The two conditions required of their decision are: 1. Any trees along the west bank which die within one year of excavation along the pavement edge must be replaced one for one with 1.5" caliper trees of similar species. 2. The fence surrounding the regulator must be made of wood or surfaced in wood. Plain chain link is not acceptable. I hope this letter will suffice as verification of the approval. I'll be working on a resolution which will be presented to the Commission Chair for his signature at the next meeting in a few weeks. If I can be of further help, please give me a call at 920 -5090. APPLICANT: Rocky Mountain Natural Gas (Dallies Krohe) LOCATION: Power Plant Road, under Hwy. 82 bridge, across Castle Creek ZONING: R -15, R -15A, and R -30 APPLICANT'S PROPOSAL: Rocky Mountain Natural Gas seeks Stream Margin Review approval in order to bury a four inch steel natural gas pipeline under Castle Creek near the City Shop. In addition, a regulator station will be added next to an existing city garage building south of the highway bridge adjacent to a steep hillside. This station requires land area of 8'x8'. See Attachment "A" for site plan and application. REFERRAL COMMENTS: Engineering, Parks, and Street Departments have reviewed the proposal and approve it. See Attachment "B ". STAFF COMMENTS: Under their franchise agreement, the gas company is allowed to use City rights -of -way. Part of this project takes place within the right -of -way of Power Plant Road. The line will also cross private property for which the owner has granted an easement. Any proposed development within 100' of the high water line or within a flood hazard area must receive Stream Margin approval. Stream Margin applications are reviewed by the Planning and Zoning Commission according to the standards set forth in Section 7 -504 of the Aspen Land Use Code (August 1989): 1. It can be demonstrated that any proposed development which is in the Special Flood Hazard Area will not increase the base flood elevation on the parcel proposed for development. This shall be demonstrated by an engineering study prepared by a professional engineer registered to practice in the State of Colorado which shows that the base flood elevation will not be raised, including, but not limited to, proposing mitigation techniques on or off -site which compensate for any base flood elevation increase caused by the development. response: The pipeline will be buried and backfilled level with existing grades, so no increase in flood elevation will result. 2. Any trail on the parcel designated on the Aspen Area Comprehensive Plan: Parks /Recreation /Open Space /Trails Plan map is dedicated for public use. response: Trails requirements are not applicable because of the nature of this project. 3. The recommendations of the Roaring Fork Greenway Plan are implemented in the proposed plan for development, to the greatest extent practicable. response: The applicant will take all practical measures to minimize disturbance to the land and will revegetate as needed. The land will otherwise remain in as natural a condition as currently exists. 4. No vegetation is removed or slope grade changes made that produce erosion and sedimentation of the stream bank. response: The slope will be replaced to original conformation after the line is installed. There is little vegetation in the immediate area of the river crossing. However, many small to medium trees line the bank along the proposed line route underneath the bridge and toward the regulator site. These trees add to the bank's stability and the excavation should be made as far as possible from the root area. 5. To the greatest extent practicable, the proposed development reduces pollution and interference with the natural changes of the river, stream or other tributary. response: The river course will not be altered. 6. Written notice is given to the Colorado Water Conservation Board prior to any alteration or relocation of a water course, and a copy of said notice is submitted to the Federal Emergency Management Agency. response: Not applicable. 7. A guarantee is provided in the event a water course is altered or relocated, that applies to the developer and his heirs, successors and assigns that ensures that the flood carrying capacity on the parcel is not diminished. response: Not applicable. 8. Copies are provided of all necessary federal and state permits relating to work within the one hundred (100) year floodplain. response: The Army Corps of Engineers has authorized this project under a nationwide permit and the applicant included it in the application packet.. The State Highway Department has been contacted for permission to work in their right -of -way. STAFF RECOMMENDATION: The Planning Office recommends approval of this Stream Margin Review with one condition: 1. The applicant is Rocky Mountain Natural Gas Division of K N Energy, Inc. and the authorized representative is James L. Krohe. Both are located at 401 27th Street, Glenwood Springs, Colorado. The proposed development does not have a street address of its own. We are planning to install a buried natural gas pipeline within the right of way of Power Plant Road, then across Castle Creek into Harbour Lane and back to Power Plant Road. See the attached map for the location of the pipeline. Part of the route is owned by the city of Aspen (Power Plant Road). We are allowed the use of the city streets under our franchise. The other part of the route is on Parcel 2, Herndon Subdivision. Please see the attached easement granted by the owners of the said Parcel 2 for authorization to use said property. We feel this stream margin review should be approved. The project consists of a buried pipeline within city right of way and on one private property. There will also be an above - ground regulator station located beside an existing garage on city property. This station will require an 8'X8' piece of property. All construction will be within a previously disturbed area. No vegetation will be removed except for a little grass. All of the route, except for the stream crossing and the regulator station, will be within existing right -of -way or access roads and the proposed creek crossing location currently consists of dirt and rocks. The proposed method of construction is with a back hoe. A bucket width trench will be dug, the pipe put in the trench and then backfill the trench. The ground contours will be left virtually the same as before the pipeline installation. Grass seed will be sown on the bank of Castle Creek where there was some grass existing prior to construction. This project will not cause an increase in the base flood elevation of the area. This pipeline will be buried. The surface should look almost exactly as it does now upon completion of the project. We do not own any property and thus can not dedicate any trails in the subject area. No vegetation will be removed and no slope grade changes will be made. Please see the attached photos that show what the current surface area looks like. The pipeline route is marked in black pen. The proposed development will not interfere with the natural changes of the stream. The trench will only be a backhoe width wide. The pipeline will be buried with river weights attached to keep the pipeline from surfacing. Please see the attached letter from the Corps. of Engineers giving us approval to make the crossing. Our company is covered by a nationwide permit that allows us to make stream crossings. We have also applied for a permit from the Colorado Department of Highways to allow us to work within their right -of -way. Colorado. The Department of the Army, Corps of Engineers, has issued a nationwide general permit which authorizes the discharge of material for backfill or bedding of utility lines provided there is not any change in preconstruction bottom contours (excess material must be removed to an upland disposal area). We have determined that your project is authorized by this nationwide general permit NWP12 (copy enclosed) provided you comply with the attached special conditions and management practices. This verification is valid until the nationwide permit is modified, reissued. or revoked. All the nationwide permits are scheduled to be modified, reissued, or revoked prior to 13 January 1992. It is incumbent upon you to remain informed of the changes to the nationwide permits. We will issue a public notice announcing the changes when they occur. Nationwide permits are designed to allow the work to occur with little delay or paperwork. An individual permit application is not required for an activity covered by a nationwide permit. • The Corps of Engineers has issued a nationwide permit for the discharge of material for backfill or bedding for utility lines, including outfall and intake structures, provided that there is no change in preconstruetion bottom contours (excess material must be removed to an upland disposal area).
