HALLAM LAKE PIPELINE STREAM MARGIN REVIEW
On October 2, 1990, the Planning and Zoning Commission approved
the pipeline project with the following conditions (as amended by
P &Z) :
1. Any trees which are removed along the route must receive a
tree removal from the Parks Department. They must be replaced
immediately upon project completion. Replacement shall be one
for one with 2.5" caliper trees of the same species.
2. Prior to excavation permit issuance, a barricade fence shall
be erected across the Art Museum parcel defining vehicular
movement and materials storage during construction.
3. Where the pipeline crosses the Rio Grande right -of -way, the
pipe must be deep enough and strong enough to allow for future
train traffic.

RESOLUTION OF THE ASPEN PLANNING AND ZONING COMMISSION
FOR THE APPROVAL OF THE HALLAM LAKE PIPELINE STREAM MARGIN REVIEW
Resolution No. 90- /4
WHEREAS, in order to restore groundwater flow to Hallam Lake
lost as a result of construction of the Rio Grande Parking
Garage, the Aspen City Council directed the Engineering
Department to design a gravity fed pipeline system; and
WHEREAS, the most workable route was determined to run
through the river corridor in the Art Museum area; and
WHEREAS, the Engineering Department submitted for approval
to the Commission an application for Stream Margin Review; and
WHEREAS, the Planning staff recommended approval of the
Stream Margin Review with conditions; and
WHEREAS, the Commission reviewed and approved the Stream
Margin Review with conditions by a 7 -0 vote on October 2, 1990.
NOW, THEREFORE, BE IT RESOLVED by the Commission:
That it does hereby approve by the Hallam Lake Pipeline Stream
Margin Review with conditions as follows:
1. Any trees which are removed along the route must receive a

NOTICE
The City of Aspen will commence construction of the Hallam
Lake Water Supply on or about October 10, 1990. The
construction is anticipated to be completed by early
November, 1990. The improvements include installation of
water mains from the existing parking structure underdrain at
the Roaring Fork River, across the river and the Holy Cross
Electric property (near the Art Museum) to a second river
crossing at Mill Street and the Aspen Consolidated Sanitation
District (ACSD) driveway. The pipeline will cross Mill Street,
enter the ACSD property at the driveway, cross the ACSD
property near the south property line, cross the Rio Grande Trail
and continue westerly across the ACES property to Hallam
Lake.
An on -site discussion of the proposed construction will be held
at 12:00 noon, Tuesday, October 9, 1990. The meeting location
is at the Arts Park on the south side of the Roaring Fork River,
east of Mill Street.

Given the urgency of the timing to get the project complete before
snow, and Council's firm decision to have a gravity feed system, Jim
Jed and I went for the alternate route with great speed. In effect,
we had to get it approved for stream margin at the next upcoming P &Z
meeting which was about 6 days later. Jim and I worked to get the
memo out within two days. The Engineers,I felt, were in concert on
this project, under Bob's wing. I agree this was not ordinary
procedure, but the project has been unusually pressured timewise.

past we have tried to be careful to provide proper procedure for city
projects and subject them to all appropriate public processes. In
previous instances, one engineer will prepare application and a
different one will review, ye goode olde checks and balances system.

SUMMARY: The Planning Office recommends approval of this Stream
Margin Review with conditions.
APPLICANT: City of Aspen Engineering Department
LOCATION: The pipeline will start at the current discharge point
of the parking garage drainage into the Roaring Fork River, on
the west side of the pedestrian trestle bridge. The line will
cross under the river, crossing the wooded area in the bulge of
the river to the s.w of the Art Museum, crossing under the river
again just west of the Mill St. bridge. It then crosses under
Mill St. and traverses the Sanitation District property. Please
see Attachment "A" for the entire alignment.
ZONING: PUB (H) - Art Museum, Park (D), and PUB - Sanitation
District facility
APPLICANT'S PROPOSAL: The City of Aspen has committed to
continue the supply of warm spring water to Hallam Lake in order
to protect the lake from freezing during the winter.
Construction of the Rio Grande Parking Garage interrupted this
flow last year. The gravity -fed pipeline route being considered
in this review avoids a lengthy section through private property
where purchase of an easement would cost the City around one
hundred thousand dollars.
REFERRAL COMMENTS: Jim Gibbard, project Engineer for the City has
prepared the application. He has been working with the City
Attorney to prepare easement documents and ownership disclosures
for affected property not owned by the City. Attachment "B ".
Roxanne Eflin indicates that the Art Museum building is historic
as reflected by the "H" overlay, but the pipeline alignment will
not affect it.
STAFF COMMENTS: Any proposed development within 100' of the high
water line or within a flood hazard area must receive Stream
Margin approval. Stream Margin applications are reviewed by the
Planning and Zoning Commission according to the standards set
forth in Section 7 -504 of the Aspen Land Use Code (August 1989):
1. It can be demonstrated that any proposed development which
is in the Special Flood Hazard Area will not increase the
base flood elevation on the parcel proposed for development.
This shall be demonstrated by an engineering study prepared
by a professional engineer registered to practice in the
State of Colorado which shows that the base flood elevation
will not be raised, including, but not limited to, proposing
mitigation techniques on or off -site which compensate for
any base flood elevation increase caused by the development.
response: The pipeline will be underground and backfilled to
original grade causing no increase in the base flood elevation.
2. Any trail on the parcel designated on the Aspen Area
Comprehensive Plan: Parks /Recreation /Open Space /Trails Plan
map is dedicated for public use.
response: There are existing trails on the public property and
these will remain.
3. The recommendations of the Roaring Fork Greenway Plan are
implemented in the proposed plan for development, to the
greatest extent practicable.
response: The applicant will take all practical measures to
minimize disturbance to the land and will revegetate as needed.
The land will otherwise remain in as natural a condition as
currently exists.
4. No vegetation is removed or slope grade changes made that
produce erosion and sedimentation of the stream bank.
response: The slope will be replaced to original conformation
after the line is installed. There is little vegetation in the
immediate area of the river crossing and that which is removed
shall be replaced. A site inspection with the contractor prior
to the Commission meeting will reveal an exact tally of tree
removal. Photos of the route will be presented at the meeting.
At the time of this writing, it is anticipated that a couple of
small to medium trees in the Art Museum woods might have to be
removed during installation. Replacement with healthy young
trees of same species will be a requirement.
5. To the greatest extent practicable, the proposed development
reduces pollution and interference with the natural changes
of the river, stream or other tributary.
response: Every attempt will be made to limit pollution during
installation. No changes will be made to the water course.
6. Written notice is given to the Colorado Water Conservation
Board prior to any alteration or relocation of a water
course, and a copy of said notice is submitted to the
Federal Emergency Management Agency.
response: Not applicable as the water course will not be
changed.
7. A guarantee is provided in the event a water course is
altered or relocated, that applies to the developer and his
heirs, successors and assigns that ensures that the flood
carrying capacity on the parcel is not diminished.
response: Same as no.6.
8. Copies are provided of all necessary federal and state
permits relating to work within the one hundred (100) year
floodplain.
response: A nationwide permit from the Any Corps of Engineers
is forthcoming.
STAFF RECOMMENDATION: The Planning Office recommends approval of
this Stream Margin Review with one condition:

GENERAL SUMMARY OF APPLICATION PROCESS

flood hazard area. This project will take place in the vicinity
of the Art Museum property. We have addressed all of the Stream

Stream Margin Review Criteria
No development shall be permitted within the floodway, with the
exception of bridges or structures for irrigation, drainage,
flood control or water diversion, which may be permitted by the
City Engineer, provided plans and specifications are provided
demonstrating the structure is engineered to prevent blockage of
drainage channels during peak flows and the Commission determines
the proposed structure complies, to the extent practical, with
all the standards set forth below.
No development shall be permitted within one hundred
feet (100'), measured horizontally, from the high water
line of the Roaring Fork River and its tributary
streams, or within the Special Flood Hazard Area where
it extends beyond one hundred feet (100') from the high
water line of the Roaring Fork River and its tributary
streams, unless the Commission makes a determination
that the proposed development complies with all the
standards set forth below.
1. It can be demonstrated that any proposed develop-
ment which is in the Special Flood Hazard Area

parcel proposed for development. This shall be

elevation since this development is underground.

RESPONSE: The designated trails on these parcels are on public
property and therefore dedicated for public use.
3. The recommendations of the Roaring Fork Greenway

RESPONSE: The above recommendations will be followed to the
greatest extent practicable.
4. No vegetation is removed or slope grade changes
made that produce erosion and sedimentation of the

RESPONSE: The stream banks will be adequately revegetated and
there will be no slope grade changes made.
5. To the greatest extent practicable, the proposed
development reduces pollution and interference
with the natural changes of the river, stream or
other tributary.
RESPONSE: During the construction procedure, every attempt
possible will be made to reduce pollution and there
will be no interference with the natural changes of
the river.
6. Written notice is given to the Colorado Water
Conservation Board prior to any alteration or
relocation of a water course, and a copy of said
notice is submitted to the Federal Emergency
Management Agency.
RESPONSE: There will be no alteration or relocation of the
water course.
7. A guarantee is provided in the event a water

Re: Hallam Lake Waterline Stream Margin Review
Dear Kim:
Jim Gibbard of the Engineering Department has asked that I supply
the following information pursuant to the City's stream margin
review application pertinent to the construction of the Hallam
Lake waterline.
Attached hereto as Exhibit "A" is a photocopy of a Warranty Deed
illustrating the City's ownership of the parcel of land commonly
known as the Rio Grande SPA. The proposed pipeline will traverse
the Rio Grande parcel on a line running from the municipal
parking garage almost due north to the Roaring Fork River. After
crossing the river near the pedestrian /bike path bridge, the
pipeline will run across a parcel commonly known as the "Art
Museum Property ". This parcel was placed in escrow for the
benefit of the City in May, 1978, as part of an agreement between
the City and the Holy Cross Electric Association, Inc. Pursuant
to that agreement, Holy Cross conditionally conveyed title to the
parcel to the City as partial consideration for the City awarding
a twenty year franchise to Holy Cross to provide electric service
in the City. The executed deed is held by the First National
Bank of Glenwood Springs as the designated escrow agent. The
escrow will expire in 1997, thus permitting actual delivery of
the deed to the City. During the escrow period, the City is
entitled to the exclusive possession and use of the parcel and
may undertake improvements thereon such as the installation of
the pipeline.

George Robinson called and reminded me that tree removal permits will
be required for this project! It is critical that this is taken care
of by you or the contractor prior to commencement (this reminds me -
an excavation is required, yes ?) Also - he informed me that tree
replacement shall be with 2.5" caliper trees, not 1.5" as I had
stated in my recommended conditions of approval. Please update your

the notice. It should be run for a few days next week. I guess Bob
