Regular Meeting Aspen Planning & Zoning July 17, 1973
(9) Willard Clapper not satisfied about cut at
bridge - feel Mr. Clapper should comment.

Bay Street Estates, Ms. Baer stated that the Planning Office is satin_

Stream Margin
Requests Vice Chairman stated that he was concerned with
J any density which would effect the balance of the
greenway. Felt the increased density would affect
the river.
Jack Jenkins stated that if all the lots were de-
veloped to that extent, the area would be unlivable.
Should be looking at the long -term solution for
that area.
Area resident George Mansfield stated that there
are increased problems with parking and density
with duplexes. Did not feel the problem would
be as great with single-family dwellings.
Developer of Bay Street Estates pointed out that
this would not be a typical duplex. There would
be separate ownership for each side of the duplex.
At this point, Miller's attorney stated that they
were just to be discussing the stream margin re-
quest at this meeting.
Remo Lavagnino, another area resident, stated that
he felt that the building of these duplexes would
affect the stream margin request on the grounds of
increased density. Felt it would affect the stream's
important natural feature.
It was pointed out that the Commission has 30 days
to make their decision. Commission agreed to table
this discussion until Thursday, July 19th. Would
act on the requests at that time.
As there was no further discussion, Barbara Lewis
moved that the meeting be adjourned, seconded by
Bryan Johnson. All in favor, meeting adjourned
at 7:15 p.m.

Continued Meeting _ Aspen Plannin & Zoning July 19, 1973
Meeting was called to order by Vice Chairman Bruce Gillis at 5:15 p.m. with
Barbara Lewis, Charles Vidal, Bryan Johnson, and Jack Jenkins. Also prescit
City /County Planner Herb Bartel and Assi.stant Planner Donna Baer.
Stream Margin Vice Chairman Gillis stated that the Commission
Request - members had taken a field trip to the site of
Jack Miller the project. Expressed the regret of the Com-
V mission, but felt they must approve Miller's
stream margin request.
Miller stated that he felt the building would
be a credit to the area, and he would be willing
to participate in street widening when and if it
became necessary.

The conditions for the approval were: (1) that
the building would be set back a minimum of 25'
from the bank; (2) no foliage would be removed.
At this time, Remo Lavagnino, area resident who
had opposed the stream margin request, expressed
his thanks to the Commission for their consider-
ation on the matter.
Commission agreed to hold a public hearing on
the rezoning of the Oklahoma Flats area to R -15.
Stream Margin Commission agreed tlat based on observations from
Request - their field trip to the site of the project:
Bay Street (1) there would be no damage to the stream;
Estates (2) building would be set back 30' from the
high water mark.
Herb Bartel reported that the building would
not be located in the flood plain area.
Bryan Johnson moved to approve the stream margin
request, seconded by Jack Jenkins. All in favor,
motion carried.
Discussion followed on the process the Commission
wished to follow for Ordinance # #19. Commission
agreed to adjourn into study session.
Barbara Lewis moved to adjourn the meeting, secon-
ded by Jenkins. All in favor, motion carried.

Lavagnino stated that the road was narrow at the
entrance to Oklahoma Flats, and that snowplows have
trouble with access. Felt there would be more pro-
blem with safety and congestion.
Jenkins felt there would be problems with density,
access, and fire.

Commission agreed to continue the public hearing
on tie Bay Street Estates on July 17th.
J Jack Miller - Ms. Baer explained that because of Miller's proximity
Stream Margin to the site of the Bay Street Estates, the same Corps
Request of Engineers Report applies. .
Commission agreed to take a field trip to this site
on July .11th.
Bruce Gillis stated that he would like to get the
opinion of the City Attorney on the question of
building duplexes in this area.
Commission agreed to table Miller's Stream Margin
Request. .
DFM Subdivision - Developer submitted a model of the project, a :id pointec
Preliminary Plat out that they had moved the building 16' closer to
Alternatives Original.
City Engineer Ellis stated that he felt the 16'
dedication should come at this time.
Developer pointed out that in the original plan, they
had allowed for a 32' wide green belt. With the
alternative plan, the green belt is narrower and
the use of the alley is restricted.
Jack Jenkins moved to approve the preliminary plat
under the previous conditions. Seconded by Lewis.
All in favor, motion carried.
Barbara Lewis moved to adjourn the meeting, seconded
by Johnson. All in favor, motion carried. Meeting
adjourned at 7:15 p.m.

Dear Mr. Miller:
Enclosed is an agreement on which we would like
your notarized signature prior to issuance of a building
permit for your duplex on Oklahoma Flats.
We are, naturally, concerned about avoidance of
subdivision regulation when there is a possibility of
condominiumizing a structure by filing of a plat with-
out our involvement. Consequently, we would like your
agreement to guarantee against condominiumizing without
application of and compliance with our subdivision
regulations, in the event condominium interests are sold.
Please sign the enclosed and return it with your
signature notarized, to me at: P.O. Box V, Aspen,
Colorado.

STIPULATION
WHEREAS, Jack Miller (hereinafter called "applicant')
is the owner of certain real property located within
Pitkin County, Colorado, more specifically described as:
All of lots 7, 8 and 9
Oklahoma Flats
City of Aspen, Colorado, and
WHEREAS, the applicant has applied to the City of
Aspen for a building permit for the purpose of constructing
thereon a residential duplex building which is a permitted
use thereof, and
WHEREAS, the applicant has not applied for subdivision
approval nor complied with the subdivision regulations of
Chapter 20 of the Aspen Municipal Code and amendments
thereto, and
WHEREAS, Section 20 -2(a) of such code, as amended,
defines subdivision as a tract of land which has been div-
ided into two (2) or more lots, tracts, parcels, sites,
separate interests (including leasehold interests), interests
in common, condominium interests or other divisions for the
purpose, whether immediate or future, of transfer of owner-
ship, and
WHEREAS, Section 20 -3(a) of such code, as amended,
further provides that it shall be unlawful for any person,
firm, or corporation to sell or lease any lot, tract,
parcel, site, separate interest (including leasehold interest),
interest in common or condominium interest until a subdivision
has been approved in writing by the City Council and a plat
thereof recorded in the office of the Pitkin County Recorder,
and
WHEREAS, the City of Aspen is desirous of processing
the applicant's assurances that no condominium, or other
subdivision interest, will be transferred without application
and approval under the subdivision regulations of the City
of Aspen.
NOW, THEREFORE, IT IS AGREED AND STIPULATED BY THE
APPLICANT that no transfer, sale, lease, or agreement to
.lease any interest in the above described real property
will be made by the applicant in derogation of the sub-
division regulations of the City of Aspen without full com-
pliance with Chapter 20 of the Municipal Code and full
approval of the City Council as required therein.
Applicant further agrees that this stipulation and
agreement shall be a covenant running with the land, and
shall bind himself, his heirs, successors and assigns.

There being no further comments, Vice Chairman Gillis
/ closed the public hearing.
/ Bay Street Estates - Vice Chairman Gillis opened the public hearing on the
VVV Preliminary Plat Preliminary Plat for the Bay Street Estates.
Donna Baer stated that this was also a stream margin
request.
•
Developer stated they wanted to build a Victorian-
style duplex, 1600 square feet /unit, 25' high. It
would be permanenthousing with separate ownership.
City Engineer David Ellis submitted the following
recommendations to the Commission:
1) The major problem of the area is the inadequate
existing right -of -way. Dedication of land to
provide for a 60' wide right -of -way will be
required; this will amount to a strip approxi-
mately 20' in width along the frontage.
2) The subdivider should be required to enter into
a covenant running with thrland to join any
future storm drainage district or street im-
provement district, including paving, sidewalks,
and curb and gutter.
_ 3) The building design and /or site plan should
incorporate the capability for storm water
• retention.
4) The landscaping plan should essentially be the
protection of existing trees and shrubs. This
can be provided for on the landscaping notes
included on the plat.
5) Aspen Metropolitan Sanitation District must
be assured an easement for the existing sewer
if they do not already have one. This would
apply to any other existing utilities.
Fire Chief Willard Clapper stated that access is
a problem and there is no turn- around available.
Commission agreed to take a field trip to the site
of the Bay Street Estates on July llth after the
trip to the Villa.
Ms. Baer submitted an engineers' report and stated
that there appeared to be no problem with the stream
margin request.

Remo Lavagnino, a property owner in Oklahoma Flats,
stated that he felt that if the Commission allowed
this exception, they would be undermining the
proposed zoning changes.

This is in reply to your 20 June 1973 request for flood information in
the Aspen area. We are inclosing a preliminary map showing the areal
extent of flooding expected to occur near river mile 45.0. The area
shaded in blue represents an Intermediate Regional Flood (a flood having
a frequency of occurrence of about once in 100 years on the average though
it may occur in any year). The area shaded in red delineates the lateral
limits expected from a Standard Project Flood. A Standard Project Flood is
a much larger but less frequent flood than an Intermediate Regional Flood.
A water surface profile showing the approximate water surface elevations
for these two floods in the area near river mile 45.0 is inclosed. The
above information is based upon the studies made to date in connection
with the Flood Plain Information Report for Aspen. Water surface ele-
vations should be considered preliminary in nature until the report is
published.
We trust the above information will be satisfactory to your present needs.
