ADDENDUM NUMBER 1 THE CHATEAU ROARING FORK DECK REPAIR PROJECT 1039 East Cooper, Aspen, Colorado March 6, 1991 This addendum forms a part of the Contract Documents and modifies the original specifications and drawings dated February 19, 1991 as noted below. The bidder shall acknowledge receipt of this addendum in the space provided on the Bid Form. Failure to do so will subject the Bidder to disqualification. INVITATION TO BID: (1) ADD the following section entitled Project Phasing to read: The Contract is being divided into two phases to allow additional time for securing local, state and federal permits to construct footings and piers in the Roaring Fork River. The work shall be phased as follows: Phase 1 shall include all work as drawn and specified with the exception of work described for Phase 2. Phase 2 shall include all work associated with the North and South Level 1 Decks including deck and handrail demolition, installation of steel tubing, railings, columns, wood decl,ing, piers, footings and associated finish work. Installation of new Level 1 Stairs shall be included in Phase 1 work. (2) CHANGE Commencement and Substantial Completion, paragraphs a) & b) to read: a) The date of commencement of the Contract for Phase 1 shall be the date of signing. The date of commencement of on-site work for Phase 1 shall be April 8, 1991. b) The Contractor shall achieve Substantial Completion of Phase 1 work not later than June 10, 1991. Substantial Completion shall be when construction is sufficiently complete as determined by the Architect, and in accordance with the Contract Documents, so that the Owner can occupy and use the Work for it's intended purpose. (3) ADD Commencement and Substantial Completion, paragraphs c), d) & e) to read: 1 c) The date for commencement of Phase 2 work is subject to receipt of Construction Permits from the Aspen-Pitkin Regional Building Department. Notice to Proceed will be issued as soon as possible following receipt of the permit which is anticipated to be in the Fall of 1991. d) The Contractor shall achieve Substantial Completion of Phase 2 work not later than four weeks or 28 calendar days from date of notice to proceed. e) Penalty/Bonus. The Chateau Roaring Fork is scheduled for full occupancy on June 15, 1991 and it is important to complete Phase 1 of the work before that date. The Owner will pay the Contractor the sum of $250.00 per day for completion(as certified by the Architect) prior to June 10, 1991. Similarly, the Contractor will pay the Owner a penalty for late completion(as certified by the Architect) as follows: $1,120.00 per day from June 11, 1991 thru June 15, 1991 increasing to $2,240 per day from June 16, 1991 until Phase 1 is Substantially Complete. Substantial Completion shall be as defined in paragraph b) above. THE CONTRACT The bidder to whom award is made shall enter into a written contract and furnish Performance and Payment Bonds on the following standard forms: AIA Document A107, Abbreviated Form of Agreement Between Owner and Contractor - 1987 Edition AIA Document A312, Performance Bond and Payment Bond - 1987 Edition , Award of Contract - a) The contract will be awarded as soon as practicable to the lowest responsive bidder, price and other factors considered, provided his bid is reasonable and it is to the interest of the Chateau Roaring Fork. b) The Chateau Roaring Fork reserves the right to waive any informality in bids received when such waiver is to the interest of the Chateau Roaring Fork. c) The Chateau Roaring Fork reserves the right to reject any and all bids when such rejection is in the interest of the Chateau Roaring Fork, to reject the bid of a bidder who has previously failed to perform properly or complete on time contracts of a similar nature; and to reject the bid of a bidder who is not in the opinion of the Chateau Roaring Fork, in a position to perform the contract. Commencement and Substantial Completion (ref. Article 2, AIA Document A107) a) The date of commencement of the contract shall be the date of signing. The date of commencement of on-site work shall be April 1, 1991. b) The Contractor shall achieve Substantial Completion of the entire work not later than June 1, 1991. Substantial Completion shall be when construction is sufficiently complete as determined by the Architect, and in accordance with the Contract Documents, so that the Owner can occupy and use the Work for it's intend purpose. Bidders Representations a) The bidder by making a bid represents that: 1) The bidder has read and understands the Bidding Documents and the bid is made in accordance therewith. 2) The bidder has visited the site, become familiar with local conditions under which the work is to be performed and has correlated the bidder's personal observations with the requirement of the proposed Contract Documents. 3) The bid is based on the materials, equipment and systems required by the bidding documents without exception. Interpretation or Correction of Bidding Documents a) The bidder shall carefully study and compare the Bidding Documents with each other, shall examine the site and local conditions, and shall at once report to the Architect errors, inconsistencies or ambiguities discovered. b) Bidders and Sub-bidders requiring clarification or interpretation of the Bidding Documents shall make a written request to the Architect prior to the date for receipt of bids. c) Interpretations, corrections and changes of the Bidding Documents will be - made by Addendum. Interpretations, corrections and changes of the Bidding Documents made in any other manner will not be binding, and bidders shall not rely upon them. Substituti{ms a) The materials, products and equipment described in the Bidding Documents establish a standard of required function, dimension, appearance and quality to be met by any proposed substitution. b) No substitution will be considered prior to receipt of bids without written request. Such requests shall include the name of the material or equipment for which it is to be substituted and a complete description of the proposed substitution including drawings, performance and test data, and other information necessary for an evaluation. The burden of proof of the merit of the proposed substitution is on the proposer. The Architect's decision of approval or disapproval of a proposed substitution shall be final. c) No substitutions will be considered after the contract award unless specifically provided in the Contract Documents. The 6x12 timber beams supporting the four levels of decks on the east face of Building "A" are overstressed, sagging and in danger of collapse if overloaded. Therefore, the Chateau Roaring Fork has decided to repair the decks on Building "A" by adding structural supports while at the same time undertaking additional aesthetic and building code compliance repairs. DEMOLITION Demolition includes, but is not limited to the following: - all handrails - all steel/concrete stairs(6 each) - wood duckboard on level 4 deck -concrete decking(approx. 3" thick) and building paper on levels 2,3&4 - rotten or damaged 3x6 T&G wood decking on levels 2,3&4 - 6"(approx.) strip of wood decking trimmed off edge of all decks - portion of wood deck on level 1 north(approx. 60 s.f.) - 6"(approx.) trimmed off end of 6x12 beams under all decks - 2x12 wood fascia along east edge of roof - 6"(approx.) wide strip of stucco at base of wall along decks at levels 2,3 & 4 NEW CONSTRUCTION New construction includes, but is not limited to the following: - Structural steel tube beams along the perimeter of all decks. - Structural steel tube columns to support decks. - Steel stairs(6 each). - Steel handrails welded to top of steel tube beams and stair stringers. - Steel guardrails welded to top of handrails(excluding stair rails). - Membrane waterproofing, metal gutter, flashings, and redwood duckboard on deck levels 2,3 & 4. - Electric heat cable in gutter and downspouts at level 4. - Roof fascia along east edge of roof consisting of a prefinished metal covering on new 2x12s. - Site landscaping for a new pathway around the south end of Building "A" from the level 1 deck to the parking lot. It is imperative that construction occur during this two month period which is the tourist off-season for the Chateau Roaring Fork. Building Code A. The 1988 Edition of the Uniform Building Code is in effect for this project. 2. Temporary Construction and Facilities A. Job Telephone: Provide temporary telephone and install when work is started, maintain until full completion, pay all charges. Allow all those connected with the work to use, provided they pay for toll calls. B. Utilities: Water and electricity for construction will be paid by the Contractor. Ascertain where these services will be available, make temporary connections as required, and remove same upon completion of the work. C. Toilets: Provide chemical type toilets, adequate in number for all those connected with the work. Locate where directed when work is started; keep in sanitary condition. Remove from site upon completion of work. D. Job Sign: Provide job sign, size, wording, colors and location as approved by the City of Aspen and the Architect. E Barricades: Provide temporary barricades and walkways according to the requirements of the City of Aspen and obtain all necessary permits. Barricades and walkways are to be kept in neat repiir throughout the project and are to be removed as soon as practical. The Contractor shall make every effort to keep the barricades as close to the project as possible to eliminate interference with pedestrian and vehicular traffic. 3. Demolition A. General: The Contractor shall obtain all permits necessary and shall . complete the demolition work specified in the drawings and remove all debris from the site. 1 .]1 B. Protection of Persons and Property: Extend the requirements of the General Conditions to include protection and security of condominiums and neighboring property, occupants of said property, customers, visitors and passer-by from injury and discomfort caused by dust and debris. 4. Maintenance Manuals and Instructions A. General: Before final payment, furnish to the Owner through the Architect, two copies of manufacturer's manuals of instruction for proper care and maintenance of materials and equipment installation under the Contract. In addition, and when so requested, instruct Owner's maintenance personnel as to such care and maintenance. 5. Products, Materials and Equipment A. General: Provide products, materials and equipment which comply with the requirements, and which are undamaged and unused at the time of installation, and which are complete with accessories, trim, finish, safety guards and other devices and details needed for a complete installation and for the intended use and effect. Where available, provide standard products of types which have been produced and used previously and successfully on other projects and in similar applications. B. Installation: Except as otherwise indicated, comply with the manufacturer's instructions and recommendations for the installation of products in the applications indicated. Anchor each product securely in place, accurately located and aligned with other work. Clean exposed surfaces and protect as necessary to insure freedom from damage and deterioration at time of acceptance. 2 STEEL RAILINGS 1. General: A. General items in this section include steel handrails and guardrails. B. Provide handrails and guardrails capable of withstanding the following - structural loads without exceeding the allowable design working stress of materials involved: 1. Top rails of guardrail systems: Concentrated load of 2001bf applied at any point and in any direction and a uniform load of 501bf applied horizontally and concurrently with a uniform load of 100 1bf per linear ft. applied vertically downward. Concentrated load need not be assumed to act concurrently with uniform loads. 2. Handrails not serving as top rails: Concentrated load of 200 1bf applied at any point and in any direction and uniform load of 501bf per linear ft. applied in any direction. Concentrated load need not be assumed to act concurrently with uniform load. 3. Infill area of guardrail system: Horizontal concentrated load of 200 1bf applied to one sq. ft. at any point in the system including panels, intermediate rails, balusters, or other elements composing the infill area. Loads on infill area need not be assumed to act concurrently with loads on top rail. C. Testing: Comply with ASTM E 985 based on testing per ASTM E 894 and E 935. D. Submittals: In addition to product data, submit the following: 1. Shop drawings showing railing layout and details of components, with structural computations. 2. Samples of each type of metal finish indicated. 2. Products: A. Steel and Iron: Provide steel and iron in the form indicated complying _ with the following requirements: 4 L 1. Cold formed steel tubing: ASTM A 500, grade as indicated below: a. Grade A, unless otherwise indicated or required by structural loads. 2. Hot-formed steel tubing: ASTM A 501 3. Steel plates, shapes and bars: ASTM A 36 B. Fasteners: Same material as fastened metal; concealed unless otherwise indicated or unavoidable and standard with systems indicated. 3 C. Fabrication: Fabricate handrails and railings to design, dimensions and details indicated and as required to support structural loads. D. Welded connections: Use fully welded joints for permanently connecting railing components. Cope or butt components to provide 100 percent contact or use manufacturer's standard fittings designed for this purpose. E. Expansion joints: Install expansion joints at locations indicated but not further apart than required to accommodate thermal movement. F. Form changes in direction of railing members as follows: 1. By inserting prefabricated elbow fittings. 2. By radius bends of radius indicated. 3. By bending. 4. By any method indicated above, applicable to change of direction involved. G. Provide closed ends, brackets, flanges, sleeves, hinges and latches as required for type of installation indicated. H. Ferrous metal paint finish: 1. Shop Prime with Benjamin Moore IronClad Retardo Rust Inhibitive Paint(163) or approved alternate compatible with acrylic latex finish coat. 2. Finish: 2 coats Benjamin Moore Impervex Enamel(309), high gloss finish/acrylic latex or approved alternate. 3. Execution: A. Set work accurately in location, maintaining alignment and elevation and free from rack. B. Close ends of returns. C. Comply with applicable AWS code where welding is required or indicated. D. Preparation for finish by fabricator: 1. Grind joints and welds smooth. 2. All surfaces must be free of residual deposits of grease and oil and shall be cleaned in accordance with SSPC-SP1-63, "Solvent Cleaning". 3. Surfaces that exhibit rust formation, mill scale, etc., must be cleaned in accordance with SSPC-SP3-63, "Hand Tool Cleaning", or SSPC-SP#-63, "Power Tool Cleaning". Particular care is to be exercised to remove welding flux, slag and fume deposit as is possible 4 by blast cleaning, washing with water, phosphate rinsing, or power tool cleaning. Weld splatters and bum must be removed. 4. Apply primer coats in strict accordance with manufacturer's instructions without delay, before rust appears. E. On site preparation for finish: 1. Grind field welds smooth. 2. Prepare surfaces in accordance with paragraphs 3.D.2. & 3.D.3 above. 3. Sand lightly. 4. Field apply additional primer coats to exposed areas without delay, before rust appears. 5. Apply finish coats in strict accordance with manufacturer's instructions. 5 MEMBRANE WATERPROOFING 1. General: A. Furnish and install a fully adhered membrane waterproofing system in strict accordance with the drawings and specifications. 2. Quality assurance: A. Apply membrane waterproofing system using a contractor authorized by the manufacturer. B. Upon completion of the installation, an inspection shall be made by a representative of the manufacturer to ascertain that the membrane system has been installed according to the manufacturer's approved specifications and details. Upon approval of the project, a warranty shall be written for a five(5) year period. 3. Delivery and Storage: A. All materials shall be delivered with appropriate packaging labels indicating appropriate warnings, storage conditions, lot numbers and usage instructions. B. Materials shall be stored in original packaging and conditions shall be maintained in accordance with the manufacturer's instructions. 4. Materials: A. Membrane waterproofing shall be .045 in. nominal thickness, scrim- reinforced uncured Hypalon sheet manufactured by Hi-Tuff Roofing Systems or approved equal. B. Alternate membrane waterproofing shall be 60 mil thick EPDM elastomeric membrane manufactured by GenCorp Polymer Products or approved equal. C. Substrate protection material shall be plywood or insulation board as approved by the manufacturer for Hypalon fully adhered installations. D. Furnish related materials such as flashings, fasteners, bonding adhesives, sealants, primers and solvents in accordance with the manufacturer's specifications. 6 5. Execution: A. The substrate shall be prepared by the contractor in strict accordance with the manufacturer's instructions and shall be approved by the manufacturer before installation of the membrane. The substate shall be smooth and free of debris, sharp edges and any other significant irregularities prior to the start of work. B. APPLICANT: Chateau Roaring Fork Association represented by John Baker LOCATION: 1039 E. Cooper ZONING: R-MF APPLICANT'S REQUEST: The applicant wishes to rebuild several upper story decks and walkways at the condominium. The existing decks and walkways are structurally unsafe by current building code requirements. This request involves a basic one-for-one replacement to upgrade the safety of the structure and does not involve any contact with the river or bank. Later this year the applicant will return with a full stream margin application to replace the river-level decks including new foundations along the bank. ENGINEERING REFERRAL COMMENT: Having discussed the proposal with the project designer and Planning staff, Jim Gibbard concurs that this proposal meets the requirements for a stream margin exemption. STAFF COMMENTS: As described above, this project takes place on the upper floors of the condo building directly adjacent to the river. The residents of the building will be vacating the structure during the 8-10 weeks of construction. Exemption from full Stream Margin review is possible when the following standards are met: 1. The development does not add more than 10% to the floor area or increase exempt floor area by more than 25%. RESPONSE: The development is proposed to replace existing deck and walkway structures. No expansions will occur. 2. The development does not require the removal of any trees requiring a removal permit. RESPONSE: No trees need to be removed by this project. 3. The development is located such that no portion of the expansion, remodeling or reconstruction will be any closer to the high water line than is the existing development. RESPONSE: The existing and proposed decks are approximately 10 feet and more above the high water level. This work will not affect the flood level of the river, nor be closer to the high water line than the existing decks and walkways. 4. The development does not fall outside of an approved building envelope, if one has been designated though a prior review. RESPONSE: The deck replacement does not fall outside of the existing building envelope. 5. The expansion, remodeling or reconstruction will cause no increase in amount of ground coverage of structures within the Special Flood Hazard Area. RESPONSE: The deck replacement will cause no increase to the amount of ground coverage within the flood hazard area. STAFF RECOMMENDATION: Staff recommends approval of Stream Margin exemption for the Chateau Roaring Fork deck and walkway replacement with the following conditions: 1. All demolition debris must be prevented from falling in the river by using protective barricades or netting erected underneath the work area prior to any demolition. 2. This exemption applies only to the 2nd, 3rd, and 4th level deck work. Full Stream Margin review is required for the next phase of demolition/construction. The existing 6x12 timber beams which support four levels of decks on the east face of the building(overhanging the Roaring Fork River) have aged to the point where they are sagging and desperately in need of additional structural support. In addition, the decks are required for emergency exiting from the fourth floor, and according to engineering calculations, do not meet current Uniform Building Code structural design load requirements for exiting. Therefore, the Chateau Roaring Fork Condominium Association has decided to repair the decks by adding the necessary structural supports while at the same time undertaking additional aesthetic and building code compliance repairs. The structural work consists of two measures. The first step is to reduce the structural dead load by removing the existing 3" to 4" concrete topping and cutting back all decks by approximately 6" in width. The second step is to add structural steel beams and columns along the outermost edge of the decks to support the loads required by the UBC for emergency exiting. The structural design calls for new steel columns which support the decks and rest on new concrete piers situated within the Roaring Fork River#oodway as currently mapped. Municipal Code Chapter 24, Section 7-504, Part C does not allow construction within a floodway, therefore, the Chateau Roaring Fork Condominium Association has begun the process of applying for a revision to the floodplain information map which, when approved by FEMA, will relocate the floodway far enough away from the building to allow construction of the piers. The deck repair project has been split into two phases in order for construction to remain on schedule and to allow time for the lengthy map revision and permit approval process. Phase 1 construction includes nearly all structural steel, stair and handrail work above the floodplain and is scheduled to begin on April 8th and be completed by June 10, 1991. Phase 2 construction includes the concrete piers and is scheduled to begin as soon as the floodplain information map has been revised and the building permit is approved. This application for exemption addresses Phase 1 only. An application for Stream Margin Review for Phase 2 will be submitted at a later date. RESPONSE TO AFFACHMENT 4 Chateau Roaring Fork Deck Repair Project - Phase l 1. The deck repairs do not add any floor area to the existing structure. 2. The deck repairs do not require the removal of any tree. 3. The deck repairs are no closer to the high water line than the existing development. 4. The deck repairs do not fall outside of the existing building envelope. 5. The deck repairs will cause no increase to the amount of ground coverage of the structures within the Special Flood Hazard Area.
