RE: Wheeler Square Subdivision Exemption for Condominiumization
DATE: November 19, 1996
SUMMARY: The applicant requests Subdivision Exemption to condominiumize the existing 14
commercial units in the Wheeler Square building.
APPLICANT: Aspen Arcade Limited, represented by Kaufman & Peterson
LOCATION: 315 E. Hyman Ave.; Lots E, F and G, Block 82, City and Townsite of Aspen
ZONING: CC, Commercial Core
LOT SIZE: 9,048 sf
REFERRAL COMMENTS: Comments from the Engineering Department are attached as Exhibit B.
The plat shall be modified as noted in Chuck Roth's comments dated November 18, 1996.
STAFF COMMENTS: Pursuant to Section 26.88.070 of the Aspen Municipal Code, to convert an
existing development to a condominium form of ownership, a condominium subdivision exemption plat
shall be submitted to the Community Development Director for review and approval. Staff has reviewed
the plat and finds that it complies with the standards of the Code.
RECOMMENDATION: Staff recommends approval of the Wheeler Square Subdivision Exemption
for Condominiumization, subject to the following conditions:
1. The applicant shall adhere to all representations made in the application as conditions of approval.
2. The condominium plat shall be reviewed and approved by the City Engineer and the Community
Development Director prior to recordation. The approved plat shall be recorded in the office of the
Pitkin County Clerk and Recorder within 180 days of its approval by the Community Development
Director. Failure on the part of the applicant to record the plat within 180 days following approval
by the Director shall render the plat invalid and a new application and approval will be required. The
plat shall also be submitted in a digital format acceptable to the Community Development
Department for incorporation into the City /County GIS system.
3. The condominium plat shall be revised as required by Chuck Roth in his referral memo dated
November 18, 1996.

Re: Wheeler Square Condominiumization
Having reviewed the above referenced application, and having made a site inspection, the
Engineering Department has the following comments:
1. There are two areas that are identified as general common elements which do not appear to be
on the applicant's property. The property lines are not clearly indicated on all four boundaries.
a. There are three planters long Hyman Avenue that extend into the public right -of -way and
that are identified in the plat legend as being general common elements. Adjacent property
owners do not possess ownership of rights -of -way although maintenance obligations are in
effect through City ordinances. This must be corrected on the plat.
b. There is a space along the easterly boundary that appears to be on adjacent private
property, the Aspen Commercial Condominiums, that is labeled G.C.E.
2. Plat certificates
a. Change "Planning Department" approval certificate to read "Community Development
Director."
b. Add two approval certificates, one for the Water Superintendent and one for the Aspen
Consolidated Sanitation District. This is necessary because when structures change from
single ownership to multiple private ownerships, operational difficulties arise for both these
utilities. The difficulties must be addressed either by construction of such facilities as

additional service lines or additional metering or by clauses in condominium declarations,
covenants, or other agreements with the individual utility.
c. Revise owner's certificate to delete reference to Council approval. Condominiumizations
are not approved by Council.
d. Include statement in surveyor's certificate or in general note addressing the applicability
of Colorado Common Interest Ownership Act state law to the condominiumization and the
compliance of the plat with CCIOA.
3. There are two encroachments in the public right -of -way which must be removed or licensed
prior to signing the plat. One is a gas meter, the other a fence.
4. Additional plat content requirements areas follows:
Vicinity map; zone designation; surveyor to complete title policy number and date; written
survey description of the area; utilities in adjacent rights -of -way; water shut -off valve box;
utility meter locations; date survey performed.
5. Show drainage improvements. Is there a drywell that is accessed in a general common element
space in the basement?
