Ozzie's Shoe Store subject to the following conditions:
1. The sidewalk planter and planting strip shall meet the
approval of the Commercial Core and Lodging Commission
prior to issuance of a building permit and shall be
completed prior to issuance of a Certificate of
Occupancy. The applicant shall maintain the planter •
and planting strip and the trees to be placed in the
planting strip by the City.
2. Encroachment of steps shall not exceed 18" into the
public right -of -way and shall be subject to approval by
City Council.
3. A handicap ramp shall be provided if recommended by the
Building Inspector and Handicap Access Board.

MEMORANDUM

RE: Ozzie's Shoes Commercial GMP Exemption

APPLICANTS: Bob and Kath Zupancus
LOCATION: Portions of Lots K, L and M, Block 100, Townsite and
City of Aspen, 312 S. Hunter Street.
ZONING: C -1 Commercial
APPLICANT'S REQUEST: The applicant would like to remove the
existing porch and lattice work and install display windows in
the front of Ozzie's Shoe Store, adding 164 square feet of
commercial space.
APPLICABLE SECTION OF MUNICIPAL CODE: Section 24- 11.2(h) of the
Municipal Code requires a Planning and Zoning Commission special
review for approval of minor commercial expansions exempt from
Growth Management Quota System competition. In granting approval
P &Z is required to make a determination that there will be
"minimal or manageable impact on the community, considering but
not limited to findings that a minimal number of additional
employees will be generated by the expansion or the applicant
will provide additional employee housing; that a minimal amount
of additional parking demand will be created or that parking can
been accommodated on site; that there will be minimal visual
impact on the neighborhood due to the project; and that minimal
new demand is placed on services available at the site such as
water, sewer, drainage and fire protection."
PROBLEM DISCUSSION:
A. Referral Comments:
1. Engineering Department: The following comments were
made in Elyse Elliott's April 16, 1987 memorandum:
a. The expansion will not effect the traffic in the
vicinity, nor will it effect an increase in utility
usage.
b. Removal of the plant boxes will have a very minimal
impact on the site runoff, not requiring modifications
to the proposal.
c. The Engineering Department does not see why the
stairs cannot be contained within Ozzie's property. If
this design is approved, an Encroachment License will
also be required.
d. Since the steps are being reconstructed, a handicap
access ramp should be included.
e. The proposed treatment for the sidewalk is not
specified. It must comply with the City's Streetscape
Guidelines and should be approved by CCLC. An excavat-
ion permit will be required for any work in the right -
of -way, including pedestrian barricades during con-
struction.
2. Parks Department: Parks Director Bill Ness stated in a
conversation on April 17, 1987 that the City will plant at
its expense two trees in a planting strip in front of
Ozzie's as part of the downtown street improvement program.
The applicant must take responsibility for maintenance of
these trees.
B. Staff comments: The Planning Office notes that a portion of
the porch area in front of Ozzie's qualifies as open space ( "open
to the sky "). Consequently, construction to the property line,
as first proposed, would reduce required open space that is
already non - conforming. As a result, the proposal has been
modified to bring the bay windows out only to the edge of the
roof overhang. A low planter would be placed within the open
space.
The issue of the handicap ramp has not been solved as of the time
of writing. We recommend that the Building Inspector and
Handicap Access Board's recommendation on this matter be follow-
ed. It will be presented to you at your meeting.
The encroachment of new stairs is shown on the original drawing
to go out 3 feet into city right -of -way. Along with the Enginee-
ring Department, we do not see the need for this full encroach-
ment. Given a new setback of the bay window, we anticipate that
no encroachment will be proposed. An encroachment under 18 ";
provided that a 8' wide sidewalk can be built, is acceptable to
staff.
The proposed new glass and wood facade of Ozzie's should be
complimentary to the storefront proportions of the approved
Hunter Plaza Building planned for next door. Visual impacts of
the proposal are acceptable, in staff's opinion, although the
open character of Ozzie's lattice work will be lost.
The applicant has stated no new employees will result, nor are
additional parking needs anticipated. Staff concurs with this
assessment of impacts.
The provision of a planter on Ozzie's property, re -doing the
sidewalk to allow better pedestrian circulation on Hunter Street,
and providing a 3' wide planting strip will benefit the neighbor-
hood in our opinion, and provide other reasons to support this
request.
RECOMMENDATION: The Planning Office recommends approval of the
requested GMP exemption for a minor commercial expansion of
Ozzie's Shoe Store subject to the following conditions:
1. The sidewalk planter and planting strip shall meet the

The Engineering Department has the following comments on the
above application:

stairs to project into the sidewalk right -of -way. We do not see
why the stairs cannot be contained within Ozzies property. if
the variance is granted, an Encroachment License will also be
required.

should be included. The Building Department has the specifi-
cations for this.
The application does not state the proposed treatment for the
sidewalk. The plan must comply with the City's Streetscape

RE: DISPLAY WINDOW EXPANSION TO OZZIES SHOES STORE FRONT
Dear Steve,
We are proposing to remove the existing porch and lattice
work from the front of Ozzies Shoes building and install display
windows with an overhead facade. The existing porch is built
to the property line and we would like to build the new display
window area to this line.
The existing planters would also be removed, allowing the
sidewalk to open. Although we are not providing a designated
open space area, we are providing a better circulation pattern
in front of the building than exists now and allowing for a
12'8" sidewalk width. Our stairs do project into this width
and we are prepared to apply for a city variance for this. The
stairs project 3' from the front of the building leaving 9'8"
to the road edge. The City requires an 8' sidewalk allowance.
Our plan adds 164 square feet of additional F.A.R. to the
Ozzies' building, within the property lines and visually not to
the extent of the existing lattice, porch and planters. We plan
to follow the design direction of the new building going in on the
corner of Hunter and Cooper Streets to allow for a sense of
continuity on the Hunter Street elevation.
The facade portion of our expansion would be built of wood
and faced with either brick to match the corner building or wood
painted with colour coordination to the new building. We want
to retain our individuality but still relate to the new
buildings.

OZZIES SHOES EXPANSION
Our expansion does not require any additional employees
or change the use of Ozzies Shoes. We will operate in the same
manner as before but with an updated display area. Our shop
location is within the C -1 district for city street parking and
we do not anticipate any additional task on this from our
previous requirements.
The 'MAZA' building on the corner of Hunter and Cooper Streets
is set for demolition and re- construction starting the 01 May 1987
and we would like to start our removal and installation at the
same time. If this schedule can be met, we hope to be completed
with our expansion and open for business at the beginning of
summer.

BUILT THIS SUMMER ON THE 'MAZA' PROPERTY ON THE CORNER OF
HUNTER AND COOPER STREETS. WE HAVE TAKEN THEIR BALCONY LINE
AND FOLLOWED THAT THROUGH TO OUR FACADE LINE, CONTINUING THE
HEIGHT AND WIDTH. OUR MATERIALS ARE TO BE WOOD AND TEMPERED
GLASS. THE WOOD FACADE WILL HAVE A BUILT UP CORNICE AND BE
PAINTED. THE BASE WILL ALSO BE BUILT IN WOOD AND PAINTED.
WE ARE WAITING TO SEE WHAT COLOURS HAGMAN YAW CHOOSE FOR
THE 'MAZA' BUILDING AND CO-ORDINATE WITH THEM. WE WOULD LIKE
TO RETAIN OUR OWN IDENTITY AND INDIVIDUALITY BUT STILL RELATE
TO THE NEW SURROUNDING BUILDINGS.
THE EXISTING PLANTERS ARE TO BE REMOVED AND NEW SMALL
PLANTERS WILL BE INSTALLED IN OUR OPEN SPACE AREA, IN THE FRONT

WE HAVE MET WITH JIM WILSON OF THE PITKIN COUNTY BUILDING
DEPARTMENT AND WITH TOMMY ISSACS, HANDICAPPED CONSULTANT FOR THE
CITY AND THEY HAVE WAVED THE HANDICAPPED ACCESS RAMP.
THE NEW STEPS TO THE EXISTING ENTRANCE OF OZZIES SHOES
WILL ENCROACH THE CITY'S EASEMENT BY 1'6 ". WE FEEL THIS IS
NECESSARY TO PROVIDE A LARGE ENOUGH LANDING AT THE DOOR FOR
CIRCULATION IN AND OUT OF OZZIES. WE ARE STILL PROVIDING AND
8'0" SIDEWALK FROM THE LAST STEP TO THE TREE AREA. WE WILL BE
APPLYING FOR AN ENCROACHMENT VARIANCE FOR THIS.
OUR EXPANSION DOES NOT REQUIRE ANY ADDITIONAL EMPLOYEES
OR CHANGE THE USE OF OZZIES SHOES. WE WILL OPERATE IN THE SAME
MANNER AS BEFORE BUT WITH AN UPDATED DISPLAY AREA. OUR SHOP
LOCATION IS WITHIN THE C -1 DISTRICT FOR CITY STREET PARKING
AND WE DO NOT ANTICIPATE ANY ADDITIONAL TASK ON THIS
