DATE: December 4, 1995
SUMMARY: The applicant, Le Gourmet, represented by Dan Martineau, seeks to increase the restaurant's
storage square footage by approximately sixty (60) square feet. There is no increase in FAR because the
storage area is being constructed in a mezzanine above a walk -in freezer.
ZONING: NC - SPA
STAFF COMMENTS: Pursuant to Section 24 -8 -104 A.1.(a) (and Ordinance 1) the Planning Director
may exempt the expansion of commercial or office space if the project does not expand commercial or
office floor area or create additional dwelling, hotel or lodge units or involve a change of use. No new net
leasable is added.
The applicant wishes to construct additional storage space above a walk in freezer. The entire net- leasable
space is approximately 750 square feet, and will not change with the additional storage space of
approximately square feet. The additional storage space would be approximately 60 square feet.
RECOMMENDATION: Staff recommends approval of the GMQS Exemption for the additional storage
space with the following conditions:
1. Prior to issuance of a Certificate of Occupancy, an inspection of the expansion and converted non -
net leasable storage space shall be conducted to confirm no new leasable space has been added to
the building.
2. All representations of the applicant as depicted on the plans submitted with the application are
considered conditions of approval.
3. Prior to the issuance any building permits, plans shall be reviewed for zoning compliance.

Minimum Submission Contents for all Development Applications
All development applications shall include, at a minimum, the following
information and materials:
1. The applicant's name, address and telephone number, contained
within a letter signed by the applicant stating the name, address
and telephone number of the representative authorize to act on

To Whom It May Concern;
(1) The building known as North Mill Station, located at the
southwest corner of South Mill and Puppy Smith Streets in Aspen,
Colorado is owned by Trueman Aspen Co., an Ohio limited
partnership (the "Landlord ") having an address of Box 5081 in
Aspen. The commercial space known as #211A in North Mill Station
(the "Premises ") has been leased to Le Petit Marche LLC (the
"Tenant ") a Colorado limited liability company.
(2) The Tenant has the permission of the Landlord to construct a
mezzanine for storage space in the southeast corner of the
Premises in accordance with plans and specifications approved by
the City of Aspen.
