SUMMARY: Planning staff recommends approval of Stream Margin
Exemption for the construction of a new duplex.
APPLICANT: David Muckenhirn
LOCATION: 1031 E. Hyman (Lots H,I and part of J, Block 34, East
Aspen Addition)
ZONING: The 8,747 s.f. lot is zoned R /MF (Residential Multi -
Family).
APPLICANT'S REQUEST: The applicant wishes to replace an existing
7 bedroom duplex with a six bedroom duplex. See sketches,
Attachment "A ". Although the drawing appears to indicate that the
proposed development is outside of the area of stream margin
review, Zoning Official Bill Drueding measured the site with the
assistance of the owner and determined that the new structure will
be approximately 75 to 80 feet from the water's edge.
STAFF COMMENTS: No part of the proposed additions /replacements are
within the 100 year floodplain. Per the inspection by the Zoning
Official, the nearest part of this development is approximately
75 to 80 feet from the high water line of the Roaring Fork River.
A unique situation exists for this property in that the Chateau
Eau Claire Condominiums are situated between it and the river.
Because of this configuration, staff has agreed to account for the
condo structure's dimensional data for this project's review.
Exemption from full Stream Margin review is possible when the
following standards are met:
1. The proposal does not add more than 10% FAR or more than 25%
of building exempt from FAR.
RESPONSE: Existing floor area on the Chateau Eau Claire parcel
is approximately 28,900 s.f. according to the application. The
existing structure on the subject parcel is approximately 2,900
s.f. of FAR. The proposed replacement duplex is 4,457 s.f., for

an increase of 1,557 s.f. This represents an FAR increase of 5%
over the combined existing FAR of the duplex and the condos of
30,900 s.f.
2. No trees will be removed, or required removal permits are
granted.
RESPONSE: No trees will be removed with this proposal. The
subject parcel is essential void of any trees.
3. No portion of the expansion, remodeling, or reconstruction
will be any closer to the high water line than the existing
development.
RESPONSE: The Chateau Eau Claire is basically at the water's
edge. The proposed duplex will be approximately 75 -80 feet from
the riverbank. Staff believes that this criteria is more than
satisfied.
4. The development does not fall outside of an approved building
envelope, if one has been designated through prior review.
RESPONSE: Per the standard above, the footprint of the Chateau Eau
Claire is the nearest "envelope ", and the proposed duplex does not
exceed this boundary.
5. The remodeling or expansion will cause no increase to the
ground coverage within the Special Flood Hazard Area.
RESPONSE: The proposal is outside of the 100 year floodplain.
STAFF RECOMMENDATION: Staff recommends approval of Stream Margin
exemption for the new duplex located at 1031 East Hyman Ave.

Avenue, Aspen, CO.
Dear Rim:
Because the N.E. corner of the property located at 1031 E. Hyman
Avenue, Aspen, Colorado is located approximately 75 feet from the
Roaring Fork River, its proposed development technically requires
a Stream Margin Review. However, because the Subject Property is
not contiguous to the river and there is a fully developed property
with a 40 x 220 four story condominium building (The Chateau Eau
Claire) between it and the river, development of the Subject
Property would have minimal or no impact on the river, the riparian
environment of the river or the flood plain. Additionally, the
Subject Property grade (present and proposed) is approximately 14
feet above the river. Because of these considerations an exemption
from a Stream Margin Review is hereby requested.
The legal description of the Subject Property is:
Lots H, I and a fraction of J, Block 34, East Aspen
Addition Townsite, Aspen, Colorado.
Enclosed you will find a 3}" x 11" vicinity map locating the
Subject Parcel as survey plat of the area, and a copy of my current
title insurance policy.
The proposed development would replace the existing 7 bedroom
duplex with a 6 bedroom plus 2 ADU duplex.
The existing duplex has a floor area of approximately 2,900 square
feet. The proposed duplex has floor area of 4,457 square feet.
The Chateau Eau Claire has a floor area of approximately 28,900
square feet. Therefore, the development adds 1,557 square feet or
5% to the floor areas of the combined existing structures.

The proposed development does not require the removal of any trees.
No portion of the expansion will be any closer to the high water
line than is the existing development - that is the Chateau Eau
Claire.
The proposed development falls entirely inside the approved
building envelope and will cause no increase to the amount of
ground coverage of structures within the Special Flood Hazard Area.
