exemption plat to the Planning Director for review.
The Engineering Department and Planning staff have reviewed the
submitted plat.
RECOMMENDATION: Staff recommends approval of the subdivision
exemption to condominiumize the new duplex at 855 and 851 Gibson
Avenue with the following conditions of approval:
1. The condominium plat shall indicate the floor plan of the
approved 600 square foot one -bedroom accessory dwelling unit and
note the book and page for the recorded deed restriction on the
plat.
2. The applicant shall revise the plat to include accurate
dimensions for all lines, angles, and curves used to describe
patios, steps, window wells, roof extensions, driveways and
setbacks.
3. The plat shall be recorded within 180 days of Planning Director
approval.
4. The applicant shall comply with all agreements entered into
during the plan review process including the sidewalk, curb, and
gutter agreement.

APPLICATION FOR SUBDIVISION EXEMPTION
AND CONDOMINIUMIZATION OF EXISTING RESIDENTIAL UNITS
FOR PROPOSED RIVERS EDGE CONDOMINIUMS
This Application is for subdivision exemption for the
condominiumization of existing residential units pursuant to the
Aspen Land Use Code, Section 7-1007, as amended by Ordinance No.
53, Series of 1993. The property consists of an existing
residential duplex. The property is zoned R-15 (see Ordinance No.
52, series of 1992) and a duplex is a permitted use. The
Applicants have received a building permit and are in the process
of completing construction of the duplex.
The Applicants, Ralph U. Whipple and Lynne C. Whipple, are
residents and employees of Pitkin County, Colorado.
I. MINIMUM SUBMISSION CONTENTS FOR ALL DEVELOPMENT
APPLICATIONS.
This portion of the Application demonstrates compliance
with the Minimum Submission Contents.
SUBMISSION: The Applicants' names, address and telephone
number, contained within the letter signed by the Applicants
stating the name, address and telephone number of the
representative authorized to act on behalf of the Applicants.
RESPONSE: See Exhibit 1 enclosed with this Application
consisting of the Authorization of Owner for Representative.
SUBMISSION: The street address and legal description of
the parcel on which the development is proposed to occur.
RESPONSE: The street address of the property is 855 and
851 Gibson Avenue, Aspen, Pitkin County, Colorado 81611. The legal
description of the parcel is set forth in Exhibit 2 to this
Application.
SUBMISSION: A disclosure of ownership of the parcel on
which the development is proposed to occur consisting of a current
certificate from a title insurance company or attorney licensed to
practice in the State of Colorado listing the names of all owners
of the property and all mortgages, liens, easements, contracts, and
agreements affecting the parcel and demonstrating the owner's right
to apply for the development application.
RESPONSE: The disclosure of ownership and description of
encumbrances of the parcel is set forth on the Certificate of Title
signed by a licensed attorney attached as Exhibit 3.
SUBMISSION: An 8 1/2" x 11" vicinity map locating the
subject parcel within the City of Aspen.

This letter is to certify that Ralph U. Whipple and Lynne C.
Whipple are the record owners of the property known as 855 and 851
Gibson Avenue, Aspen, Pitkin County, Colorado, and more
