1. Vegetation shall not be removed nor any slope grade changes made that
may produce erosion of the stream bank.
2. There shall be permitted no changes to the stream channel or its capacity,
and no acj'tivity shall be allowed which will increase stream sedimenta-
tion and suspension loads.
3. All efforts must be made to reduce stream pollution and interference
with the natural changes of the stream, and to enhance the value of the
stream as an important natural feature.

Request: This application requests co of stream margin re-
view pursuant to Section 24 -6.3 of the Aspen Municipal Code.
Engineering
Department: No objections to the proposal expansion to the Gruenberg re-
stden`ce. Due care should be taken to insure that building
materials and any excessive excavation is prevented from
polluting the river.
Building
Department: Comments from the Building Department were not available at the
writing of this memorandum. Comments will be made at the
Planning and Zoning meeting.
Planning Office: This application has been evaluated with the review criteria for_,
stream -- margin review and no problertp have been identified (see
criteria below). The entire house is currently situated within
the 100 foot stream margin review line. The mjor additions
proposed for this one -story house are oriented away from the
river which should have less environmental 'impact ` to river
during construction.
to Review criteria. In reviewing the development plan
the zoning commission shall consider the following guide-
lines and standards, and impose the following conditions for
permit approval:
(1) No building shall be located so as to be within a flood
hazard area designated by the U.S. Corps of
Engineers Flood Plain Report for the Roaring Fork
River.
(2) In the event there is a trail designated by an approved
trail plan within the development site, such trail shall
be dedicated for public use.
(3) All attempts should be made to implement the
recommendations of the Roaring Fork Greenway Plan
prepared by the Roaring Fork Greenway Committee.
(4) Vegetation shall not be removed nor any slope grade

Dear Sunny,
Pursuant to our telephone conversation of today,
I write this letter to confirm my understanding of the
time that a stream margin review approval by the Planning
and Zoning Commission is valid.
It is my understanding that as long as my clients
do not materially change the plans that were approved by
the P & Z, their stream margin review would be valid
indefinitely and at the very least until next summer
when they intend to build.
If you have any problems with this interpretation, please
let me know. Otherwise, I will advise my clients accordingly.

Dear Sunny,
Please consider this letter an application for a stream
margin review pursuant to §24 -6.3 of the Aspen Municipal
Code. The Code provides that all land and air space within
one hundred feet (100') measured horizontally from the high
water line of the Roaring Fork River and tributary streams
shall go through a stream margin review prior to the issuance
of a building permit.
My clients have an existing structure within one hundred
feet (100') of the river. Their children are growing and
they need to expand their existing residence. The contemplated
renovations will all take place away from the river as is
indicated on the map and plans being submitted with this
application. It is important to note we have an existing
structure and my clients, sensitive to the intent of stream
margin review, have planned all additions away from the
river. Their new construction will not contravene the
intent of the stream margin review as set forth in §24 -6.3.
It is most important my clients receive approval for these
expansions; otherwise they will be forced to sell their
residence and move to a new house which would clearly be
an unwarranted hardship.
An examination of stream margin review and the history
surrounding it clearly shows the Planning and Zoning Commission
has discretion, under the intent of §24 -6.3, to grant a
building permit for my clients. I believe this application
meets the standards of the criteria set forth under the
review criteria for stream margin review.

Aspen. This item is being scheduled for review by the Aspen Planning and
